Be it resolved by the City Council of the City of Lyn- wood, California, as follows: tNHERFAS, under the provisions of the Improvement Act of 1911, as amended, this City Council adopted its Resolution of Intention No. 1260 on the 24th day of September, 1940. declar- ing its intention to order certain work to be done. Refe�enCe is hereby made to said Resolution of Intention for a descrip- tion oP the work, or improvement, and the assessment district, and for all further particulars, which said Resolution of In- tention is on file in the office of the City Clerk of the City of Lynvrood. WHEREAS, it appears tha,t notice of the hearing on the assessment has been published, poated and mailed as required by la�v and that this is the time and place set for hea.ring on the said aesessment; and 1dHEREAS, it appears that the following protests or ob,�ec- tions to said assessment have been filed: 1. A written protest by Jaaes A. IuYeyers, orvner of Lot 140, Gentury 5quare, ob,jecting to the amount of the asseasment on his lot in comparison with the lots directly ad,joining it. 2. A written protest by CJ. MeCausland, owner of Lot 7, Block 13, Tract 9337, ob�ecting to the asseesnent on the ground that his property is still in A. &. I. District 18; that he ce_n not borroar money on his property and that the assessment is more than he thinks it ahould be; and PIHEREPS, the Superintendent of Streets--City Engineer of the City of Lynwood, being present at said hearing, testified _1_ that the assessments protested as aforesaid are fair and equit- able and are in accordance with the benefit of said work or im- provement to each of said parcels of property. NOPt, THEREFORE, the City Council of the City of Lynwood, California, does hereby resolve determine and order as follows: Section 1. That said Resolution of Intention No. 12E0 vaas duly adopted and contains all tne Matters and things r•equired by law a.nd is in every respect legal and sufficient. That sa.id resolution vaas passed �t the time and in the form and manner re- quired by la� and that noticea of the passage of said Resolution of Intention and of the proposed improvement therein deacribed were posted at the time and as required by law; and that notices of the adoption of said Resolution of Intention ryere �ailed, postage prepaid, at the time and in the manner and to the per- Gons required by la�, and affidavits of such passage, posting and mailing were duly filed as required by law in the office of the City Clerk of the City �of Lynwood. That a hearing was held pursuant to said resolution at the time and place atated therein; that there were two.protests filed ob�ecting to the proposed �ork or improvement; that sa3d protests were duly and properly considered and overruled and Resolution No. 1266 overruling protestsand deter�ining that the � City Council had acquired �urisdiction to order the proposed work �as duly adopted. . That Resolution No. 1267 ordering the �ork or improvement, to which resolution reference is had for further particulars vras, on the 15th day of October, 1940, duly adopted. That notices inviting bida were duly posted and published in accordance vaith law and affidavits of posting and publishing filed have been/in the office of the City Clerk of the City of Lynvvood. That at the time and place provided in said notice inviting bida seven bids were received and after an analysis and report _2_ by the Superintendent of Streets-=City Engineer this City Coun- cil did on the 29th day of October, 1940, award the contract Por the doing of said work or improvement to the lovaest bidder, Leko and Bosnyak. 'Phat notice of the awarding of said contract was duly and properly published in accordance with law and affidavit of pub- lication has been filed with the City Clerk. That pursuant to the direction of said City Council the City Engineer prepared a diagram of the'pronerty included with- in the district affected or benefited by the work or improve- ment proposed by Resolution of Intention No. 1260 and said :. assessment diagram was on n4ay 20, 1941, duly approved by this City Council. That on the 29th day of I.nay, 1941 the Superintendent of Streets--City Engineer filed with the City Clerk the asseas- ment with attached diagram for the work or improvement afore- said and the City Clerk thereupon fixed this tine and pl'ace for hearing� on said assessment and. published, posted and mailed as required by law the,proper notices of this hearing. That this City Council has heard evidence relating to the assessment and the specific assessmenta and finds that the ae- sessment is ,just and in accordance with law and that all of the actions, determina.tions, resolutions and orders, and all of the proceedings heretofore taken are legal, valid and suf- ficient, and that the dia.gram attached to said assessment is legal, �alid and sufflcient. Section 2. Tnat said protests hereine.bove referred to are hereby overruled. Section 3.
