APPROVING PRO r E SSIONAL SERVICES CONTRACT -
JAMES F. CLARIQN, III, ESQ.
WHEREAS, the Borough of Carteret is in need of specialized legal services with
regard to the defense of the matter of Tampa v. Borough of Carteret and Carteret
Planning Board, Superior Court of New Jersey, Law Division — Middlesex
County, Docket No. MID-L- 8033 -05; and
WHEREAS, James F. Clarkin, III, Esq. presently serves as the attorney for the
Plarming Board and possesses the requisite experience and expertise to provide
said specialized legal services; and
WHEREAS, the Borough Attorney has recommended the appointment of James
F. Clarkin, III to defend the Carteret Plarming Board in the above referenced
matter at an hourly rate of $125.00 not to exceed a maximum cost of $1,500.00;
and
WHEREAS, the Chief Financial Officer has certified that funds are or will be
available for said purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret that the James F. Clarkin, III, Esq. is hereby appointed
special counsel to defend the Carteret Planning Board in the above described
matter at an hourly rate of $125.00 for a maximum cost not to exceed $1,500.00.
BE IT FURTHER RESOLVED, that this action is approved as an award of a
professional services contract pursuant to N.J.S.A. 40A:11- 5(1)(a) in accordance
with the Borough's Fair and Open Process as authorized by law.

Borough Hall, 61 Cooke Avenue, Carteret, New Jersey.
As per Resolution Number 07 -298.
THE CONTRACTOR does hereby agree to perform the following:
PROFESSIONAL SERVICE CONTRACT FOR LEGAL TAMPA V BOROUGH OF
CARTERET, CARTERET PLANNING BOARD, SUPERIOR COURT OF NJ
DOCKET #MID -L- 8033 -05.
NOT TO EXCEED $1,500.00.
According to the terms set forth in the Resolution.
THE BOROUGH does hereby agree to pay the Contractor the sum set forth in
Resolution.
