CALL TO ORDER: Pursuant to the Agenda posted on April 15, 1988, Mayor Gillanders called the meeting of the City Council to order at 7:30 P.M. on Tuesday, April 19, 1988. 2. The invocation was given by Reverend Jim Brown, Seventh Day Adventist Church, 9664 E. Broadway. 3. The Pledge of Allegiance Gillanders. 4. ROLL CALL: Present: Also Present: PRESENTATION: to the Flag was led by Mayor Councilmen- Atkins, Swain, Froehle, Dennis, Gillanders City Manager Koski, City Attorney Martin, Community Development Director Dawson, Public Works Coordinator Peterson, Parks & Recreation Director Kobett, Julie Estrada of the Temple City Times and a representative of the San Gabriel Valley Tribune. Mayor Gillanders presented a framed Certificate of Recognition to Marie Carey, Temple City's Outstanding Older American and com- mended Ms. Carey for her many contributions to the community over the years. 5. MUNICIPAL ELECTION A. CANVASS OF VOTE City Clerk Koski presented City Clerk's Certificate of Can- vass of the Municipal Election held April 12, 1988 (Exhibit "A ") which showed Thomas Breazeal and incumbent Pat Froehle elected to a four -year term. Councilman Atkins moved to adopt Resolution No. 88 -2772 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, RECITING THE FACT OF THE GENERAL MUNICIPAL ELEC- TION HELD IN SAID CITY OF TEMPLE CITY ON THE 12TH DAY OF APRIL, 1988, DECLARING THE RESULT THEREOF AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW, seconded by Councilman Froehle and unanimously carried. Councilman Froehle told those present he was very pleased and happy to be elected. It is a privilege to be appointed but it is even more gratifying to know that what you have done in the past is acceptable and he is very happy to be elected to Council. Councilman Atkins took this opportunity to bid farewell to Bill Dennis, a dear friend who served many years on the Planning Commission and City Council. He commented on how well Bill looked and hoped he would be back in service soon. Councilman Swain concurred with Councilman Atkins stating that Bill is a dear friend and she enjoyed working ,with him on Council. City Council Minutes April 19, 1988 - Page 2 Mayor Gillanders, speaking of Bill Dennis, commented that Bill has always been a responsible individual in representing the people of the community. Virtually everything that goes on in the community is a team effort and Bill has always been a member of the team giving his best all the time. Mayor Gillanders then presented a plaque to Mr. Dennis as a small token of appreciation for his 19 years of outstanding serv- ices as a public official. Mrs. Dennis, speaking for Bill, thanked Mayor Gillanders an'. all the Councilmen for their hard work. Further stating tha_ Temple City is a wonderful community and everyone should b proud. He is taking a vacation and asked everyone to carry on until he could return. Councilman Froehle said two words came to mind when thinking of Bill - sincerity and integrity. His outstanding service to the community will be missed. B. SEATING OF COUNCIL City Clerk Koski presented Certificates of Election to Thomas Breazeal and Patrick Froehle, and administered the Oath of Office. C. REORGANIZATION At this time the City Clerk assumed the Chair and opened nominations for the office of Mayor. Councilman Froehle nominated Councilman Swain for the office of Mayor, seconded by Councilman Breazeal Councilman Atkins moved that nominations be closed and unanimous ballot be cast for Councilman Swain for the offic of Mayor, seconded by Councilman Froehle. Councilman Swain accepted the gavel and took this opportu- nity to welcome Tom Breazeal to the Council and presented him with a City pin. She then called for nominations for the office of Mayor Pro Tempore. Councilman Breazeal nominated Councilman Froehle_\, for the office of Mayor Pro Tempore, seconded by Councilman Gillanders. Councilman Atkins moved that nominations for Mayor Pro Tem- pore be closed and a unanimous ballot be cast for Councilman Froehle for the office of Mayor Pro Tempore, seconded by Councilman Breazeal. Mayor Swain presented a plaque to Councilman Gillanders in recognition of his leadership and service as Mayor to the City of Temple City. Councilman Gillanders made reference to pins from Hawkesbury Shire sent to the Councilmen. thanked Council for their cooperation during the past year and referred to the many projects which have been completed and the programs just started that Mayor Swain can continue. Councilmen Atkins and Froehle individually expressed their thanks to Councilman Gillanders for his hard work and leader- ship during the past year. Councilman Breazeal said he was elated at being elected to the Council and commended Councilman Gillanders on doing an excellent job as Mayor City Council Minutes April 19, 1988 - Page 3 D. Councilman Atkins moved to adopt Resolution No. 88 -2774, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING AN ALTERNATE DIRECTOR OF COUNTY SANITATION DIS- TRICT 15, seconded by Councilman Froehle and unanimously carried. 