SHIRLEY AVENUE AND CERTAIN ALLEYS, INCLUD-
ING ALL INTER3ECTION5 OF STREETS AND ALLEYS,
' BY CONSTRUCTING PUBLIC SEWERS._ •
RESOLUTION OUERRULING PROTESTS AND DETERMIN-
- ING THAT THE CITY COUNCIL HAS ACQUIRED JURIS-
DICTION TO ORDER THE PROPOSED WORK, OR IM-
PRO,VEI�dENT.
° Be it resolved by the City Council of the City of Lynwood, �
Galifornis, as Pollows: �
WHEREAS, said Citq Council did, on the 24th day of Septem-
ber, 1940, adopt its,Resolution of Intention No. 1260 to order
. the improvement of portions of Louiee Stree�, First Avenue,
�° •Linden Street, Elm Street, Fernwood Avenue, Pine Street, Locust
Street, Sanborn Avenue, Shirley Avenue and certain alleys, by
conatructing public sewers; and.
VPHEREAS, Tuesday, the 15th day of October, 1940, at the hour
' of S:QO o'clock P.M, at the Counoil Chamber in the City Hall, in
said City of Lynwood, was the time and place set in said Reso-
lution of Intention, when and where ang ob�ectiona to the pro-
posed work, or improvement, or to the extent of the diatrict to
be assessed, or to. the grades_to wHich the veork was proposed to
be done would be heard by said City Council; and
WHEREAS, the City Clerk has heretoPore presented and filed
an affidavit of publication of said Resolution oY Intention,
ehowing that the same was publiahed according to law; and
WHEREAS, said City Clerk has also presented and filed his
affidavit of mailing riotices of the ado�tion of said Resolution
of.Intention in the.time, Yorm and manner, and to the persona.

all as provided Sn 3ectlon 5 of the °Improvement Act of 1911,"
ae amended; and
wHEREAS, the City Engineer--3uperintendent of Streets has
heretofore presented and filed an affidavit showing that noticee
of the passage of said Resolution of Intention have been poeted
in the manner provided by said "Improvement Act of 1911," as
am�ded; `and

„?AHEREAS, a protest was filed by Mrs. Clara M. Lee, owner
of Lot 7, Block 9 and Lot 16, Block 11, Tract 9288, which pro-
test was to the effect that further aesessments on her property
were not �ustified; and
WHEREAS, a letter wae received from the law firm of Denio,
Hart, Taubman and Simpaon, representing the "Beckett Estate,°
ob,�ecting to the proposed work, or improvement, on the grounde
that further assesaments on the property owned by said eatate
were not ,Justified, but which ob,jection, or protest, did not
describe the property in which the ob,�ectora were intereated;
and
WFiEREAS, no further written protests were filed and no
oral proteats were made at the said time and place of hearing.
NOW, THEREFORE, BE IT`RESOLVED by the City Council of the
City of Lynwood ae fo3:lows:
Section 1. That the protest filed by the law firm oY
Denio, Hart, Taubman and Simpson representin� the "Beclsett Es-
tate" ie insufficient.
Section 2. That the proteat filed by Pdrs. Clara M.
Lee is hereby overruled.
Section 3. That the•said City Council has acquired
Jurisdiction to order the proposed work, or improvement,
