ORDINANCE NO: 648 AN ORDINANCE CONCERNING THE AMENDMENT OF CHAPTER 16, ARTICLE 4 OF THE CITY CODE OF BEL AIRE, KANSAS, IN CONNECTION WITH INSPECTION REQUIREMENTS FOR BACKFLOW PREVENTION DEVICES, ALL WITHIN THE CITY OF BEL AIRE, SEDGWICK COUNTY, KANSAS. Be it ordained by the Governing Body of the City of Bel Aire, Kansas: Section 1. AMENDING SECTION 16.4.6 OF THE BEL AIRE MUNICIPAL CODE: It shall be the responsibility of building and premise owners to have each backflow preventer device tested and inspected immediately after initial installation to assure the device has been installed properly and that debris resulting from the installation has not interfered with the functioning of the device. Thereafter, it shall be the responsibility of building and premise owners to have each backflow preventer device tested and inspected annually, any overhaul or repairs made, and a backflow device test report filed with the City of Bel Aire, Kansas annually, on or before the first day of June of each year, beginning in 2020. The inspection and testing shall be by a certified tester/repair technician certified by the Wichita-Sedgwick County Health Department, licensed in Bel Aire and testing procedures shall be in accordance with the manufacturer's instructions when approved by the City Engineer. Overhaul intervals should not exceed five (5) years. There shall be a filing fee to file a backflow device test report with the City of Bel Aire, Kansas set forth in the City fee schedule. If an irrigation system is not being utilized, the property owner shall have the system completely disconnected from the City water supply and capped off. The City Engineer's designee shall inspect, approve, and tag such disconnected systems. Approved disconnected systems shall not be required to be tested or rebuilt while disconnected. A new backflow device must be installed and inspected upon any reconnection to the City water supply. SECTION 2. REPEAL. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 6. EFFECTIVE DATE. This ordinance shall take effect and be in force from and after the publication of its summary in the Ark Valley News, and official City newspaper.
