AND
THE TEMPLE CITY EMPLOYEE ASSOCIATION
REGARDING NEW EMPLOYEE CONTACT INFORMATION AND ASSOCIATION
ACCESS TO NEW EMPLOYEE ORIENTATIONS FOR UNIT MEMBERS
Pursuant to the provisions of the Meyers-Milias-Brown Act ("MMBA"), the City of Temple
City (the "City") and the Temple City Employee Association ("Association") have met
and conferred and have reached agreement regarding the City's provision of new
employee contact information to the Association and the Association's right to
participate in new employee orientation meetings. Accordingly, this Side Letter of
Agreement is entered between the City of Temple City (the "City') and the Temple City
Employee Association ("Association") as an amendment to Section 1.8 of the
Memorandum of Understanding between the City and the Association, currently in effect
July 1, 2016 through June 30, 2018.
Article 1: General Provisions, is hereby amended to include the following new
Section 1.8:
1.8 Union Access to Employee Information and New Employee Orientation.
A. Definitions.
(1) "Contact Information" means the name, job title, department, work
location; home address; personal email addresses on file with the City;
and work, home, and personal cellular telephone numbers.
(2) "Employee" means a City employee serving in a position represented by
the Association.
(3) "New employee orientation" means the onboarding process of a newly
hired employee, whether in person, online, or through other means or
mediums, in which employees are advised of their employment status,
rights, benefits, duties and responsibilities, or any other employment-
related matters.
B. New Hire Contact Information. Subject to the opt -out provisions set forth in
Subsection 1.8(C) of this Article, the City will provide the Association with the
contact information of newly hired employees within 30 days of the date of
hire. The City also agrees to provide the Union with contact information for all
employees annually, unless otherwise requested.
C. Employee Opt -out Procedures for Personal Contact Information. The City and
Association recognize that employees have a privacy interest in their home
address, home telephone number, and personal cellular telephone number.
Accordingly, an employee may direct that the City refrain from providing such
information to the Association by notifying the City in writing of the type(s) of
information to be withheld from the Association ("opt -out"). Upon receipt of an
employee's written opt -out, the City will immediately cease providing the
Association with the information identified therein. However, all other contact
information not subject to this opt -out provision will continue to be provided to
the Association pursuant to Subsection 1.8(B) of this Article, unless otherwise
required by law.
D. Notice of and Access to New Employee Orientations. Where practical, the
City shall provide the Association with at least 10 days' notice in advance of
any new employee orientation(s). The Association shall have discretion as to
whether a representative will appear in person at the orientation meeting or
whether the Association will prepare written correspondence for the City to
provide during the new employee orientation. One Association representative
shall receive 10 minutes of release time to attend new employee
orientation(s).
