AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, APPROVING A PRELIMINARY
AND FINAL PUD PLAN FOR A 0.10 ACRE TRACT ADDRESSED AS 628 CLARK AVENUE,
LOCATED IN PART OF LOTS 106 AND 107, FAIRVIEW ADDITION, JEFFERSON CITY, COLE
COUNTY, MISSOURI.
WHEREAS, Steven and Janet Hurst, owner of the real estate hereinafter described, having
submitted to the City Council a Preliminary and Final PUD Plan of said real estate,
being located in Jefferson City, Cole County, Missouri, and more particularly
described as follows:
Part of Lots Nos. 106 and 107, and a strip of land 12 feet wide and
adjacent to the South side of Lot No. 107, being part of land vacated
by the City of Jefferson in Fairview Subdivision, a subdivision of
Outlots Nos. 57 and 58, in the City of Jefferson, Cole County,
Missouri, described as follows: Beginning at a point on the Easterly
line of Lot No. 106, which said point Iles 12 feel southerly of the
northeasterly corner thereof; thence in a southerly direction along the
easterly line of Lots Nos. 106 and 107, and the strip vacated by the
City of Jefferson, 50 feet 7 '/7 inches to the southeasterly corner of
• said vacated land, thence in a westerly direction along the southerly
line of said vacated land and parallel with the southerly line of Lot
No. 107, 89 feet 6 Inches; thence in a northerly direction parallel with
the easterly line of said vacated land, Lots Nos. 107 and 106, 50 feet
7 V2 Inches, thence in an easterly direction parallel with the northerly
line of Lot No. 106, 89 feet 6 Inches to the easterly line thereof and
the beginning point of this description. Containing approximately
0.10 acres.
WHEREAS, it appears that the procedures set forth in the zoning code relating to zoning have in
all matters been complied with as said property owner submitted to the Planning
and Zoning Commission and City Council a Preliminary and Final PUD Plan for the
above referenced property.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
SECTION 1. The Preliminary and Final PUD Plan submitted by David and Gabrielle
Rachell, on file as Case No. P05027 in the Jefferson City Planning Division is hereby approved for
the above land referenced herein.
SECTION 2. The following principal land uses are approved for the site:
A. Permitted uses on the first and second floors shall include individual residential dwelling
units and any use permitted by right in the C-1 Neighborhood Commercial District;
B. Permitted uses in the basement shall Include any use permitted by right in the
C-1 Neighborhood Commercial District, including Laundromat.

• SECTION 3. Approval is made subject to the following conditions:
A. Permits shall be obtained for signage and any building alterations or remodeling;
B. Signage shall be limited to a wall sign no larger than 16 square feet and may be
Illuminated;
C. A parking lot striping plan shall be approved by City staff and the spaces shall be
striped in accordance with the plan prior to occupancy of the laundromat.
SECTION 4. Common Areas and Public Land. No common areas are proposed and no
lands are dedicated to public use with this PUD Plan.
SECTION 5. Access: Vehicular access to the site is provided by a driveway off Dunklin
Street which serves an existing on-site parking lot located west of the building.
SECTION 6. This ordinance shall be in full force and effect from and after the date of its
passage and approval.

• The City Council of the City of Jefferson, Missouri,will hold a public hearing on Monday,August 15,
2005 at 6:00 p.m. In the Council Chamber of the John G. Christy Municipal Building, 320 East
McCarty Street, to consider a Preliminary and Final PUD Plan for a 0.10 acre tract as described
herein for the following property:
Section 1. Property Location and Description is 628 Clark Avenue: Part of Lots

Dear Sirs,
Enclosed please find our applies tion for Planned Unit Development (PUD) for the Cl
property located at 628 Clark Avenue in Jefferson City. We currently have a contract for
tine purchase of this property from Mr. and Mrs. Steven Hurst, conditional to the Planning
Division's approval of the attached PUD.
•
Our intended use of the property will require minimum changes to the exterior
appearance of the building. Currently,the property is vacant and it was most recently
used by Mr. Hurst as both a dwelling and an office on the main and upper floors.
Our intended use of the property is two fold. We plan to utilize the walk-out basement
space to set up an attended, automated laundry to serve Lincoln University students and
the immediate vicinity. This laundry space would remain totally independent from the
upstairs floors by elimination of the staircase that now links the two areas. Furthermore,
an independent utility area will be set up for the laundry. Plumbers and electricians will
be hired to upgrade the existing utilities to meet the needs of the laundry. The entry way
to the laundry would face the existing parking lot on the back of the building. The above
mentioned exterior changes will be linked to the laundry and will include a double entry
door and business sign.

The second use of the property pertains to the main and second floors. Currently, only the
second floor is deemed for residential use. This division adversely affects the use of the
property since there is no independent entrance to reach that floor. Through this PUD,
we request permission to utilize the two existing entrances and the proposed internal
structural changes(see attached drawings) to set up distinct residential units. Considering
that each floor has its own kitchen and complete bath, the proposed change would
maximize the utilization of the space.

Location
The subject property is located at the nortinvcsl cornerofClark Avenue mid Dunklin Street and is zoned C-1
Neighborhood Commercial. Adjacent zoning is C-1 to the north and cast and RD Medium Density Residential
to the south and west of the subject site.A mixture ofuses are located in the immediate vicinity of the property.
• Residential exists to the north and west and neighborhood retail/service/office uses (convenience store,
plumbing and healing business, financial investments)exist to the cast and south.
Background
The property was the location of Salisch Paint and Decorating until 1993. It was then vacant for some time
mail it was changed to office use, In April, 1998,(he Board ofAdjus(mca(approved a conditional use permit
to establish a single residence, which included the installation ofa kitchen, on the second floor. A business
office occupied the first floor until recently.
Nature of Rcnuest
The applicant is requesting approval to establish a mix of residential and commercial uses within an existing
building. Specifically, the request is for the continued use of the second floor as a residential apartment,the
conversion of the first floor into a residential aparunetu,and the conversion of the walk-out basement into an
automated laundry.
Analvsis
A. Rezoning. The C-1 district allows retail, office and certain other uses on the first floor and in a basement
(including a laundromat)but only allows a residential use in a non-residential building on the second floor or
above.Tbc intent ofthis provision is to reserve the first floor of buildings in commercial districts forretail and
office uses. Therefore, to establish a residential unit on the first floor, either the entire property could be
rezoned to residential or it could be rezoned to PUD. The applicant has requested PUD zoning in order to
allow mixed residential and commercial use of the building.

Parma The parking requirement for a residence above the first floor is I space, for a residence on the
first floor-2 spaces, and for a Laundromat- I space/300 square feet of floor area.'lllis results in a total
requirement of 5 parking spaces for all uses. The existing parking lot, if the spaces were striped, would
provide parking for 5.6 vehicles, which is adequate for the proposed uses.
Sidewalks. Sidewalks exist adjacent to the properly boll)oil Clark Avcnuc and Dunklim Street,

and Council in the site plan review and approval process. In a standard commercial district,one post sign

Staff Recommendation
Staff recommends approval of the rezoning front C-1 to PUD, subject to the following condition;
