COUNCIL MINUTES
DECEMBER 18, 1990 - REGULAR MEETING
The regular monthly meeting of the Bal Harbour Village Council
was held on Tuesday, December 18, 1990 at 9:30 a.m. in the Council
Chambers at Village Hall. The meeting was called to order at 9:30
a.m. by Mayor Estelle Stern and the roll was called. Those present
were:

Councilman James E. Boggess
Councilman Andrew R. Hirschl
Also present: Village Manager Carole S. Morris
Village Attorney Richard J. Weiss
Administrative Assistant Teresa M. Smith
Absent: Councilman Sol M. Taplin
As a quorum was found to be present, the meeting commenced.
2. Approval of Minutes: A motion was offered by Mr. Hirschl
and seconded by Mr. Blank to waive the reading and approve the
minutes of the November 20, 1990 Regular Meeting as submitted.
There being no changes or corrections, the motion carried
unanimously (4-0) and the minutes were approved as submitted. A
motion was offered by Mr. Blank and seconded by Mr. Boggess to
waive the reading and approve the minutes of the November 27, 1990
Special Meeting as submitted. There being no changes or
corrections, the motion carried unanimously (4-0) and the minutes
were approved as submitted. A motion was offered by Mr. Blank and
seconded by Mr. Boggess to waive the reading and approve the
minutes of the December 11, 1990 Special Meeting as submitted.
There being no changes or corrections, the motion carried
unanimously (4-0) and the minutes were approved as submitted.
3. Presentations: Police Chief Treppeda recognized Steven
Goldberg as Officer of the Month for November, 1990 for his hard
work and persistence, specifically in three cases which Chief
Treppeda detailed to Council. Officer Goldberg was presented with
a plaque and a check for $100.
Bal Harbour Village employee Pamila Thompson was recognized
for her achievement, having met the requirements thereof, of
attaining the status of "Professional Public Buyer". Mrs. Morris

presented her with a Certificate from the National Institute of
Governmental Purchasing.
4. Public Hearing: Mayor Stern opened a Public Hearing to
consider a request for an operating permit/approval of alcohol
license by Tiberio Ristorante pursuant to Bal Harbour Village Code
Section 21-316 (19). Michael Feldman, attorney for 9700 Collins
Avenue Inc. addressed Council in representation of the applicant.
He advised Council that Giulio Santillo, President of the
corporation, was the prior owner of the restaurant and due to the
fact that the operator he sold to is now in bankruptcy, Mr.
Santillo seeks to re -open this business. Discussion was had
relative to the problems experienced with the previous owner in
collection of resort tax. Attorney Weiss explained the procedure
for collection thereof and noted that there were no problems with
the payment of resort tax by Mr. Santillo previously. There being
no further discussion, Mayor Stern closed the Public Hearing. A
motion to approve this request was offered by Councilman Boggess
and seconded by Mr. Blank. The motion carried unanimously (4-0),
as follows
ORDINANCE OF BAL HARBOUR VILLAGE CREATING
SECTION 8-71 OF THE BAL HARBOUR VILLAGE CODE;
PROVIDING PROCEDURES FOR FILLING A VACANCY IN
CANDIDACY CAUSED BY DEATH, WITHDRAWAL, OR
REMOVAL FROM THE BALLOT OF A QUALIFIED
CANDIDATE FOLLOWING THE END OF THE QUALIFYING
PERIOD WHICH LEAVES FEWER THAN TWO CANDIDATES
FOR AN OFFICE; PROVIDING FOR SEVERABILITY,
INCLUSION IN THE CODE, AND AN EFFECTIVE DATE.
5. Ordinances - Second Reading - None.
6. Ordinances - First Reading: An Ordinance was presented to
Council on first reading which would provide procedures for filling
a vacancy in candidacy caused by death, withdrawal, or removal from
the ballot of a Qualified candidate following the end of the
qualifying period which leaves fewer than two candidates for an
office. This Ordinance was read by title by Mrs. Smith. Mayor
Stern then opened a Public Hearing, and hearing no comment, closed
the Public Hearing. A motion was offered by Mr. Hirschl and
seconded by Mr. Blank to approve this Ordinance on first reading.
There being no further discussion, the motion carried unanimoulsy
(4-0).
7. Resolutions: - None.
8. Reports and Recommendations:
A. Mayor and Council: Mayor Stern noted that the
Employees Holiday Fund is distributed among all Bal Harbour Village

employees with the exception of the Village Manager and in order to
express appreciation to her for her hard work, suggested a bonus be
given to Mrs. Morris. It was noted that in past years, one week's
pay was given to the Manager. A motion was offered by Mr. Boggess
and seconded by Mr. Hirschl to grant a bonus of one week's salary
to Mrs. Morris. The motion carried unanimously (4-0).
The next item to come before Council was the Village Clerk
Selection process. Having been presented with the Selection
Committee's recommendation of eight names, a motion was offered by
Mr. Boggess and seconded by Mr. Blank to interview the top four
applicants submitted by the Committee, i.e. Jeanette Horton, Teresa
Smith, Jeffrey Naftal and Sherrie Harris. These interviews would
be conducted by Council at the January regular Council meeting
scheduled for January 15, 1990 and be approximately 15 minutes
each.
B. Village Attorney: Mr. Weiss brought Council up to
date regarding the matters of Over 50 Productions, Sheila Levinson
and the problem regarding police retirement funds.
C: Village Manager: Having received a request from the
Sheraton Bal Harbour and the University of Colorado to allow
"Ralphie" their buffalo mascot to visit Bal Harbour once again this
year at the Sheraton Bal Harbour from December 29th - January 2nd,
Mrs. Morris requested and received Council's approval thereof.
9. Other Business: Oath of Office - Special Masters: Bal
Harbour Village residents John Arenstam and Darcee Seigel were
sworn in by Mrs. Morris as Special Masters for the Village. Ben
Oremland, unable to attend at this time, will be sworn in at a
later date.
10. Adjourn: There being no further business to come before
Council, a motion was offered by Mr. Bogqess and seconded by Mr.
Hirschl to adiourn. The motion carried unanimously (4-0) and the
meeting adjourned at 10:15 a.m.
