WHEREAS, Rodney A. and Keely R. Prohaska, owners of the real estate hereinafter described, having submitted to the City Council a Major Amendment to the Final PUD Plan of said real estate, being located in Jefferson City, Cole County, Missouri,and more particularly described as follows: Part of the Northwest quarter of the Southeast quarter of Section 16,Township 44, Range 11, in the City of Jefferson, Cole County, Missouri, more particularly described as follows: From the northwest corner of the Southeast quarter of Section 16; thence east along the quarter Section line, 713.79 feel; thence South 4 degrees 20 minutes east, 299.64 feet, to the northerly line of old U.S. Highway No. 50, now known as Old St. Louis Road; thence South 42 degrees 15 minutes west, 109.7 feet, to the southerly line of said old Highway No. 50, at the northwesterly corner of a tract conveyed to Josephine Landwehr, by deed of record In Book 99, page 261, Cole County Recorder's Office; thence South 71 degrees 30 minutes east, along the southerly line of said old Highway, 195 feet, to the • beginning point of this description, and being the northwesterly corner of a tract conveyed to Charles Richard Willibrand and wife, by deed of record in Book 203, page 222, Cole County Recorder's Office; thence continuing southeasterly along the southerly line of said Old Highway, 105 feet, to the northeasterly corner of a tract conveyed to Charles Richard Willibrand and wife, by deed of record in Book 137, page 148, Cole County Recorder's Office; thence turning an angle to the right of 90 degrees, 200 feet; thence turning an angle to the right of 90 degrees, 100 feet, to the most southerly corner of aforesaid tract conveyed in Book 203, page 222, Cole County Recorder's Office; thence North 17 degrees 04 minutes east, along the westerly line of said tract, 200.06 feet, to the beginning point of this description. NOW,THEREFORE,BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS: SECTION 1. The Major Amendment to the Final PUD Plan submitted by Rodneyand Keely Prohaska on file as Case No. P05026 In the Jefferson City Planning Division is hereby approved for the above land referenced herein. SECTION 2. The following principal land uses are approved for the site:The main building may be used for a furniture and decorating store, an educational materials store, a dance school, a photography studio, an art gallery, an antique store and a child day care center. The annex • building may be used for a child day care center. 1 SECTION 3. Approval is made subject to the following condition: Permits shall be obtained for the sign and any building alterations or remodeling. SECTION 4. Common Areas and Public Land. No common areas are proposed and no lands are dedicated to public use with this PUD Plan. SECTION 5. Access: The site will obtain access from East McCarty Street. There is a 11'wide entrance drive on the west side of the site which extends around both the front and back of the main building to a 11'wide exit drive on the east side of the site back to East McCarty Street.
