HomeMy Public PortalAbout2013-02 Resolution Est. 2013 Appointment & Designations to Various City ServicesMember Weir introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2013-02 ESTABLISHING 2013 APPOINTMENTS AND DESIGNATIONS TO VARIOUS CITY SERVICES, AUTHORITIES, COMMISSIONS, AND AGENCIES WHEREAS, the City contracts with various consultants and businesses to provide services to the City, and WHEREAS, the City is required to appoint City representatives to City commissions as well as area jurisdictions, agencies, authorities and commissions as indicated by governing documents, State statute, or City codes. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Medina hereby establishes the 2013 appointments and designations listed on Exhibit A. Dated: January 3, 2013. T.M. Designation of Official City Legal Newspaper South Crow River News Planning Commission Appointments Three Year Term Kent Williams Three Year Term Kathleen Martin One Year Term Mark Osmanski Park Commission Appointments Three Year Term Janet White Three Year Term Steven Lee Resolution No. 2013-02 January 3, 2013 2 WHEREAS, the City Council held a public hearing on the application at the December 18, 2012 and took additional testimony and continued discussion at the January 3, 2013 meeting; and WHEREAS, based on the written and oral record before the Planning Commission and City Council on the above dates as well as all additional written testimony submitted to the City, the City Council makes the following findings of fact in regards to the application: 1. The proposed variances are consistent with the Comprehensive Plan, subject to the more restrictive limitations on hardcover, the requirement that stormwater improvements be constructed, and the other conditions noted below. 2. The proposed variances are in harmony with the general purposes and intent of the Zoning Ordinance, subject to the more restrictive limitations on hardcover, the requirement that stormwater improvements be constructed, and the other conditions noted below. 3. A11 procedural requirements related to the review of the variance request have been satisfied, all of the variances granted herein have been articulated and discussed at numerous public meetings, and the written record of the City has accurately described and interpreted City ordinances. 4. When all applicable setbacks are applied to the Property, the portion of the parcel not constrained by a setback is narrower than required to construct a home meeting the minimum standards of the Zoning Ordinance. 5. The Property is located within a single-family residential zoning district and the proposed single-family home is similar in size and footprint to and of the same character as other homes in the area and within the same district and is a reasonable use for the Property. 6. The Property cannot be put to the reasonable use proposed as a result of the constraints of the Zoning Ordinance. The proposed variances are the minimum necessary to put the Property to such reasonable use. 7. The proposed variances do not confer special privileges which are not afforded to owners of other lands, structures, or buildings in the same district, as evidenced by the comparable size and location of other homes in the neighborhood and the variances granted to other owners in the area. 8. The plight of the landowner is due to the narrowness of the lot remaining after taking into consideration the overlapping setback requirements from Ardmore Avenue and Lake Ardmore. These circumstances are unique to the Property and are not created by the landowner. 9. The granting of the variances permit the construction of a home that is similarly located and is of similar size to other homes in the area and will not alter the essential character of the neighborhood. 10. The Applicant has established that there are practical difficulties in complying with the requirements of the Zoning Ordinance. NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota approves the following variances, subject to the conditions noted in this resolution: Resolution No. 2013-03 2 January 15, 2013 1. The required yard setback adjacent to Ardmore Avenue is hereby reduced from 30 feet to 15 feet. 2. The required yard setback adjacent to the Palm Street right-of-way is hereby reduced from 30 feet to 15 feet. 3. The required setback from the Ordinary High Water Level of Lake Ardmore is hereby reduced from 75 feet to 55 feet. 4. The required setback from the upland buffer is hereby reduced from 15 feet to five feet. 5. A variance is hereby granted to allow construction of the proposed single-family home on the existing lot within the Shoreland Overly District with a lot area less than 20,000 square feet. BE IT FURTHER RESOLVED that the approval granted herein shall be subject to the following terms and conditions: 1. Construction of the home shall be completed as shown on the plans received by the City on November 17, 2012, except as modified in this resolution or as otherwise directed by the City. 2. The home shall be constructed seven feet further to the west from the location shown on the plans received by the City on November 17, 2012. 3. The width of the upland buffer adjacent to the home shall be increased as directed by the City Engineer. 4. Impervious surface coverage on the Property shall not exceed 2700 square feet. 5. If the City constructs a stormwater improvement on or adjacent to the Property, the Applicant shall contribute towards the construction of the improvement in a proportionate amount equivalent to the additional runoff created by the proposed hardcover on the Property. If the City does not construct such a stormwater improvement, the Applicant shall install a raingarden with an area of 200 square feet. The Applicant shall not occupy the home until he has contributed to the stormwater improvement or constructed the raingarden as described herein, or submitted a financial guarantee in a form and of an amount acceptable to the City to ensure this obligation is met. 6. The Applicant shall prepare a tree replacement plan and shall install replacement trees consistent with City regulations. The Applicant shall not occupy the home until the required trees have been planted or a financial guarantee has been submitted in a form and of an amount acceptable to the City to ensure this obligation is met. 7. The Applicant shall prepare an upland buffer zone vegetation plan and shall install required vegetation within the buffer consistent with City regulations. The Applicant shall not occupy the home until the upland buffer is established or a financial guarantee has been submitted in a form and of an amount acceptable to the City to ensure this obligation is met. 8. The Applicant shall grant the City an easement over the upland buffer zone. 9. The Applicant shall grant the City drainage and utility easements over the north, south, and westerly 10 feet of the property, over any stormwater improvements constructed on the Property, and over the wetland and lake areas of the parcel. 10. The grading plan shall be updated so that drainage from the site is directed towards the portions of the upland buffer which are wider. Resolution No. 2013-03 3 January 15, 2013 11. All plans and easements shall be provided and accepted by the City prior to the issuance of any building permit on the Property. 12 The City Engineer shall approve the final grading plan prior to the issuance of any building permit. 13. The Applicant shall install gutters on the lake side of the house with downspouts directed so that runoff is directed towards the wider portions of the upland buffer and, if possible, towards the stormwater improvement to be installed. 14. Additional signs beyond the number required by ordinance shall be installed along the upland buffer in a manner found to be acceptable by the City. The Applicant shall not occupy the home until these signs are installed or a financial guarantee is submitted in a form and of an amount acceptable to the City to ensure this obligation is met. 15. The driveway location shall be approved by the City Engineer prior to the issuance of any building or driveway permit. 16. The Applicant shall begin work within one calendar year of adoption of this resolution, or the variances hereby granted shall be null and void. 17. The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the variance application and the preparation, negotiation and recording of the easements and other relevant documents.
