RESOLUTION OF THE BOROUGH OF CARTERET, IN THE
COUNTY OF MIDDLESEX, NEW JERSEY AMENDING
RESOLUTION NO. 10 -57
WHEREAS, the New Jersey Local Redevelopment and Housing Law, N.J.S.A.
40A:12A -1 et seq. (the "Redevelopment Law ") authorizes municipalities to determine
whether certain parcels of land located therein constitute areas in need of redevelopment;
and
WHEREAS, the Borough Council (the "Borough Council ") of the Borough of Carteret,
in the County of Middlesex, New Jersey (the "Borough ") authorized and directed the
Planning Board of the Borough (the "Planning Board ") to conduct a preliminary
investigation to determine whether the property designated as Block 1, Lot 2.13 on the
Borough's tax map, located at 760 Port Carteret Drive (the "Study Area "), meets the
criteria set forth in N.J.S.A. 40A:12A -5 and should be designated as an area in need of
redevelopment; and
WHEREAS, the Planning Board caused Beacon Planning and Consulting Services, LLC
(the "Planting Consultant ") to conduct a preliminary investigation to determine whether
the Study Area should be designated as an area in need of redevelopment; and
WHEREAS, by Resolution No. 10 -57, duly adopted by the Borough Council on
February 4, 2010, the Borough Council determined that it would follow the previous
recommendation by the Planning Board and designated the Study Area an area in need of
redevelopment based on the criteria for redevelopment area designation set forth in
N.J.S.A. 40A:12A -5c, 5g and 5h; and
WHEREAS, the Borough Council desires to amend Resolution 10 -57 as provide for
herein.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret, County of Middlesex, State of New Jersey, as follows:
Section 1. The aforementioned recitals are incorporated herein as
though filly set forth at length.
Section 2. Resolution No. 10 -57, adopted on February 4, 2010, is
hereby amended, to provide that the property designated as Block 1, Lot
2.13 on the Borough's tax map, known as 760 Port Carteret Drive, satisfies
the criterion for redevelopment area designation set forth in N.J.S.A.
40A:12A -5g and such property is hereby designated as an area in need of
redevelopment (the "Redevelopment Area ") based on such criterion only.
Section 3. The Platting Board is hereby authorized to cause a
redevelopment plan to be prepared for the Redevelopment Area, consistent
herewith, and present same to the Borough Council pursuant to N.J.S.A.
40A: 12A-7f.

Section 4. The Borough Clerk is hereby directed to immediately
forward a copy of this resolution, upon its adoption, to: McManimon &
Scotland, L.L.C, Attn: Kevin P. McManimon, Esq., 1037 Raymond
Boulevard, Suite 400, Newark, New Jersey 07102 for any required service
thereof.
Section 5. This resolution shall take effect immediately.
