AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE
VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO, AND LYING
SOUTHWESTERLY OF THE PRESENT CITY LIMITS, INTO THE CITY OF JEFFERSON,
MISSOURI, LOCATED IN SECTION 10, TOWNSHIP 44 NORTH, RANGE 12 WEST IN THE
COUNTY OF COLE, STATE OF MISSOURI, AND AMENDING SECTION 1-17 OF THE CODE
OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY BY
ADDING ONE NEW SUB-SECTION PERTAINING TO THE SAME SUBJECT.
WHEREAS, pursuant to Section 71.012.2 RSMo, 1994, the City Council of the City of Jefferson
desires to annex the unincorporated area of land described in Section 1; and
WHEREAS, the owners of the properly have submitted a petition to have their property Included
within the corporate boundaries of the City of Jefferson; and
WHEREAS, the property is adjacent to the City and is located along Edgewood Drive, and
WHEREAS, a public hearing concerning the annexation was advertised on September 3, 2005
in the Jefferson City Post Tribune; and
• NOW THEREFORE, BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. The City Council Intends to and shall proceed to annex, as provided by law,
the unincorporated area of land described as follows, containing approximate .65 acres, more or
less:
Part of the Southeast Quarter of the Southeast Quarter of Section 10,Township 44
North, Range 12 West, Cole County, Missouri, more particularly described as follows:
BEGINNING at the southeast corner of said Section 10,thence S83'51'58"W,along
the Section Line, 125.00 feet to the northwest corner of Lot No. 22 of FAINWOOD
SUBDIVISION, THIRD ADDITION, as per plat of record In Plat Book 11, page 258, Cole
County Recorder's Office;thence N4'31'32"W,along the northerly extension of the westerly
line of said Lot No. 22, 248.47 feet to a point Intersecting the present southerly line of the
Edgewood Drive right-of-way, said being the northerly line of the vacated right-of-way of
Edgewood Drive as per City Ordinance No. 12814;thence N84'43'1 WE,along said present
right-of-way line,24.10 feet;thence S70618'21"E,along said present right-of-way line,106.75
feel to a point Interesting the east line of the aforesaid Section 10;thence S5'31'20"E,along
the Section Line 201.52 feet to the POINT OF BEGINNING.
Containing 0.65 of an acre.
Subject to terms, conditions, restrictions and reservations of record, if any.
• Section ;; The City Council finds and declares that the land described in Section 1 is
• contiguous to the City boundary; that the annexation is reasonable and necessary to the proper
development of the City; and further, did determine the City has the ability to furnish normal
municipal services to the area.
Section 3. A public hearing was held on September 16, 2005 as provided by law,
concerning the annexation of the unincorporated area described in Section 1.
Section 4. The land described in Section 1 shall be zoned C-2 until such time as the
zoning may be changed in the manner provided for by State Statute and City Code.
Section 5. Section 1-17 of the Code of the City of Jefferson, Missouri is hereby amended
by adding one new subsection which shall read as follows:

the aforesaid Section 10;thence S5'31'20"E,along the Section Line 201.52 feet to the
POINT OF BEGINNING.
Containing 0.65 of an acre.
Subject to terms, conditions, restrictions and reservations of record, if any.
Section I The annexed area shall be in Ward 4 of the City.
Section 7. The effective date of this Ordinance and the annexation of the area described
in Section 1 will be immediate upon passage provided that no written objections to the proposed
annexation are filed with the City Council. If sufficient objections are filed, this ordinance shall not
become effective until such time as the annexation Issue has been resolved pursuant to the
provisions of Chapter 71 RSMo.