6. CONSENT CALENDAR Councilman Gillanders requested Item 6.B be removed from the Consent Calendar; Councilman Atkins moved to approve the remain- der of the Consent Calendar as recommended, seconded by Council- man Froehle and unanimously carried. REQUEST FOR AUTHORIZATION TO RECRUIT FOR SUMMER RECREATION Council approved Parks & Recreation Department's request to recruit for summer recreation. D. PLANNING COMMISSION ACTION FROM THEIR REGULAR MEETING OF APRIL 12, 1988. City Council received and filed the memo outlining action taken by the Planning Commission at their regular meeting of April 12, 1988. E. RESOLUTION NO. 88 -2776: EMPLOYMENT OF BUDGETED PERSONNEL Council adopted Resolution No. 88 -2776, a Resolution appoint- ing budgeted personnel. F. RESOLUTION NO. 88 -2775: APPROVAL OF PAYMENT OF BILLS City Council adopted Resolution No. 88 -2775, approving claims and demands in the amount of $59,590.90. B. APPLICATION FOR FIREWORKS STANDS - 1988 Councilman Atkins moved to approve the applications for fireworks stands, seconded by Councilman Breazeal and car- ried; with Councilman Gillanders abstaining due to a possible conflict of interest. 7. UNFINISHED BUSINESS: A. ACCEPTANCE OF BID: LIVE OAK PARK IMPROVEMENTS City Council reviewed the bids received and Councilman Gil - landers moved to award the contract to the lowest bidder, Creative Homes, in the amount of $205,552, as recommended by Recreation Systems, Inc. and amend adopted budget accord- ingly; seconded by Councilman Froehle and unanimously car- ried. 8. NEW BUSINESS: Councilman Breazeal made known to the Council that he was famil- iar with the items under New Business as he had heard them as Chairman of the Planning Commission, he had familiarized himself with the information contained in the Councilmen's packets, was prepared to hear new testimony and was able to vote with an open mind. A. PUBLIC HEARING: ZONING CODE AMENDMENTS RELATING TO COMMER- CIAL DEVELOPMENT STANDARDS City Manager Koski provided background information stating that the Planning Commission was recommending certain amend- ments to the Zoning Code which would provide for better control over future commercial development within the City. The recommended code amendments are 1) Require a Conditional Use Permit for shopping centers with three or more commercial units, 2) Require a Conditional Use Permit for sharing a commercial or manufacturing unit, 3) Require a Conditional Use Permit for subdividing an existing commercial or manufac- turing unit, and 4) Specify that any newly created commercial or manufacturing unit shall have a minimum of three parking spaces. This code amendment would codify the Urgency Ordi- nance adopted by Council on June 2, 1987. Councilman Froehle moved to include the Minutes and materials from the Planning Commission as part of the record of Coun- cil's public hearing concerning this matter, seconded by Councilman Atkins and unanimously carried. City Council Minutes April 19, 1988 - Page 5 Mayor Swain declared the public hearing open and invited anyone wishing to address the City Council on the matter to come forward at this time. William H. Bretz, 8723 E. Hermosa Drive, San Gabriel, speak- ing for concerned residents of Temple City, questioned whether the above - mentioned code amendment would re -zone everything in Block "A" of the Redevelopment Area. Mayor Swain explained the proposed code amendments and as- sured Mr. Bretz no zone changes had taken place since the last meeting and this had nothing to do with Block "A ". As no one else wished to address the City Council on this matter, Councilman Atkins moved to close the public hearing, seconded by Councilman Froehle and unanimously carried. Councilman Gillanders stated these code amendments are long overdue and reflect Council's thinking at the time they passed the Urgency Ordinance. He was in favor of approving these amendments. Councilman Atkins said he has seen problems arise from indis- criminate dividing of commercial stores into virtual cells. This will provide control