CITY OF MEDINA RESOLUTION NO.2013-57 RESOLUTION APPROVING A LOT LINE REARRANGEMENT FOR MICHAEL KUNIN & SREY TAN AND THE ESTATE OF WALLACE ANDERSON AT 855 MEDINA ROAD, 985 MEDINA ROAD, AND ADJOINING PROPERTY WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Michael B. Kunin and Srey M. Tan (the "Applicants") own property within the City which is legally described as Lot 2, Block 2, Tuckborough Farm Fourth Addition, Hennepin County, Minnesota; and WHEREAS, the estate of Wallace E. Anderson (the "Estate") owns two parcels of property within the City which are legally described as Lot 2, Block 1, Green Pastures Farm, Hennepin County, Minnesota and the Southwest Quarter of the Southwest Quarter of Section 13, Township 118 North, Range 23 West of the 5 h Principal Meridian; and WHEREAS, the properties described above owned by the Applicants and the Estate are collectively referred to herein as "the Properties"; and WHEREAS, the Applicants and the Estate are collectively referred to herein as "the Owners"; and WHEREAS, the Owners have requested approval from the City to rearrange the common property lines between the Properties; and WHEREAS, the City Council reviewed the proposed lot line rearrangement on July 2, 2013, at which time all interested parties were heard; and WHEREAS, following the review, the City Council found that the rearrangement will not negatively impact any neighboring properties, impair the environment or public health, or conflict with any public purposes. NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota hereby grants approval of the requested lot line rearrangement subject to the following terms and conditions: 1. The Properties shall be legally described as shown in Exhibit A, attached hereto. Resolution No. 2013-57 July 16, 2013 2. Easements shall be granted for the area identified in the memo dated June 26, 2013. The Owners shall provide legal descriptions for these easements. 3. The Owners shall meet the requirements of the City Attorney with regards to title issues and recording procedures and any other documents necessary for placing this approval into effect. 4. The Owners shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the lot line adjustment. 5. The Owners must file necessary paperwork with Hennepin County to effectuate the lot line adjustment within 180 days of approval. Dated: July 16, 2013. ATTEST: 1-4440/1 Scott T.
