HomeMy Public PortalAbout2014.08.28 PLRWSD Memo of Understanding for Disposal of EffluentMemorandum of Understanding for Disposal of Effluent Between The City of McCall and Payette Lakes Recreational Water and Sewer District The City of McCall ("City") and the Payette Lakes Recreational Water and Sewer District ("District") agree that it is in the best interest of their citizens to work toward a contract where: a) The City has responsibility for wastewater treatment to include permitting, maintaining, and operating wastewater treatment facilities. b) The District has responsibility for obtaining a reuse permit from DEQ and for effluent disposal to include maintaining and operating effluent disposal facilities in compliance with an IDEQ reuse permit. c) Both entities acknowledge that a positive relationship with landowners is critical to the affordability and sustainability of the wastewater system. The current letters of intent from landowners, found at Exhibit A, outline requirements of the landowners which must be incorporated into a contract between the City and District. Refer to Exhibit B for an illustration reap of areas of responsibility. A general outline of the relationship follows. The City will: a) Consistently and reliably produce effluent in accordance with the requirements of the most current DEQ effluent quality permit issued to the City. b) Maintain the existing NPDES permit, without modification, unless such modification is required by a regulatory agency. c) Operate and maintain the treatment facility. d) Enter into a contract with the District for effluent disposal services. This. contract will be executed no later than February 28, 2015. The District will: a) Obtain the necessary permits from IDEQ to dispose of the treated effluent generated by the City and the District. b) Operate and maintain the effluent disposal facilities from the existing treatment facility's point of compliance in accordance with the DEQ reuse permit and in close coordination with the City. Disposal facilities are comprised of the winter storage pond, the: pipeline to the mixing station, the mixing station, the infrastructure to deliver reuse water to the privately owned irrigation systems, and all other ancillary equipment and facilities. Ownership of disposal facilities, as defined above, will not change and the City will still be responsible for capital replacement, repair, and/or enhancement of these facilities. c) . Perform all monitoring and sampling in compliance with the reuse permit. d) Generate and submit annual reports as required by IDEQ. This contract will be executed no later than February 28, 2015. The City and District will: a) Continue to maintain and operate their respective wastewater collection systems. b) Continue to comply with provisions outlined in the Settlement Agreement of case number CV-2005-352-C between the City of McCall and Payette Lakes Recreational Water and Sewer District. c) Maintain a close working relationship with the reuse site owners and Lake Irrigation District to properly maintain and manage a slow rate land application system. d) Establish a Joint Wastewater Working Group ("JWWG") which will provide advisory support to McCall City Council and Payette Lakes Recreational Water and Sewer Board. e) Develop a separate memorandum of understanding outlining process and timeline for the consolidation of City and District wastewater entities. This MOU will be executed no later than February 28, 2016. Some caveats are: a) The final Idaho DEQ Reuse Permit incorporates conditions that I find agreeable to my operations. b) The long-term agreement with the District will be based on a thirty (30) year contract, renewable every twenty (20) years. c) The District is in sole management and operation of the effluent storage and delivery infrastructure. d) I am willing to receive reuse water generated outside of the District but will not contract with those entities.