and he felt this was a good Ordi- nance. Councilman Froehle felt this would prevent the proliferation of shopping centers and someone coming in and chopping up the stores. Councilman Breazeal said he approved the amendments as a Planning Commissioner but now felt they did not go far enough. There are areas the Planning Commission did not look into such as City parking lots, mini - malls, etc. These will have an adverse effect on traffic circulation and parking. He was in favor of this Ordinance and also in favor of adopting a moratorium on the construction of mini - malls. Mayor Swain expressed similar feelings as the other Council- men, and felt this is a very important code amendment. She has met with Planning Commissioners of surrounding cities experiencing these same problems and this Ordinance came as a result of those meetings. She concurred with the other Councilmen. Councilman Gillanders moved to certify the Negative Declara- tion of Environmental Impact, seconded by Councilman Atkins and unanimously carried. Councilman Gillanders agreed that a study session might be in order. City Attorney Martin introduced for first reading by title only Ordinance No. 88 -631, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTIONS 9128 (U) (3), 9202 and 9291 OF THE TEMPLE CITY ZONING CODE PERTAINING TO COMMERCIAL DEVELOPMENT STANDARDS. Councilman Atkins moved to waive further reading, seconded by Councilman Breazeal and unanimously carried. B. PUBLIC HEARING: APPEAL OF A DECISION OF THE PLANNING COMMIS- SION DENIAL OF ZONE VARIANCE 88 -907 AT 5817 KAUFFMAN AVENUE - APPLICANT/OWNER FERNANDO VETRONE - City Manager Koski provided background information stating that the applicant is requesting a zone variance to allow a side yard setback of four feet instead of the required five feet for a second story portion of a proposed two -story single family dwelling and a variance to allow a guest house with a five foot rear yard instead of the required 15 foot rear yard. On February 23, 1988, the Planning Commission approved the second story addition to the existing dwelling four feet from the property line but denied the guest house. (C City Council Minutes April 19, 1988 - Page 6 Community Development Director Dawson showed a video of the subject property and surrounding area. Council members asked questions of staff regarding the provi- sion to have the garage sprinkled because of bedrooms above, if the alley ran along the rear of the property, and how far the residence to the south was located from the property line. Councilman Gillanders moved to include the Minutes and mate- rials from the Planning Commission as part of the record of Council's public hearing concerning this matter, seconded by Councilman Breazeal and unanimously carried. Mayor Swain declared the public hearing open and invited anyone wishing to address the City Council on the matter to come forward at this time. Fernando Vetrone, 5817 Kauffman Avenue, called the Council's attention to the fact that there already are other two -story structures with five foot setbacks in the area. He was requesting approval of his project to accommodate his family and mother -in -law. He said the guest house was for family use and definitely would not be a rental. The proposed guest house is 840 square feet and will be built over a four -car garage. Mayor Swain explained that a guest house is a temporary place for a guest to sleep. She asked if a refrigerator or cooking facilities were proposed or would Mr. Vetrone's mother -in -law eat with them. The design shows bathroom and counter with sink, which would make conversion to a rental very easy. Kenneth Palmer, 5818 Kauffman, a neighbor across the street, expressed approval of Mr. Vetrone's proposal and said it would upgrade the property. Mr. Palmer felt strongly that the zoning should be R -2 and Mr. Vetrone should be allowed to build just as many of his neighbors have. Lloyd Ranabargar, 5822 Camellia, reminded the Council they just petitioned to have this area zoned R -1 and it should remain R -1. The alley is very busy and a 15 foot rear yard should be maintained. He did not object to the addition to the house, but was opposed to the guest house as he has seen many of these converted to rentals. Robert Huson, 5812 Camellia, owns the property behind Mr. Vetrone's, and said he has spoken before on this subject and wanted to reinforce what he said. He wants this area to remain R -1 and agreed with Mr. Ranabargar. It was his opin- ion code requirements should be met. He had no objections to the