HomeMy Public PortalAbout04-20-2009PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, APRIL 20, 2009 The Common Council of the City of Richmond, Indiana met in regular session Monday, April 20, 2009 in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR ELSTRO President Wissel presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. APPROVAL OF MINUTES Councilor Parker moved to approve the minutes of the meeting of April 6, 2009, supported by Councilor Miller. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS None COMMUNICATION FROM THE MAYOR • Spring Clean Up began April 18 — 225 lunches were served to workers • Lemonade Day is May 3 • The Sanitary District has received a $1.3 million grant and access to a $2 million low interest loan for their projects • There will be 330 jobs lost with the closing of Cinram REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the April 2 & 9, 2009 meetings were accepted as presented. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS • Fire Chief, Mike Crawley reported on the savings resulting from closing Fire House No. 6. Response times are shorter than predicted with the consolidation. The Insurance Services Office will be finalizing their report soon. Chief Crawley will update Council with the findings as soon as they are available. • Ron Church, Director of Human Rights, summarized the annual report for his agency. This report reflects the monthly activity in regards to the Pre - Intake Investigations and complaints that moved forward to the Formal Investigation stage. Common Council Minutes April 20, 2009 Page 2 of 5 • The Urban Enterprise Association submitted the names of Board members wishing to be reappointed by Common Council: Zone Business Representative Joe Chamness -First Bank Richmond and Zone Residents: Jimm Grimm & Etta Lundy. Additional nominations will be accepted until the May 4 meeting. • Vicki Robinson, Director of Purchasing, presented Contract No. 60 -2009 for consideration. This contract is with Ameresco, Inc. as the Guaranteed Energy Savings contractor for the energy project for the municipal building and Fire Station No. 1. The proposal for funding of this project will be presented May 4, 2009. MISCELLANEOUS BUSINESS ■ Councilor Welch distributed copies of a newspaper article regarding a sewer being cleaned which was over half clogged with debris and dirt at a cost of $75,000. Mr. Welch submitted a list of questions regarding sewer problems to Sam Lahanis, Director of the Sanitary District. Mr. Lahanis will take them under advisement to be addressed at a future meeting. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 13, 15, 16, 17, 18 & 19 -2009 on first reading by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed. ORDINANCE NO. 13 -2009 — AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE AND APPROPRIATION OF A GRANT FROM THE PARTNERSHIP FOR A DRUG FREE WAYNE COUNTY The Clerk read Ordinance No. 13 -2009 on first reading by title only. Presented by Police Chief, Kris Wolski, this Ordinance would authorize the City of Richmond Police Department to submit a grant application to the Partnership for a Drug Free Wayne County and to accept grant funding in an amount up to Seven Thousand Dollars and Zero Cents ($7,000.00). If awarded, said funds shall be appropriated for K -9 equipment, training for handler and K -9 and to purchase educational materials to be handed out at public presentations on the use of K -9's. Councilor Welch moved to advance Ordinance No. 13 -2009 to second reading and to suspend the rules and read by title only, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 13 -2009 on second reading by title only. Council President Wissel declared Ordinance No. 13 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Pappin moved for engrossment of Ordinance No. 13 -2009, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 13 -2009 to third and final reading and suspend the rules and read by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 13 -2009 on third reading by title only. Ordinance No. 13 -2009 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 15 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM INDIANA DEPARTMENT OF HOMELAND SECURITY The Clerk read Ordinance No. 15 -2009 on first reading by title only Common Council Minutes April 20, 2009 Page 3 of 5 Presented by Fire Chief, Mike Crawley, this Ordinance would authorize the City of Richmond Fire Department to submit a grant application to the Indiana Department of Homeland Security and to accept grant funding in an amount up to Ten Thousand Five Hundred sixty -seven Dollars and Zero Cents ($10,657.00). If awarded, said funds shall be appropriated for Hazmat equipment. Councilor Welch moved to advance Ordinance No. 15 -2009 to second reading and to suspend the rules and read by title only, supported by Councilor Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 15 -2009 on second reading by title only. Council President Wissel declared Ordinance No. 15 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 15 -2009, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No. 15 -2009 to third and final reading and suspend the rules and read by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 15 -2009 on third