AN ORDINANCEOFTHE CITY OFJEFFERSON,MISSOURI,APPROVING A SPECIAL EXCEPTION
USE PERMIT FOR OPEN LAND, INCLUDING PRIVATELY HELD OPEN SPACE AND NATURAL OR
CONSERVATION AREAS FOR 88.4 ACRES OF LAND LOCATED AT 2301 GREEN MEADOW
DRIVE, DESCRIBED AS RESERVE TRACT A, RIVERS EDGE ESTATES,JEFFERSON CITY, COLE
COUNTY, MISSOURI.
WHEREAS, Roger and Irma Verslues, owners of the real estate hereinafter described, having
submitted an application for a Special Exception Use Permit for Open Land, including Privately Held
Open Space and Natural or Conservation Areas, for the land described as follows:
Property addressed as 2301 Green Meadow Drive; described as Reserve Tract A,
Rivers Edge Estates, Section 29, Township 44N, Range 11 W, in the City of Jefferson,
Cole County, Missouri; containing approximately 88.4 acres.
WHEREAS, it appears that in the procedures set forth in the zoning code have been complied
with, as said property owners submitted to the Planning and Zoning Commission and City Council an
application and plan for a Special Exception Use Permit for the above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Special Exception Use Permit Application and Plan prepared by Roger F.
Verslues and S&V Consultants, Jefferson City, Missouri,on file as Case No. P05023 in the Jefferson
City Planning Division is hereby approved for the site described above;
• SECTION 2. The principal land uses and Improvements to the site shall be as depicted on the
Special Exception Use Permit Plan referenced in Section 1 above, subject to the following limitations
and conditions:(1)construction of an 1,875 sq.ft. storage building for agricultural and other equipment,
which shall be painted a light earth tone color, such as tan or gray; (2)maintenance of an undisturbed
15 foot wide buffer along adjacent property lines where no agricultural crops,burning or top soil removal
shall be permitted; (3)the raising of crops and top soil removal shall cease on or before December 31,
2008 and the savannah shall be substantially established on or before December 31, 2010, provided
however, at the end of the time period, the applicant may request that the Commission review the
application and grant an extension if necessary; and (4)Issuance of a grading permit and a flood plain
development permit and approval of the use of Green Meadow Drive for the hauling of equipment,
agricultural products and topsoil In and out of the site.
SECTION 3. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

The City Council of the City of Jefferson, Missouri, will hold a public hearing on
Monday, July 18, 2005 at 6:00 p.m. in the Council Chamber of the John G. Christy
Municipal Building, 320 East McCarty Street, to consider a Special Exception Use Permit
for the following described property:
SECTION 1: The subject property is addressed as 2301 Green Meadow Drive,and
described as follows: Reserve Tract A, Rivers Edge Estates; located in Section 29,
Township 44 North, Range 11 West, in the City of Jefferson, Cole County, Missouri;
containing 88.4 acres,
SECTION 2. The purpose of the public hearing Is to hear an application for a
Special Exception Use Permit for Open Land, Including Privately Held Open Space and
Natural or Conservation Areas, in accordance with Section 35-41 of Chapter 35, Zoning
Code, Specific Use Standards,filed by Roger and Irma Verslues, property owners, for the
land described In Section 1. The land is zoned RS-1 Single Family Residential. The
complete application is available for inspection during regular business hours at the
Department of Community Development, Planning Division, Room 120, John G. Christy
Municipal Building, 320 East McCarty Street, Jefferson City, Missouri.

Private Ownership — 88.4 Acres
Members of Planning& Zoning, City ofJefFerson:
The Owners of the above referenced tract of land are submitting the following request for
use of the Reserve Tract 'A':
1.) Sheet 1 outlines the location of ilia proposed storage building(62.5'x30')
which will be used to store the equipment to accommodate the planned
usages.
The structure will be constructed in compliance with Ordinance on record
at City of Jefferson, MO.
2.) Sheet 1 outlines the boundary of sixteen 16 acres (a•/-) which is proposed for
• agriculture use for 2-3 years. The cultivation is intended for cleaning up the
weeds and hard-wood root system that was allowed to develop prior to
purchasing the property. The sixteen (16) acres (+/-) will be used for planting
soy-beans during the first two (2)years and possible transition to other row-
crop the third year if necessary to accomplish clean-up which will allow
installation of Ilia savannah.
Soybean crops will require the spraying of round-up to extricate weed
growth and allow a productive crop.
3.) Sheet 2 outlines the boundary for annual burn in late winter or early spring.
The agriculture acreage will not be burned to control vegetation until such
time cultivation ceases.
4.) Sheet 3 outlines the areas where strategic grading will take place to
accommodate drainage and elimination of wct areas that have developed due
to the collapse oFthe sub-drain system installed many years ago.
The Grading will include removal of top soil that will be sold and
removed from the site to off-site locations.
Areas disturbed during ilia drainage effort will consist of/, to %: acres
maximum and will be reseeded for erosion control and benutification.
5.) The wooded areas will routinely have dead trees removed and strategic cutting
of underbrush to enhance the general appearance.

