HomeMy Public PortalAboutOrdinance 471 Vacate Certain Access and Utlity Easements for Ski & Board Broker, LLC TOWN OF FRASER Series 2019 Ordinance No. 471 AN ORDINANCE TO VACATE A PORTION OF CERTAIN ACCESS AND UTILITY EASEMENTS ON PROPERTY OWNED BY SKI & BOARD BROKER, LLC, IN THE TOWN OF FRASER. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER IN THE STATE OF COLORADO, THAT: SECTION 1. The Board of Trustees of the Town of Fraser does hereby find and resolve that there is no continuing public need for that portion of a certain easements hereinafter described, except for easements reserved as hereafter set forth; and that the same should be vacated pursuant to the authority of 19-3-245 of the Fraser Municipal Code. SECTION 2. That portion of the Access and Utility Easement shown on the plat recorded December 1, 1982 at Reception No. 198590 of the records in the office of the Grand County Clerk and Recorder, as described on Exhibit A attached hereto and incorporated herein by this reference, is hereby vacated; provided, however, that such vacation shall not affect any private easements or facilities located within the area of the public easement hereby vacated. SECTION 3. This Ordinance shall be effective thirty (30) days after publication thereof as provided by law. This Ordinance shall be published by title only.