house addition but was opposed to the garage and guest house. As no one else wished to address the City Council on this matter, Councilman Gillanders moved to close the public hearing, seconded by Councilman Atkins and unanimously car- ried. Councilman Breazeal basically had no objection to the four - foot side yard but had reservations about a four -car garage and an 840 foot guest house. It looks like a rental. Councilman Froehle had no problem with the addition to the house. He was not opposed to the garage, but was concerned about an 840 square foot guest house which he felt would become a rental some time in the future. City Council Minutes April 19, 1988 - Page 7 Councilman Atkins shared the concerns of his peers regarding the guest house. He felt it may be a guest house now but it will be turned into an apartment in the future. An addition to accommodate his family can be made on this size lot in- cluding a two- or three -car garage. This does not show a case for a variance. Councilman Gillander's objections ran along the same lines. A four -foot setback is not difficult to accept and, because of the alley, it is not difficult to accept a five foot rear yard. The problem is the guest house and the four unit garage. Today's guest house is tomorrow's rental unit. Additionally, he felt it is not in character with the area. Mayor Swain concurred completely with the other Councilmen. She also stated that the design indicated it could very easily be converted to a rental. She had no problem with the four -foot setback but is opposed to the guest house. Councilman Gillanders moved to deny the Appeal and support the decision of the Planning Commission to approve the second story addition to the existing dwelling four feet from the property line but deny the guest house, seconded by Commis- sioner Froehle and unanimously carried. C. PUBLIC HEARING: APPEAL OF DECISION OF PLANNING DENIAL OF CONDITIONAL USE PERMIT 87 -891 AND ZONE VARIANCE 87 -894 AT 9123 -25 LAS TUNAS DRIVE - APPLICANT /OWNER - JOHN RICCI City Manager Koski gave background information and stated this Appeal was considered by the City Council at their meetings of February 16, and March 1, 1988. The applicant requested a continuation until this meeting. The subject request is for a Conditional Use Permit to subdivide an existing commercial unit into four smaller units and a Zone Variance from the minimum required three parking spaces per unit. This would legalize the creation of three additional units in the C -2 Zone without providing the additional three parking spaces required. The Planning Commission denied this request at their January 12, 1988 meeting. Community Development Director Dawson showed a video of the subject site and surrounding properties. Councilman Atkins moved to include the Minutes and materials from the Planning Commission as part of the record of Coun- cil's public hearing concerning this matter, seconded by Councilman Froehle and unanimously carried. Mayor Swain declared the public hearing open and invited anyone wishing to address the City Council on the matter to come forward at this time. John Ricci, 9932 Daines, speaking of his property at 9123 -25 Las Tunas Drive, briefly discussed the history of this property and the inherent parking problem and the prohibitive cost to the property owners in the area to correct the prob- lem. He asked if perhaps the owners could get together with the Council and buy some land in the vicinity for parking that would benefit everyone. He divided his property because the size was too large for him to use and it was also too large to rent out. Most people wanted 600 - 900 square feet rather than 3,200 square feet. Councilman Froehle asked how he could get the small stores in there without parking and was told the subdivisions were done without permits. Mr. Ricci said the use has never been in compliance with the parking requirements. City Council Minutes April 19, 1988 - Page 8 Bill Sweeney, Valley Lock and Safe, 9112 Las Tunas, spoke in opposition at the Planning Commission and came to the Council Meeting to see if there wete any new reasons to approve this proposal and Mr. Ricci has not given any. Mr. Sweeney said this area is impacted from 11:00 a.m. on. He personally parks one -half block away. The parking lot shown in the video is a private lot for R & S. In answer to Mr. Ricci statement that there are spaces in back, Mr. Sweeney said these have been sealed off and are used for storage. He asked Council to reject this Appeal. Judy Burns, 5926 Hart, stated that