G.) Upon establishing the savannah, a tree planting program will be initiated.
• Consultation with the Missouri Department of Conservation will establish the
recommended species.

fn May, 2004, the applicant filed an application for a Special Exception Use perrnfl to use 88.4
acres of land located in in RS-1 zoning district as a conservation/agricultural area, including the
construction of associated maintenance and storage buildings. After review, the City Counselor
delennined that Ilia special exception provisions were not applicable to the construction of a storage
building in the RS-1 district. The applicant then withdraw the request and filed an application to
rezone the property from RS-1 to RU Rural Use. During the review process, the Commission, at the
request of staff, initialed a zoning text amendment to allow Open Land, including private Open
Space and Natural and Conservation Areas as a Special Exception Use in all zoning districts. In
January 2005, upon adoption of this amendment, the applicant withdraw his rezoning application.
• Current Renuest
The applicant has filed an application for a Special Exception Use to allow several uses and
activities.These are described in an attached letter from the applicant and summarized as follows:
I. Construction of a 1,875 sq. ft. building for the storage of agricultural and other equipment.This
building would be located about 500 feet cast of Green Meadow Drive nt the end of an existing
farm access drive(see Sheet 1).The building would be a rectangular metal building from 17-20
real tall with four overhead doors on the front or west side(see drawings). As the site is in the
100 year floodplain and ilia use of"wet" flood-proofing is proposed, a variance would be needed
from the Board orAdjustrnenl prior to construction.
2. Agricultural cultivation, including planting and harvesting or soybeans and other row crops for 2-
3 years on about 16 acres of ilia site(see Sheet 1). This includes Ilia spraying of Roundup on ilia
cropped area. It also includes conducting an annual burn over a 31.5 acre area to control weeds
(see Shect 2). After 2-3 years, a savannah type grassland will be established.
3. Site grading to improve drainage and eliminate wet areas over a larger area with no acreage
stated(see sheet 3). This includes the removal and sale of top soil. Areas disturbed will not
exceed %: acre in size and will be reseeded.
4. Removal of dead trees and selective cutting of underbrush over the entire area. Upon establishing
the savannah,a tree planting program will be initiated.

Staff Analvsis
In Section 35-41 Open Land Pennits, various standards and limitations have been established for
such uses.The application has been reviewed with these provisions with lice following findings:
1. Penmancm structures for the storage of mowers,tractors, fuel and maintenance items not to
exceed 2,000 sq. R. may be allowed. Architectural style shall be approved as part of the permit.
The proposed building is less than the maximum size allowed.The question for the Commission
is whether the design of Ilia building mid the proposed type and color of exterior materials is
compatible with the surroundings in view of the distance away from existing and new residences.
2. Raising of crops may be allowed. I towever,cutting of trees and land clearing, re-grading or
removal of topsoil,and widespread application of fertilizers, herbicides and insecticides are
prohibited, except in compliance with specific authorization as provided for in an approved
pennit and site plan. 'rite question for the Commission is whether the proposed activities are
sufficiently limited as to location and duration so as to not cause tiny adverse impacts such as
noise,odors or visual nuisances that will not be mitigated by distance and buffers.
3. The proposed use will be required to meet all fire, health, building, plumbing, electrical and
• slornnvater drainage regulations as applied during the plan review and building pernut process.
4.The proposed use would not appear to generate any appreciable additional vehicular traffic
except for trucks hauling top soil and tending the crops.Tliese trucks could impact Green
Meadow Road, however.
Review Criteria and Allnwed Condillons
No special exception use shall be approved unless the Commission finds that the use and plan: 1)
will be compatible with surrounding land uses; 2) will not have a significant detrimental effect on
the character of surrounding residential uses; 3) will not over burden municipal services, cause
traffic, parking or environmental problems, or adversely affect the health, safety and welfare of the
community. If necessary, conditions may be imposed which: a) limit the operation of the use, b)
impose performance standards to mitigate potential incompatible activities, and c) adjust the site
design and layout to mitigate potential negative impacts.
Staff Recommendations
Staff supports the application, subject to Ilse following conditions;
I, 'rite storage building shall be painted a light earth lone color,such as tan or gray.
2. The maintenance of an undisturbed 20 foot wide buffer adjacent to the residential lots where no
agricultural crops, burning or lop soil removal shall be pertained.
3. The raising of crops, burning and top soil removal shall cease on or before December 31,2008
and the savannah shall be substantially established on or before December 31, 2010.
4. Public Works Section: (1) issuance of a grading permit, (2) issuance of a flood plain
• development penmft, (3) and approval of the use of Green Meadow Road for the hauling of
equipment, agricultural products and topsoil in and out of the site.
