HomeMy Public PortalAboutr 07:304�sa�u #ga r � e axa�t a 3C Q7 -�y Dale of Adoptio Dx rfber 6, 2(70 No. , RESOLUTION OF THE BOROUGH OF CARTERET AUTHORIZING AND DIRECTING THE CARTERET PLANNING BOARD TO PREPARE AN AMENDMENT TO THE WEST CARTERET COMMERCIAL REDEVELOPMENT PLAN WHEREAS, the Local Redevelopment and Housing Law, N.J.S.A. 40A:12A -1 et seq., as amended and supplemented (the "Redevelopment Law") provides a process for municipalities to participate in the redevelopment and improvement of areas in need of redevelopment; and WHEREAS, on October 28, 2004, the Borough Council adopted resolution number 04 -335 requesting that the Borough Planning Board (the "Planning Board ") determine whether certain real property located within the Borough constitutes an "area in need of redevelopment" pursuant to the Redevelopment Law; and WHEREAS, on January 27, 2005, the Borough Council adopted resolution number 05 -45 specifying that that proposed redevelopment study area be comprised of Block 372, Lots I through 17, inclusive, on the Borough's Tax Map (collectively, the "Redevelopment Area "); and WHEREAS, on April 27, 2005, the Planning Board adopted a resolution of findings and conclusions to recommend to the Borough Council that the Redevelopment Area be designated an "area in need of redevelopment" by the Borough; and WHEREAS, on June 2, 2005, the Borough Council, following the recommendation of the Planning Board, adopted resolution number 05 -188 determining that the Redevelopment Area constitutes an "area in need of redevelopment" tinder the Redevelopment Law; and WHEREAS, on August 11, 2005, the Borough Council adopted resolution number 05 -245 directing Beacon Planning and Consulting Services (`BPCS') to prepare a redevelopment plan; and WHEREAS, BPCS prepared a redevelopment plan (the "Redevelopment Plain', for the Redevelopment Area, dated October 2005, entitled "West Carteret Commercial Redevelopment Plan, "; and WHEREAS, on November 30, 2005, the Planning Board adopted a resolution of findings and conclusions endorsing and recommending final adoption of the Redevelopment Plan; and WHEREAS, on December 15, 2005, the Borough Council, pursuant to Section 7 of the Redevelopment Law (N J.S.A. 40A:12A -7) and based on the recommendation of the Planning Board, adopted ordinance number 05 -63 approving and adopting the Redevelopment Plan; and WHEREAS, on November 29, 2007, Borough Council, acting in its capacity as a Redevelopment Entity for the Borough, adopted resolution number 07 -290 designating Carteret Gateway, LLC as the redeveloper for a portion of the Redevelopment Area; and NO. 07 -304 PAGE 2of2 1 WHEREAS, the Borough desires to direct the Planning Board to prepare one or more amendments to the Redevelopment Plan to allow for: (i) drive -thin restaurants, drive -thru pharmacies and drive -thin banks as a permitted use(s) thereunder, (ii) one gasoline filling station, but only when combined with a convenience store, as a permitted use thereunder, (iii) non - residential uses with over four thousand (4,000) square feet of gross floor area. NOW, THEREFORE, BE IT RESOLVED as follows: Section 1. The Planning Board is hereby authorized and directed to prepare one or more amendments to the Redevelopment Plan to allow for: (i) drive -thin restaurants, drive -thm pharmacies and drive -thra banks as a permitted use(s) thereunder, (u) one gasoline filling station, but only when combined with a convenience store, as a permitted use thereunder, (iii) non - residential uses with over four thousand (4,000) square feet of gross floor area (the "Amendments "). Section 2. The Planning Board is hereby authorized to utilize the services of Beacon Planning and Consulting Services, LLC, as previously authorized, to assist the Planning Board with the preparation of the Amendments to the Redevelopment Plan. Section 3. The Planning Board, upon completion of the Amendments to the Redevelopment Plan, shall transmit the amended Redevelopment Plan to the Borough Council for its adoption. Section 4. The Borough Clerk is hereby authorized and d to forward this Resolution to the Planning Board for action consistent herewith. Section 5. This resolution shall take effect at the time and in the manner prescribed by law. Section 6. Upon the adoption hereof, the Borough Clerk shall forward certified copies of this resolution to Matthew C. Karrenberg, Esq., DeCotiis, Fitzpatrick, Cole & Wisley LLP, Special Redevelopment Counsel to the Borough.