there is a parking problem on Hart and the street cannot handle any additional busi- nesses. As no one else wished to address the City Council on this matter, Councilman Breazeal moved to close the public hear- ing, seconded by Councilman Atkins and unanimously carried. Councilman Atkins said he could see that Mr. Ricci was trying to establish space easily rentable. Parking is too critical to do what he wants. The tenant parking would spill over and have an adverse effect on the neighbors. He cannot support what Mr. Ricci is doing. Councilman Gillanders stated that in addition to Councilman Atkins' objections regarding parking, Council has just made a decision against subdividing buildings - more or less justi- fying what is already there. If they approve this it will set a dangerous precedence. Councilman Froehle concurred completely with the other Coun- cil members. Council just passed an ordinance against cut- ting up buildings. There must be unique circumstances present to grant a variance. They were talking about a shortage of 9 parking spaces. Councilman Breazeal had nothing to add that was not included in the Planning Commission Minutes. Mayor Swain gave a brief history of the Revitalization Com- mittee of the Chamber of Commerce and their efforts to work out this parking problem with the property owners in the area. She explained the procedure necessary to set up a parking district and said these owners must take care of some of these problems by themselves. Councilman Breazeal moved to deny the Appeal and support the decision of the Planning Commission to deny Conditional Use Permit No. 87 -891 and Zone Variance No. 87 -891; seconded by Councilman Atkins and unanimously carried. D. PUBLIC HEARING: APPEAL OF PLANNING COMMISSION APPROVAL OF TENTATIVE PARCEL MAP 19432, CONDITIONAL USE PERMIT 88 -900 AND ZONE VARIANCE 88 -901 AT 5135 FARAGO (OWNER - YII CHENG) City Manager Koski provided background information stating that the applicant is requesting approval to construct four detached residential condominium units on an R -2 zoned par- cel. The variance is necessary because of the proposed two -story construction on a lot less than 80 feet in width; however, this will not apply after May 5, 1988. The Planning Commission approved this project at their meeting of March 8, 1988. This Appeal was submitted by neighboring property owners to the north and was signed by property owners in the area. Community Development Director Dawson showed a video of the subject property and surrounding area. City Council Minutes April 19, 1988 - Page 9 Councilman Breazeal moved to include the Minutes and materi- als from the Planning Commission as part of the record of Council's public hearing concerning this matter, seconded by Councilman Gillanders and unanimously carried. Mayor Swain declared the public hearing open and invited `anyone wishing to address the City council on the matter to come forward at this time. 'Councilman Froehle said that if this case was submitted after May 5, 1988, no zone variance would be required. Mr. Dawson confirmed this statement. Stephen Lam, 328 Atlantic Boulevard, Monterey Park, stated he is the architect on this project and it was designed primar- ily for single families so there would be pride in ownership. The project has met all the design standards and code re- quirements. In order to get approval of this project, Mr. Lam said he would consider a single -story or a combination of single- and two -story development. If this should be the case, he requested a 30 day continuance. Councilman Gillanders asked if he understood that after May 5th he could build without a variance so why would he modify his plans. Mr. Lam said he was conservative and concerned about receiving approval. Mr. Lam said the 5 foot setback is a good idea but was in conflict with the open space require- ment. He needed a 10 foot setback for his single story design. Jo Ann Hoenninger, 5201 Farago, stated she had mixed feelings on this case. In general she felt Council had done real damage to the community. She has sold her home but many of the people left on that block do not want these condominiums. She said the privacy and open space of the neighborhood will be affected. She further stated two -story condos do not fit in with the rest of the neighborhood. Ms. Hoenninger re- quested the traffic problem be looked into. Mayor Swain reminded Ms. Hoenninger that this property has been zoned R -2, Multiple Residential, since 1965. Councilman Gillanders commented that two -story developments are