ORDINANCE NO. 13q 3/
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE AN AMENDMENT TO THE AGREEMENT TO
FURNISH JOINT COMMUNICATIONS SERVICES TO COLE COUNTY.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
Section 1. The Mayor and City Clerk are hereby authorized and directed to execute
an Amendment to the Agreement to Furnish Joint Communications Services To Cole
County to include the Village of Wardsville.
Section 2. The agreement shall be substantially the same in form and content as
that agreement attached hereto as Exhibit A.
Section 3. This Ordinance shall be in full force and effect from and after the date
• of its passage and approval.

AMENDMENT TO AGREEMENT
TO FURNISH JOINT COMMUNICATIONS SERVICES TO COLE COUNTY
Whereas, the Village of Wardsville is a Village located wholly within the County of Cole; and,
Whereas, the Village of Wardsville provides public safety to its citizens through an appointed
Village Marshall ; and,
Whereas, these officers require communications services for vehicle and driver information
through MULES; and
Whereas, these officers, usually working alone, depend on effective communications for their
safety and the safety of their citizens; and,
Whereas, this municipality lacks the resources to provide a communication system on its own,
nor would independent communication systems be efficient or effective,
NOW therefore, in consideration for the mutual promises contained herein, the undersigned
parties hereby agree as follows:
1. The Agreement to Furnish Joint Communications Services to Cole County, entered into
between Jefferson City and Cole County, is amended as set forth herein. Except as
• explicitly amended herein, all other portions of the agreement not directly contradictory
to this agreement remain in full force and effect.
a. The title of the agreement is hereby changed to "AGREEMENT TO FURNISH
JOINT COMMUNICATIONS SERVICES:'
b. For the purposes of Section 10(B) of the agreement only, the Village of
Wardsville, shall be added to the list of agencies in Exhibit A and shall thereby be
eligible for one of the two spats reserved for entities in the County.
2. The City of Jefferson agrees to provide Communication Services to the Village of
Wardsville pursuant to the terms of the"AGREEMENT TO FURNISH JOINT
COMMUNICATIONS SERVICES" as amended.
3. The Village of Wardsville agrees that it will:
a. provide to the Joint Communications Center its OR[ number prior to beginning
use of services
b. provide and maintain at their own cost radio equipment to communicate with the
joint operations center.

C. indemnify and hold harmless the City of Jefferson, including cost of defense, in
the event that the City of Jefferson is named in a lawsuit based upon allegations of

• wrongdoing by it(Wardsville) or their agents or employees.
d. be responsible to assure that their officers are using MULES only for the purposes
allowed in the rules and regulations of MULES and to abide by all other MULES
rules and regulations.
C. provide the City of Jefferson with a copy of the ordinance authorizing their
representative to execute this agreement.
4. In exchange for the services provided herein,the Village of Wardsville agrees to pay to
the City of Jefferson the sum of$600.00 per year, payable in advance. The first payment
shall be due upon the execution of this agreement and a similar amount annually on the
anniversary of the execution of this agreement.
5. The City of Jefferson and the County of Cole agree that the compensation imposed herein
is de minimus and will not change the compensation schedules previously agreed to
between them.
6. Each entity agrees that the individual executing this document has been properly
authorized by the entity represented to sign this agreement.
