HomeMy Public PortalAbout2013-40 Resolution Approving Lot Combination for Property Adjacent to 2505 Willow DrMember Martinson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO. 2013-40 RESOLUTION APPROVING A LOT COMBINATION FOR PROPERTY LOCATED AT AND ADJACENT TO 2505 WILLOW DRIVE WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Daniel Johnson and Jill Johnson (the "Applicants") are the fee owners of property in the City of Medina at 2505 Willow Drive and immediately to the west which have the property identification numbers 16-118-23-42-0007 and 16-118-23-31-0001 according to the records of Hennepin County, Minnesota; and WHEREAS, the Applicants are the vendees on a contract for deed for the property immediately to the east of 2505 Willow Drive which has the property identification number 16- 118-23-42-0006 according to the records of Hennepin County, Minnesota; and WHEREAS, the three parcels described (collectively, the "Properties") are identified on the map attached hereto as Exhibit A; and WHEREAS, the Applicants have requested approval from the City to combine the Properties into a single parcel of 61.5 acres in area; and WHEREAS, the Applicants have also requested to rezone the Properties from the Rural Residential to the Agricultural Preservation zoning district; WHEREAS, on May 21, 2013, the city council reviewed the requested lot combination and heard comments from interested parties; and WHEREAS, following such review and comments, the city council makes the following findings of fact in regards to the proposed lot combination: 1. The proposed combination is consistent with the Comprehensive Plan. 2. The proposed combination is appropriate for the physical conditions on the site including the topography, storm water, natural resources, and soils. 3. The density proposed is consistent with the City of Medina Comprehensive Plan and the lot proposed is consistent with the standards of the RR and AG Zoning Districts. 4. The proposed combination is not likely to cause substantial environmental damage. 5. The proposed combination is not likely to be injurious to public health. 6. The proposed combination will not conflict with public or private streets, easements, or right-of-ways. Resolution No. 2013-40 May 21, 2013 7. The proposed combination does not inhibit proper utility and street connections to neighboring properties. NOW, THEREFORE BE IT RESOLVED, by the city council of Medina, Minnesota that approval is hereby granted for the proposed lot combination, subject to the following terms and conditions: (1) This approval shall be subject to the Applicants obtaining fee ownership of property which has PID 16-118-23-42-0006 according to the records of Hennepin County. (2) The Applicants shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the request and preparing relevant documents. Dated: May 21, 2013.