allowed in any zone in Temple City, the same as in many surrounding cities. There are various reasons why people do not want to live next to two -story developments; however, there is not a great deal that can or should be done about them as long as they meet the code requirements. Elizabeth Crawford, 5221 Farago, told Council that she lived north of one of Mr. Chang's developments and her cedar fence was removed and she requested that it be replaced. She also commented the subject property is overgrown and is now a fire hazard. She was also concerned about increased traffic. Additionally, she discussed flag lots being considered sub- standard and why would they grant a variance for a substand- ard lot? Mayor Swain explained the difference between a flag lot configuration and an R -2 zoning. Councilman Gillanders stated they could not build enough houses in this block to impact traffic. He further explained parking in commercial areas and the new code to bring the requirements for apartments and condominiums into confor- mance. Lucinda Grant, 5534 El Monte Ave., expressed her concern for the people living in this area. She also mentioned a mailing received from a broker asking them to sell because it is going to be developed anyway. City Council Minutes April 19, 1988 - Page 10 Sylvia French, 5320 Farago Ave., was concerned that outside interests not involved in the community saw a chance to make money and were building condominiums. The street now looks bad with the two obnoxious condos that are out of place. Councilman Froehle said the area is zoned R -2 which is not considered high density. They have height and setback re- quirements. Janet Soter, 5123 Farago, lives next door to the property in question and counted fourteen new units being added to the street, and felt this is enough. City Manager Koski said there seems to be a contradiction since during the General Plan hearings many people gave testimony they wanted an R -2 zoning for this area. There are three and sometimes four units on many lots already. What is taking place is the lots with single units are being con- verted to multiple use. Instead of apartments it is condo- miniums. It is a good location for additional units because it is close to a major street and there is a demand for single family units. To call a halt will deny people the right to develop their property. Helen Jordan, 5130 Daleview, stated that the builders cannot come up to her wall because they did not build directly on the property line but inside. She did not like these condo- miniums because they took away her privacy. She felt so many new developments would impact the schools. Frank Jordan, Jr., 5130 Daleview, a resident of Temple City for 31 years, told Council he has seen a lot of development; however, most people prefer single- story, single - family residences. He is not happy with outside people coming i not to live but to develop. He suggested rezoning the are back to R -1. Councilman Gillanders suggested Mr. Jordan, if he could get the support of his neighbors, petition City Council to re- verse the zoning to R -1. However, it has been his observa- tion that sometimes a vested interest makes a difference but Mr. Jordan does have the option to apply for a zone change. Mr. Jordan felt there was a difference in the area residents wanting to add one house than an outside developer coming in and adding four units. Perhaps Temple City needs a morato- rium on apartments. San Gabriel came up with a non - growth policy. He disagreed with Council and felt it would impact the schools. Councilman Froehle stated that during the General Plan meet- ings he received many calls from residents who wanted Farago to be zoned R -2. He explained the setback requirements for two story structures set to protect the neighbors. He also suggested a petition if the majority of people wanted the change. Councilman Gillanders informed Mr. Jordan of the developer's fee paid to the schools at the rate of $1.50 per square foot of living space. Ruben Reyes, 5154 Farago, lives across the street from this development and would like to see the Sheriff's Department go by. There will be an impact on traffic with 14 new units. He does not want to see an Alhambra and Monterey Park situation in Temple City. Jo Ann Hoenninger, 5201 Farago, stated that after listening to everyone it should be obvious there is a huge problem here. Change the law if necessary. Farago is not the only street in the City being affected. Perhaps Council could come up with an R -1 (A) Zone which would be