reading by title only. Ordinance No. 15 -2009 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 16 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE U.S. DEPARTMENT OF JUSTICE, BUREAU OF JUSTICE ASSISTANCE The Clerk read Ordinance No. 16 -2009 on first reading by title only. Presented by Chief Wolski, this Ordinance would authorize the City of Richmond Police Department to submit a grant application to the U.S. Department of Justice, Bureau of Justice Assistance and to accept grant funding in an amount up to Sixty Five Thousand Dollars and Zero Cents ($65,000.00). If awarded, said funds shall be appropriated for funding of technology and educational programs. Councilor Welch moved to advance Ordinance No. 16 -2009 to second reading and to suspend the rules and read by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 16 -2009 on second reading by title only. Council President Wissel declared Ordinance No. 16 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 16 -2009, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 16 -2009 to third and final reading and suspend the rules and read by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 16 -2009 on third reading by title only. Ordinance No. 16 -2009 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 17 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE INDIANA DEPARTMENT OF TRANSPORTATION The Clerk read Ordinance No. 17 -2009 on first reading by title only Common Council Minutes April 20, 2009 Page 4 of 5 Presented by Tony Foster, Director of Metropolitan Development, this Ordinance would authorize the Roseview Transit to submit a grant application to the Indiana Department of Transportation and to accept grant funding in an amount up to One Million One Hundred Sixty -four Thousand One Hundred Dollars and Zero Cents ($1,164,100.00). If awarded, said funds shall be appropriated to assist with transportation infrastructure projects. Councilor Welch moved to advance Ordinance No. 17 -2009 to second reading and to suspend the rules and read by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 17 -2009 on second reading by title only. Council President Wissel declared Ordinance No. 17 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 17 -2009, supported by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Parker moved to advance Ordinance No. 17 -2009 to third and final reading and suspend the rules and read by title only, supported by Councilor Pappin. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 17 -2009 on third reading by title only. Ordinance No. 17 -2009 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 18 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE APPROPRIATION OF DONATIONS FROM INDIVIDUALS FOR THE JUNE 2009 ALL AMERICAN CITY CONFERENCE The Clerk read Ordinance No. 18 -2009 on first reading by title only. Presented by Mayor Hutton, this Ordinance would authorize the Mayor to obtain and receive donations from individuals in an amount not to exceed Thirty Five Thousand Dollars and Zero Cents ($35,000.00). Said funds would cover the costs allowing students in the community to attend the All American City Conference in Tampa, Florida, in June 2009, as well as hotel reimbursement, travel expenses and per diem. The Mayor asked Council to amend the proposed Ordinance to reflect the necessary $35,000. Councilor Welch moved to amend Ordinance No. 18 -2009 as recommended by Mayor Hutton, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Welch moved to advance Ordinance No. 18 -2009 as amended to second reading and to suspend the rules and read by title only, supported by Councilor Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 18 -2009 as amended on second reading by title only. Council President Wissel declared Ordinance No. 18 -2009 as amended on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Cruse - Nicholson moved for engrossment of Ordinance No. 18 -2009, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. Councilor Cruse - Nicholson moved to advance Ordinance No. 18 -2009 as amended to third and final reading and suspend the rules and read by title only, supported by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 18 -2009 as amended on third reading by title only. Ordinance No. 18 -2009 as amended was adopted with a 9 -0 roll call vote. Common Council Minutes April 20, 2009 Page 5 of 5 ORDINANCE NO. 19 -2009 - AN APPROPRIATION ORDINANCE AUTHORIZING THE SUBMITTAL, ACCEPTANCE, AND APPROPRIATION OF A GRANT FROM THE U.S. DEPARTMENT OF JUSTICE The Clerk read Ordinance No. 19 -2009 on first reading by title only. Presented by Chief Wolski, this Ordinance would authorize the City of Richmond Police Department to submit a grant application to the U.S. Department of Justice and to accept grant funding in an amount up to Four Hundred Thousand Dollars and Zero Cents ($400,000.00). If awarded, said funds shall be appropriated to assist with expenses of construction of classrooms at the Police Training Facility. Chief Wolski asked Council to strike this Ordinance due to the fact the request does not meet the criteria set forth in the grant guidelines. Councilor Parker moved to strike Ordinance No. 19 -2009, supported by Councilor Miller. Upon a vote viva voce, the motion passed.
