RESOLUTION 2013-03
RESOLUTION APPROVING VARIANCES FOR JACOB MOSER TO CONSTRUCT A
SINGLE FAMILY HOUSE ON AN UNADDRESSED PARCEL LOCATED EAST OF
ARDMORE AVENUE AND SOUTH OF BALSAM STREET
WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and
existing under the laws of Minnesota; and
WHEREAS, Jacob Moser (the "Applicant") owns property within the City east of
Ardmore Avenue and south of Balsam Street (the "Property") which is legally described as:
Lots 9, 10, and 11, Block 21, Independence Beach, Hennepin County, Minnesota.
WHEREAS, the Applicant has requested variances to allow for construct a single family
house upon the Property; and
WHEREAS, the Property is located within the UR, Urban Residential Zoning District
and the Shoreland Overlay District for Lake Ardmore, which is a Recreational Development
lake; and
WHEREAS, the Applicant has requested variances from the setback requirements from
the Ardmore Avenue right-of-way and the Palm Street right-of-way required by City code
Section 826.35 Subd. 2; and
WHEREAS, the Applicant has requested a variance from the setback requirement from
the Ordinary High Water (OHW) level of Lake Ardmore as required by City code Section 827.06
(a); and
WHEREAS, the Applicant has requested a variance from the setback required from the
upland buffer required by City code Section 828.42 Subd. 5; and
WHEREAS, the Applicant has requested a variance to construct a house on a riparian
Shoreland Overlay District property that contains less than 20,000 square feet of area above the
ordinary high water level of Lake Ardmore as required by City code Section 827.06 (b); and
WHEREAS, the Planning Commission held a duly noticed public meeting to discuss the
application on October 24, 2012, continued discussion at a public meeting on December 11,
2012, and following such discussion recommended approval of the application; and
