HomeMy Public PortalAbout2013-17 Resolution Approving Final Plat for Enclave at Medina 4th AdditionMember Anderson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2013-17 RESOLUTION APPROVING THE FINAL PLAT OF THE ENCLAVE AT MEDINA 4TH ADDITION WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, U.S. Home Corporation, a Delaware Corporation (the "Applicant'), is the fee owner of land within the City (the "Property") which is legally described as: Outlot E, The Enclave at Medina, Hennepin County, Minnesota; WHEREAS, on April 4, 2011, the City granted approval to the Applicant for a preliminary plat to allow the future platting of property into 40 single family parcels zoned R1, 71 single family parcels zoned R2, and 41 townhome parcels zoned R3; and WHEREAS, the preliminary plat was proposed to be developed in four phases; and WHEREAS, on May 17, 2011, the City granted approval to the Applicant for a final plat of the first phase of the project referred to as "The Enclave at Medina," which included 24 R2 single family parcels, five R3 townhome parcels and also created a number of outlots intended to be replatted in subsequent phases; and WHEREAS, on July 17, 2012, the City granted approval to the Applicant for a final plat of the second phase of the project referred to as "The Enclave at Medina 2nd Addition," which included 12 R1 single family parcels, 38 R2 single family parcels, and which included one fewer R2 single family parcel than shown on the preliminary plat in order to provide area to access property being developed by the Applicant immediately to the east; and WHEREAS, on March 19, 2013, the City granted approval to the Applicant for a final plat of the third phase of the project referred to as "The Enclave at Medina 3rd Addition," which included 28 R1 single family parcels and 8 R2 single family parcels; and WHEREAS, Outlot E, The Enclave at Medina was anticipated for future subdivision consistent with the approved preliminary plat; and WHEREAS, the Applicant has requested to replat Outlot E, The Enclave at Medina to develop the fourth phase of The Enclave at Medina project to include 36 R3 townhome parcels and to be called The Enclave at Medina 4`h Addition; and WHEREAS, the City Council reviewed the final plat at the March 19, 2013 meeting; and Resolution No. 2013-17 March 19, 2013 WHEREAS, the City Council has found that, subject to the terms and conditions contained herein, the plat is substantially consistent with the approved preliminary plat and the requirements of the City's subdivision regulations. NOW, THEREFORE BE IT RESOLVED, by the City Council of Medina, Minnesota that final approval is hereby granted for the plat of The Enclave at Medina 4th Addition, subject to the following terms and conditions: 1. The Applicant shall enter into a development agreement as drafted by the City which shall include the requirements described below as well as other relevant requirements of City ordinance or policy. 2. The Applicant shall address the comments of the City Engineer in the letter dated March 11, 2013. 3. Home owner association documents shall be recorded against the lots as approved by the City in order to address required maintenance of private streets, private open space, storm ponds, wetlands, upland buffers, buffer yards, landscaping, common open space, and irrigation. 4. The Applicant shall provide the City a letter of credit as required by City ordinances to ensure completion of the proposed subdivision improvements. 5. The Applicant shall install the improvements within the Property as shown on the plans received by the City on February 26, 2013, except as modified herein. 6. The property shall be subject to current City regulations related to lawn and landscaping irrigation. Irrigations systems within the subdivision shall not be connected to the City Water Supply System. 7. The Applicant shall prepare an irrigation system plan subject to review and approval by the City Engineer. 8. The City Council hereby grants a limited waiver from the 10-foot setback requirement for driveways from a side lot line for lots within this plat. Driveways shall not require a setback from side lot lines. 9. The Applicant shall install vegetative upland buffers adjacent to wetland as well as required signage consistent with the City wetland preservation ordinance. 10. All comments by the City Attorney related to title issues and recording procedures shall be followed. 11. This final plat shall be recorded within 120 days of the date of this resolution or this approval shall be considered void, unless a written request for a time extension is submitted by the Applicant within said 120 days and approved by the City Council for good cause. All fees incurred by the City regarding the processing and review of this application shall be paid by the Applicant, including the drafting and review of relevant agreements and documents and the review of construction plans.
