SUBJECT: PUBLIC HEARING -ADOPTION OF RESOLUTION NO. 18-5334 APPROVING THE MASTER FEE AND FINE SCHEDULE FOR FISCAL YEAR 2018 -19 RECOMMENDATION : The City Council is requested to : 1 . Rece ive presentation from staff; 2 . Open the p ubl ic hearing and receive publ ic comment ; 3 . Close the public hearing ; 4 . Adopt Resolution No . 18 -5 334 approving the Master Fee and Fine Schedule for Fisca l Yea r 20 18-19. BACKGROUND/ANALYSIS: The City has estab li shed a Master Fee and Fine Schedu le (Schedu le) of charges for City services , which is revised as needed and adopted annua lly. The Schedu le proposes the fo ll owing changes for Fisca l Year 2018-19 : • In crease the following fees to 100% cost recovery : o All Planning service fees o Address ass ignment or change request o Shoppi ng cart conta inment and retr ieva l plan rev iew o All Publ ic Works fees o Spec ial event permit o Street closure permit • Establ ish the fo llowi ng new fees at 100 % cost recovery: o Temporary Use Permit o Telecommun ications Permit City Council June 19 , 2018 Page 2 of 2 All fines and other fees will remain unchanged . Attachment A of this report provides a summary of all proposed fee changes. It is recommended that the C ity Council approve one of the following alternatives : a) Increase fees to the recommended full cost recovery rate of 1 00 %; b) Increase fees to a recovery rate between the current rate of 75% and 1 00 %; c) Maintain fees at the current 75 % recovery rate but approve the proposed new Temporary Use and Telecommunications fees ; or d) Take no action on fees at this time. CITY STRATEGIC GOAL: Approval of the Master Fee and Fine Schedule furthers the City Strategic Goal of Good Governance . FISCAL IMPACT: It is estimated that the proposed fees will generate an additional $50 ,000 annually. ATTACHMENTS: A. Summary of fee changes B. and WHEREAS , the City Council has received and cons idered information about the actual cost of providing such programs , services , and fac ili ties ; and WHEREAS , the City Council held a duly noticed pub li c hear ing on June 19 , 2018, to consider approving the updated Master Fee and Fine Schedule fo r Fiscal Year 2018-19 , which includes previously established fees and f i nes and estab li shes several new fees . NOW, THEREFORE, the City Council of the City of Temp le City does hereby resolve , find , determ ine , and order as follows : SECTION 1. The fees set forth in the Master Fee and Fine Schedule , attached hereto as Attachment "A " and incorporated herein by reference , are reasonably necessary to recover the costs of providing the programs , services , and fac il iti es for wh ich such fees are levied or authorized to be levied . SECTION 2. City Council Resolutions No . 17-5262 and 17-5295 and the attachments thereto are hereby superseded in the ir entirety by this resolut ion and the updated Master Fee and Fine Schedule , attached hereto as Attachment "A" and incorporated herein by reference . SECTION 3. The City Clerk shall certify to the passage and adoption of this Resolution and it shall thereupon take effect. The initial license fee and permit fee payment is prorated quarterly for all license and permit types. Proration is calculated as a percentage of the fee based on when the business is initially licensed as follows : January 1 -March 31: 100%, April1-June 30: 75 %, July 1-September 30 : 50%, October 1-December 31: 25 % • Process fees listed below are one-time fees that are due payable when a business application is submitted . Process fees are required for new businesses and for any change to an existi ng business that requires a new application to be subm itted, including but not limited to moving to a different locat io n or a change of ownership. • Other fees listed below are annual fees that are due payable when a bus iness application is submitted and annua l ly thereafter, unless otherwise noted . Ba ckground checks, when required for regulated businesses , are conducted annua ll y by the Los Angeles County Sheriff's Department (LASD). Background checks are required for every business owner. An additional fee equal to SO percent of the app lication fee shall be due paya bl e at the time of a third resubmittal.