somewhere between -1 and R -2. City Council Minutes April 19, 1988 - Page 11 As no one else wished to address the City Council on this matter, Councilman Atkins moved to close the public hearing, seconded by Councilman Gillanders and unanimously carried. Councilman Froehle stated that they looked forward to com- pleting the General Plan and felt they had the right density in this area. All the setback requirements have been met. Two -story structures are not always appealing but we cannot limit them. What Council can do is come up with setbacks so they are not overbearing on the neighbors. This project meets the R -2 standards so there is no alternative but to approve it. As previously suggested, get a petition together to change the zoning to R -1. Councilman Breazeal agreed totally with Councilman Froehle. Two -story is the issue not the density but you cannot deny someone's rights. If the residents want to change the zon- ing, come back with a petition. He would support Planning Commission's decision. Councilman Gillanders said they would only be playing with the system if they forced Mr. Lam to wait five days. It is interesting that many present think that it is wrong for somebody from another town to buy and build in Temple City. It is the American way. He is impressed with Mr. Lam's willingness to cooperate with staff and what he is asking for is completely legal. Continuing, Councilman Gillanders said that the fact there are property nuisance problems involved with this parcel is outside the law but is no reason to deny the project. Councilman Atkins called to their attention that a couple of weeks ago they brought the development standards for condo- miniums and apartments into conformance. He felt Council should take another look at the standards for two -story structures to be sure everything has been done to mitigate the effect on the neighboring properties. A vote on this case does not really mean anything. Mayor Swain agreed with Councilman Atkins. Mr. Lam tried to re- design the project but could not meet the open space requirement. If they denied this project tonight, Mr. Lam could still build it after May 5th. What needs to be done is a petition brought in requesting the neighborhood be rezoned to R -1. They spent two years on the General plan and tried to do what the people wanted in each area. All of the codes have been met and she could not vote against it. However, the owners should maintain the lot. Councilman Breazeal moved to deny the Appeal and support the decision of the Planning Commission to approve Tentative Parcel Map No. 19432, Conditional Use Permit No. 88 -900 and Zone Variance No. 88 -901 at 5135 Farago; seconded by Council- man Gillanders and unanimously carried. MATTERS FROM CITY OFFICIALS: Councilman Gillanders moved to approve the attendance of Coun- cilman Breazeal at the League of California Cities 1988 Mayors and Council Members Orientation seminar on May 11 - 13, 1988; seconded by Councilman Breazeal and unanimously carried. Councilman Breazeal commented on how sorry he was that his dear friend, Bill Dennis, was not able to be sworn in for another term. Councilman Atkins stated he sincerely believed there should be another review of second story development standards and another look at condominium requirements. He felt it's too easy to build in Temple City. Mayor Swain mentioned an Ordinance from Arcadia covering over- sized developments on undersized lots. The Planning Commission felt Temple City's standards were tight enough and did not feel review was necessary at this time. Mayor Swain directed Commu nity Development Dawson to take these suggestions back to th Planning Commission and cover such areas as second story stan- dards, lot coverage, etc. Mr. Dawson felt they could come up with ideas for discussion. City Manager Koski said a Study Session with the Chamber of Commerce is tentatively planned for Monday night, May 16th, to discuss budgets, goals and objectives. Perhaps Planning Commis- sion and Council could meet after the Chamber meeting. Mayor Swain welcomed Councilman Gillanders home from his recent trip to Hawkesbury Shire. Councilman Gillanders reported briefly on his trip and his experience in sitting in on the Sister City's Council. Mayor Swain discussed attending a meeting on the feasibility of hauling solid waste by railroad to waste disposal sites. The bottom line being tipping fees at local land fills average $10.50 per ton. If and when the rail type of disposal takes place, tipping fees will be around $36 -$55 per ton. 13.
