ORDINANCE NO. 3�
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY
ANNEXATION OF REAL PROPERTY CONTIGUOUS TO, AND LYING SOUTH OF THE PRESENT
CITY LIMITS, INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN SECTION 10, IN
TOWNSHIP 44 NORTH,RANGE 12 WEST IN THE COUNTY OF COLE, STATE OF MISSOURI,AND
AMENDING SECTION 1-17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING
THE EXISTING CITY BOUNDARY BY ADDING ONE NEW SUB-SECTION PERTAINING TO THE
SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson
desires to annex the unincorporated area of land described in Section 1; and
WHEREAS, the owners of the property have submitted a petition to have their property Included
within the corporate boundaries of the City of Jefferson; and
WHEREAS, the property is adjacent to the City and Is located along West Edgewood and
WHEREAS, a public hearing concerning the annexation was advertised on July 29, 2005 in the
Jefferson City Post Tribune; and
• NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI,AS FOLLOWS:
Section ,11, The City Council Intends to and shall proceed to annex, as provided by law, the
unincorporated area of land described as follows, containing approximate 6.3 acres, more or less:

Part of the Southeast Quarter or the Southeast Quarter of Section 10,Township 44 North,Range 12 West,
Cole County,Missouri more particularly described as follows:
From the southeast comer of said Section 10 thence 583'51'58"W,along the Section Line, 125.00 feet to
the northwest corner of Lot No.22 of FAINWOOD SUBDIVISION,THIRD ADDITION,as per plat of
record in Plat Book 11,page 258,Cole County Recorder's Office and the POINT OF BEGINN ING for lhis
description;thence continuing S83'51'58"W,along the Section Line, 1220,23 feet to the southwest corner
ofthe Southeast Quarterofthc Southeast Quartcrofsaid Section 10;thence NS'40'59"W,along the Quarter
Quarter Section Line,68.66 feet to the present southerly line of the Edgcwood Drive right-of-way,said
being the northerly line of the vacated right-of-way of Edgcwood Drive as per City Ordinance No. 12814;
thence,along said right-of-way line the following courses:N57'39'40"E,388.21 feet;thence Easterly,on
a curve to the right,having a radius of 1387.39 feel,an are distance of 255.21 feet,(the chord of Bald curve
being N79'27'05"E,254.85 feet);N84'43'16"E,623.27 feet to a point intersecting the northerly extension
of the westerly line of the aforesaid Lot No. 22 of FAINWOOD SUBDIVISION,THIRD ADDITION;
thence leaving the southerly line of said Edgcwood Drive right-of-way,S4'3I'32"E,along said extended
line,248.47 feet to the PONT OF BEGINNING.
Containing 6.30 acres
Section?-. The City Council finds and declares that the land described in Section 1 is contiguous
. to the City boundary; that the annexation is reasonable and necessary to the proper development of the

• City;and further,did determine the City has the ability to furnish normal municipal services to the area.
Section 3. A public hearing was held on August 12, 2005 as provided by law, concerning
the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned C-2 until such time as the zoning may
be changed in the manner provided for by State Statute and City Code.
Section 6. Section 1-17 of the Code of the City of Jefferson, Missouri is hereby amended by
adding one new subsection which shall read as follows:

to the PONT OF BEGINNING.
Containing 6.30 acres
Section 6. The annexed area shall be in Ward 4 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area described In
Section 1 will be Immediate upon passage provided that no written objections to the proposed
annexation are filed with the City Council, If sufficient objections are filed, this ordinance shall not
become effective until such time as the annexation Issue has been resolved pursuant to the provisions
of Chapter 71 RSMo.

A petition for voluntary annexation has been filed with the City
Council for the City of Jefferson City to annex certain property
into the City of Jefferson City at the request of the property
owner, said property being described as:

The following described parcel of land, and improvements and appurtenances
thereto in the County of Cole, State to Missouri, to wit:
Part of the Southeast Quarter of said Section 10 thence S8305115811W, along the Section Line, 125.00 feet
to the northwest corner of Lot No. 22 of FAINWOOD SUBDIVISION,THIRD ADDITION, as per plat of
record in Plat Book 11, page 258, Cold County Recorder's Office and the POINT OF BEGINNING for this
description; thence continuing S83°along the Section Line, 1220.23 feet to the southwest corner of the
Southeast Quarter of the Southeast Quarter of said Section 10; thence N 5°along the Quarter Quarter
Section Line, 68.66 feet to the present southerly line of the Edgewood Drive right-of-way,said being the

A hearing on the proposed annexation will be held in the
Boone-Bancroft Room, City Hall, 320 E. McCarty St., Jefferson
City, Missouri on August 12, 2006 at noon immediately
following the City Council Brown Bag Meeting.

Please be advised that the property referenced above is owned by S & O Development and
has recently been platted as Creektrail Subdivision, a commercial subdivision containing six
(6) lots upon 6.3 acres.
• While no businesses were located on this property at the time It was annexed, the land was
zoned C-2 General Commercial upon annexation with the Intent to develop all lots for
commercial purposes.
