CITY OF MEDINA RESOLUTION NO.2013-65 RESOLUTION APPROVING A LOT LINE REARRANGEMENT FOR THE REIMER TRUSTS AND THREE RIVERS PARK DISTRICT BETWEEN 1822 HOMESTEAD TRAIL AND ADJACENT PROPERTY WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Three Rivers Park District ("Three Rivers") owns property within the City which is legally described in Exhibit A, attached hereto; and WHEREAS, the Sylvia Maria Reimer Neumann Trust, Michael Philip Reimer Trust, Phyllis Joan Reimer Willegalla Trust, and Bernard George Reimer Trust (collectively, "Reimer") own property within the City which is legally described in Exhibit A, attached hereto; and WHEREAS, the properties described in Exhibit A are collectively referred to herein as "the Properties"; and WHEREAS, Three Rivers and Reimer are collectively referred to herein as "the Owners"; and WHEREAS, the Owners have requested approval from the City to rearrange the common property lines between the Properties; and WHEREAS, the City Council reviewed the proposed lot line rearrangement on August 7, 2013, at which time all interested parties were heard; and WHEREAS, following the review, the City Council found that the rearrangement will not negatively impact any neighboring properties, impair the environment or public health, or conflict with any public purposes. NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota hereby grants approval of the requested lot line rearrangement subject to the following terms and conditions: 1. The Properties shall be legally described as shown in Exhibit B, attached hereto. Resolution No. 2013-65 August 20, 2013 2. The Owners shall grant to the City the drainage and utility easements described in the memorandum from the City Planner dated August 13, 2013. The Owners shall provide legal descriptions for these easements. 3. The Owners shall meet the requirements of the City Attorney with regards to title issues and recording procedures and any other documents necessary for placing this approval into effect. 4. The Owners shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the lot line adjustment. 5. The Owners must file necessary paperwork with Hennepin County to effectuate the lot line adjustment within 180 days of approval. Dated: August 20, 2013. ATTEST: Scott T.
