HomeMy Public PortalAboutZoning Ordinance Supplement - R1A (Woods Estates)ORDINANCE NO. 2016-201 AdOD AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF RIVERDALE, IOWA. Be It Enacted by the City Council of the City of Riverdale, Iowa: That the Zoning Ordinance of the City of Riverdale, Iowa be amended as follows: 1. Article 111, District Boundaries and General Regulations, is amended by striking the language "seven (7)" and substituting the language "eight (8)" and adding as a District an "R-1 A" Single - Family Residential District. 2. At Section 35, Fence Regulations, the "R-1 A" District is added as a District subject to the fence regulations. 3. Article IV -A is added to the Zoning Ordinance and the following is adopted as the "R -IA" Single -Family Residential District Regulations: ARTICLE IV -A "R -1A" SINGLE-FAMILY RESIDENTIAL DISTRICT REGULATIONS SECTION 40A. TITLE. The regulations set forth in this Article or set forth elsewhere in this Ordinance when referred to in this Article are the district regulations in the "R -1A" Single - Family Residential District. SECTION 41A. USE REGULATIONS. A building or premises shall be used only for the following purposes: 41A.01. Single -Family Dwellings covering a minimum ground area of twelve hundred (1,200) square feet for a single story and eight hundred and fifty (850) square feet for a two-story dwelling. 41A.02. Farm. 41A.03. Churches and public and private schools. 41A.04. Institutions except institutions for criminals and the insane. 41A.05. Public parks and playgrounds. 41A.06. Home occupations. 41A.07. A Single -Family Dwelling is allowed one (1) attached up to a (4) four car garage without allowance of a separate detached garage structure or storage shed structure provided that such garage structure shall be limited to a maximum size of no more than 40% of the square footage of the finished living space, except all residences may have garage space of at least 704 square feet per garage. Page 1 of 3 SECTION 42A. HEIGHT REGULATIONS. 42A.01. No building hereafter erected or altered shall exceed two and one- half (2-1/2) stories nor shall it exceed forty (40) feet in height except as provided in Article X and XI, SECTION 43A. AREA REGULATIONS. 43A.01. Front Yard. There shall be a front yard having a depth of not less than thirty (30) feet. Where the street is curved, the line shall follow the curve of the street rather than be a straight line. Where lots have a double frontage, the required front yard shall be provided on both streets. Where a lot is located at the intersection of two or more streets, there shall be a front yard on each street side of the corner" lot, except that the buildable width of such lot shall not be reduced to less than fifty (50) feet, No accessory building shall project beyond the front yard line on either street. 43A.02. Side Yard. There shall be a side yard on each side of a building having a width of not less than ten (10) feet with a minimum combined side yard of not less than twenty (20) feet. No accessory building shall project beyond the side line of the main building as extended. 43A.03. Rear Yard. There shall be a rear yard having a depth of not less than thirty (30) feet. 43A.04. Intensity of Use. Every lot or tract of land for a Detached Single - Family Dwelling shall have an area of not less than seventeen thousand four hundred twenty-four (17,424) square feet and a minimum width of not less than seventy-five (75) feet for a lot fronting on a cul-de-sac and a minimum width of not less than ninety-six (96) feet for all other lots. 43A.05. Location on Lot of Satellite Receivers. No satellite receiver shall be erected or placed unless a permit therefore has been obtained from the Building Inspector. No satellite receiver shall be located on any residentially zoned lot except as set forth herein. a. No satellite receiver shall be erected or placed in or on any front or side yard, or any vacant lot. b. A satellite receiver may be erected or placed in any rear yard provided that it is located no nearer to any side lot line that the required or actual distance between the principal building on said lot line and the side lot line, whichever is greater and no less than twenty (20) feet from the rear lot line; and, provided that a satellite receiver must be located at least thirty (30) feet from any rear yard lot line that abuts a public street or highway, c. No satellite receiver in excess of three (3) feet in diameter shall be erected upon or affixed to any building. d. A satellite receiver may be erected or placed in any corner lot provided it is located only in the yard that is opposite the yard used for the street address of the residence. Page2of3 43A.06. Lots Abutting "R-1" District. Any platted lot in an "R -1A" District that directly abuts a currently platted lot in an "R-1" District must maintain the minimum side yard width requirements of the "R-1" District. 4. General. a. The "R -1A" Single -Family Residential District shall be applicable to lots or tracts of land which are re -zoned from an existing zoning classification to an "R -1A" Single -Family Residential District after the effective date of this Ordinance. b. The existing "R-1" Single -Family Residential District will remain unchanged by passage of this Ordinance. c. Severability Clause. If any section, provision or part of this Ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. d. This Ordinance shall be in effect from and after its final passage, approval, and publication as provided by law.
