CALL TO ORDER — 6:30 PM Lynn Teach called the meeting to order at 6:30 pm. 2. ROLL CALL & PLEDGE OF ALLEGIANCE Those present at roll call: Planning Commission Chair Lynn Teach and Planning Commission Members Sage Pierson, Tom Priest, and Elliot Hovey. Staff Members Present: Town Planner Scot Hunn and Planner I Madison Harris. Note: Michael Boyd is excused absent. Note: Jeff A. arrived at 6:33 pm. 3. APPROVAL OF AGENDA Opportunity for amendment or deletions to the agenda. Motion by Tom P., second by Jeff A., to approve the agenda as presented. Motion passed 5- 0. Note: Michael Boyd is excused absent. 4. DECLARATION OF CONFLICTS OF INTEREST No conflicts of interest. 5. APPROVAL OF MINUTES 5.1 September 28, 2022 Mint= Planning Commission October 12, 2022 Page 2 of 4 Motion by Jeff A., second by Tom P., to approve the minutes of September 28, 2022 as presented. Motion passed 5-0. Note: Michael Boyd is excused absent. 6. PUBLIC COMMENT Citizens are invited to comment on any item not on the regular Agenda subject to a public hearing. Please limit your comments to five (5) minutes per person unless arrangements have been made for a presentation with the Town Planner. Those who are speaking are requested to state their name and address for the record. No public comment. 7. PLANNING COMMISSION COMMENTS The PC discussed the presidential motorcade coming through Town. 8. DESIGN REVIEW AND LAND USE PUBLIC HEARINGS 8.1 Community Plan Update — SE Group Julia Randall, SE Group recapped the joint Town Council and Planning Commission session held on September 21, 2022 and went through the memo provided in the packet, plus the feedback received from Eagle County and VVMTA. The map included in VVMTA's memo does not have an accurate map, but was included as it was part of the feedback. The first proposed change discussed is adding a transitional commercial zone from the 500-800 Block. • Lynn T. would like to term it Transitional Residential. o Sage P. agreed. • Tom P. would like to term it Mixed Use 3. o Jeff A. also likes Mixed Use 3 or Mixed Use Lite. o Elliot H. liked Mixed Use 3 and thinks it should expand to the 600 Block of Boulder Street. • It was also discussed the possibility of changing Maloit Park from Mixed Use 2 to Mixed Use 3. Ms. Randall also discussed Objective 1.3.2 which dealt with non -conformities. • Direction from the Planning Commission was to revisit the non -conformities section of the code. Scot H. said there was a draft of changes that was done a few years ago. Note: Sage P. left the room at 7:15 pm and returned at 7:17 pm. Continued direction on the topic said to change Maloit Park to Mixed Use 3 or a Residential Zone. Brian Duffany, EPS. Spoke about an economically vibrant community and attainable housing and historic character. He recommended looking at 100% AMI for the threshold for affordable units, as well as doing a survey of the surrounding communities to see what they have the AMI set at. • The Planning Commission agreed that we need to lower the AMI. Mintum Planning Commission October 12, 2022 Page 3 of 4 • The action item in the plan covering this should be broader. • Context should be added for Eagle County Mr. Duffany continued speaking about ADUs and the possibility of allowing a 15% lot coverage increase if the ADUs are deed restricted for locals. • Lynn T., Jeff A., and Elliot H. were ok with the bonus. • Mr. Duffany asked a follow up question of whether ADUs should be allowed in the Mixed Use zones. o Sage P. and Lynn T. were against this. o Jeff A., Tom P., and Elliot H. were for this. Note: 5 minute recess called 8:14 pm. Lynn T. asked how to address VVMTA's comments about 3.3.1-3.3.2. Madison H. brought up public comment submitted by Tim Lahey, 406 Pine Street which made an argument that his lot should be zoned Mixed Use or Commercial rather than Residential. His public comment is included as an appendix to these minutes. SE Group will be bringing back documents for recommended adoption at the October 26, 2022 meeting. 8.2 Ordinance TBD — Series 2022: An ordinance of the Town of Minturn amending Chapter 16 of the Minturn Municipal Code to provide for the addition and inclusion of waterwise landscaping regulations and standards Scot H. introduced the ordinance. As requested by the Planning Commission at their regular meeting of September 28, 2022, staff has reduced the depth of mulch required to two inches. Also added, was a detailed list of native, drought tolerant plants. This list will replace, in its entirety, the previously approved list of plans referenced within Appendix `B' - Design Standards and Guidelines, of Chapter 16. Lynn T. suggested adding concolor fir to the tree list and hollyhocks to the flower list. Elliot H. would like to add a wildland urban interface approved plant list. Public comment opened. No public comment. Public comment closed Motion by Jeff A., second by Elliot H., to recommend approval to the Town Council of Ordinance TBD — Series 2022: An ordinance of the Town of Minturn amending Chapter 16 of the Minturn Municipal Code to provide for the addition and inclusion of waterwise landscaping regulations and standards with Lynn's additions to the plant list and the condition that we revisit the Wildland Urban Interface approved plant list.
