AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND
MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY
REZONING FROM RS-2 SINGLE FAMILY RESIDENTIAL TORO MEDIUM DENSITY RESIDENTIAL,
FOR PROPERTY LOCATED IN THE 1800 BLOCK OF CEDAR HILL ROAD,AND ENDORSING AN
AMENDMENT ON THE DEVELOPMENT PLAN MAP OF THE COMPREHENSIVE PLAN TO
REFLECT SUCH CHANGE.
WHEREAS, It appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with.
WHEREAS, The zoning ordinance requires consistency between the comprehensive plan and the
zoning map and the proposed zoning change would necessitate a change to the
Comprehensive Plan Development Plan Map.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1.The following described real estate is rezoned from RS-2 Single Family Residential
to RD Medium Density Residential-Attached:
Section 1,A. Property Description For Clyde Jr.. & Leslie Gudermuth Parcel: Part of
the Northwest Quarter of the Southwest Quarter of Section 13, Township 44, Range
12, in the City of Jefferson, Cole County Missouri, more particularly described as
follows: From the Southwest Corner of the Northwest Quarter of the Southwest
Quarter of said Section 13; thence North along the West tine of said Quarter Quarter,
50 feet,to the beginning point of this description;thence North 89 degrees 41 minutes
East, parallel with the South line of said Quarter Quarter, 995.75 feet, more or less, to
the Westerly line of Southwest Boulevard (formerly Zehendner Road); thence North

The City Council of the City of Jefferson, Missouri, will hold a public a hearing on Monday, July
18, 2005 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal Building, 320
East McCarty Street, to consider rezoning approximately 2.06 acres of property located in the
1800 Block of Cedar Hill Road from RS-2 Single Family Residential to RD Medium Density
Residential and an associated amendment to the Development Plan Map of the City's
Comprehensive Plan to reflect the zoning change:

foreseeable to exist in the future.

d. Whether events subsequent to the Comprehensive Plan adoption have changed the character and/or

Re: 1704 and 1702 Southwest Blvd. and approximately .34 Acre section bordering Cedar
Hill Road
Dear Planning and Zoning Commission and the City Council of the City of Jefferson:
We are planning to purchase all three of the above-described properties. 1702 Southwest
Boulevard and 1704 Southwest Boulevard are currently used as rental properties. Both of
these lots are irregular in shape with excessive depth. Our intent is to use the Cedar Hill
Road frontage location to build four to five duplexes. The development would
compliment the existing duplex and rental developments in this area. The adjoining land
use will be similar. The traffic impact would minimal.

The subject site is located beginning about 500 feel west of Southwest Boulevard on the north side of Cedar
• Hill Road. The site has about 525 feet of frontage on Cedar Bill Road and extends north-south from 110 to
180 feet. It also extends cast—west about 270 feet further cast in behind three existing homes on Cedar Hill
Road into the rearyards of two bonus that face Southwest Boulevard.The site is currently zoned RS-2 Single
Family Residential.

The first property immediately to the east of the site on the north side of Cedar Hill Road is zoned RD and
developed with a two-family dwelling. The remaining area to the cast is zoned RS-2 and developed with

Nature of Request
The applicants are requesting rezoning to RD with a stated intent of constructing 4-5 duplexes along Cedar
• Hill Road. The property is irregularly shaped and is heavily wooded with sloping topography. The west
portion pf the site is low as a drainage way(lows through Ilia area towards ilia planned stor nwater detention
facility just northwest of the subject site.
Staff Annlvsis
A. Comprehensive plan Amendment: The Comprehensive plan Land Use Map designates the subjcct site
as Low Density Residential. The area directly south of Cedar Ili)) Road is designated Medium Density
Residential. The proximity of existing duplexes to ilia south and ilia potential for similar development on
the subject site supports a higher density residential use. The predominant uses located in ilia larger
surrounding area being single-family homes supports a lower density residential classification.
B. Rezoning from RS-2 to RD:
• Density: If the property were developed under existing RS-2 zoning, the site could contain up to
7 single-family dwellings on 10,000 sq. fl. and 80 feet wide lots. With rezoning or ilia property
to RD, which allows 6,000 sq. R, and 60 fool wide lots, 9 duplexes could potentially be built on
the site. The four RD zoned lots to the south have an average lot width of 135 feet. Development
of ilia site matching this pattern would result in four lots facing Cedar Hill Road and perhaps a
filth lot with driveway frontage on Cedar Hill Road and a building site cast of the four lots behind
the existing houses. This option would most closely fit ilia staled intent of the applicant to build
4-5 duplexes on Ilia site.
• Public Services: All public services and utilities are currently in place or could be extended to
serve Ilia proposed development. Water service would be available from all existing line on Cedar
Hill Road. Sewer service would be provided by a city server line located west of ilia silo.
• • Access/Tmffae Impact:Cedar Hill Road is a two-lane residential street. Separate access drives
could potentially be provided to each dwelling unit. Each unit can be expected to generate 7-8
vehicle trips per day.This portion ofCcdar Hill Road is curvy and located on fairly sleep terrain
(falling from an elevation of 720 to 670 in 500 feet for a slope of 10%)which affects vehicle
speed and sight distance.This will make backing out of driveways more hazardous than normal.
Shared or consolidated driveways would reduce potential in Me hazards.
• No more than one duplex may be built on an individual parcel of land. Development of multiple
duplexes will require that the parcel be subdivided into a like number of lots. Approval of a
subdivision plat could be expected Villa plat nnecls minimum RD zoning district standards for lot
area and width and other requirements.
Staff Recommendations
A. Staff supports ilia amendment to the Comprehensive Plan Development Map from Low Density
Residential to Medium Density Residential.
D. Staff supports rezoning the site from RS-2 to RD. When the subdivision plat is submitted, the
expectation will be for no more than 5 lots to be shown on the plat,no development of the drainage
way and adjacent low area on the west portion of the site, and the use of shared or consolidated
driveways for ilia duplex units.
