HomeMy Public PortalAbout2013-49 Resolution Authorizing Waiver of Certain Dev Fees for an Affordable Housing Project by DominiumMember Martinson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2013-49 RESOLUTION AUTHORIZING THE WAIVER OF CERTAIN DEVELOPMENT FEES FOR AN AFFORDABLE HOUSING PROJECT BY DOMINIUM WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Dominium (the "Developer") intends to propose the development of approximately 32 affordable rental housing units on property at 510 Clydesdale Trail (the "Property") and is seeking funding from public agencies to support the project; and WHEREAS, the City wishes to support the construction of affordable housing within Medina; and WHEREAS, the Developer has requested that the City waive certain development fees in the interest of financially supporting the project; and WHEREAS, the assistance requested by the Developer is proposed to be provided in consideration for the Developer constructing housing within the City, and therefore, is not considered a business subsidy for purposes of Minn. Stat. 116J.993 — 116J.995 (the "Business Subsidy Act"). NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota does hereby agree to waive the City Trunk Water Connection Fees, City Trunk Sewer Connection Fees, and, if applicable, Park Dedication Fees for an affordable housing project on the Property, subject to the following terms and conditions: 1) The rent of the housing units and other terms and conditions regarding affordability of the project shall be acceptable to the City; 2) The fee waiver shall only apply to the specific fees noted above and shall not exceed $300,000; 3) The agreement to waive the fees noted above shall only be valid for Dominium and only apply to an affordable housing project constructed on the Property; and 4) The Developer shall enter into a written agreement consistent with the terms and conditions stated in this resolution and agree to repay to the City the amount of the fees waived if the affordable housing development is not completed or terminated prematurely.
