HomeMy Public PortalAbout1991-07-24 Special Meeting��D COUNCIL MINUTES SPECIAL MEETING - JULY 24, 1991 A Special Meeting of the Bal Harbour Village Council was held on Wednesday, July 24, 1991 in the Bal Harbour Village Hall Council Chambers. The meeting was called to order at 5:05 p.m. by Mayor Estelle Stern and the roll was called. Those present were: Mayor Estelle Stern Assistant Mayor Andrew R. Hirschl Councilman Matthew B. Blank Councilman James E. Boggess Absent: Councilman Sol M. Taplin Also present: Richard J. Weiss, Village Attorney Carole S. Morris, Village Manager Jeanette Horton, Village Clerk 2. Sheraton Bal Harbour Noise Complaint: Mr. Hamel, General Manager of the Sheraton Bal Harbour, introduced the gentlemen accompanying him today. Mr. Milbreath, Construction Manager of the Sheraton Bal Harbour, Mr. Ken Batchelor of McDevitt & Street Company, Mr. Steve Morrill, Vice President of Operations. Mrs. Morris briefly summarized the circumstances surrounding the Sheraton renovation and noise complaints. The Sheraton is undergoing major renovations and prior to the start of construction discussed with the contractor the working regulations in Bal Harbour. It was explained that the concern was about large vehicles getting in and out of the construction site. Also discussed were complaints relative to noise, and at that time a permit was issued allowing interior renovations only on a 24-hour seven days a week basis. The contractor was cautioned that exterior work was restricted to regular working hours. Mrs. Morris further explained that when the Building Department started to receive complaints she again met with Mr. Batchelor, Job Superintendent, and with Mr. Hamel and advised them both that the Village was receiving complaints, and that the Village was anxious to cooperate, but that permission would be withdrawn if the complaints continued. After July 16th , following direction given by the Council, the Sheraton was notified that they would be expected to adhere to the noise regulations as outlined in the Bal Harbour Village Code. On July 18th, Mrs. Morris stated that along with Assistant Chief Cardeno, Chief Treppeda and George Desharnais, she met with Mr. Batchelor and Mr. Milbreath to reiterate the restrictions in the Code relative to noise regulations and provide them with copies of 07/24/91 Special Council Mtg. 1 10 that portion of the Code. Mrs. Morris stated she wrote a letter to Mr. Jim Ayres, Balmoral Condominium Security, and advised him to encourage residents to make a formal complaint with the Police Department during the actual occurrence in order to resolve this situation. Councilman Blank requested that Mr. Hamel of the Sheraton Bal Harbour speak first. Mr. Hamel stated he was sorry the noise happened and understood the position of the neighbors. There will be a certain amount of noise connected with the construction and believes if the noise is such that it awakens someone from their sleep, then it is wrong and again Mr. Hamel apologized. Mr. Hamel then explained the cost of renovation will be over 22 millon dollars. When completed, they hope to attract visitors from around the world. Present guests are from Italy, France, Germany, Spain, Japan and many Latin Americans. The project is expected to be finished about the 15th of December, but with the present restrictions, the project will not be completed and possibly the project may have to be canceled. Mr. Hamel then went on to explain that in the construction business you can only put so many people to work doing one thing at a certain time. Therefore, if unable to have a better span of time, it will take longer to complete. Mr. Hamel requested that if possible they be allowed to work until sunset. Councilman Blank stated he has no objection to the renovation of the hotel and commended the hotel for investing $22 millon on renovation in the last newsletter. He questioned Mr. Hamel if the outside construction workers could work between the hours of 8:30 a.m. and 5:30 p.m. and then work indoors on a 24-hour basis. Mayor Stern said there should be no noise if just painting and papering, if the worker does not have a radio and recommended hours of work 8:00 a.m. to 8 p.m. Mr. Hamel stated this would help and the disturbing noise would be scheduled for the hours defined by the Code. Mrs. Schoen of the Balmoral stated her windows are closed tight, but the noise is very disturbing when debris is dumped at 7:00 a.m. in the morning. Mrs. Goss of the Balmoral stated she spoke to the Sheraton Security, but finally called Bal Harbour Police. Once the Police left, the noise continued. She also reported there is a pool of green water on top of the metal shed which should be looked into. Mayor Stern explained that Mr. Burke, of the Singapore, was unable to attend. He stated that he was not greatly inconvenienced and 07/24/91 Special Council Mtg. 2 would like to see the job come in on target. Councilman Boggess stated he was concerned that this matter had reached this point. Mr. Hamel should look to the contractor for better supervision of his sub -contractors and employees. Extensive discussion followed as to hours and what would constitute a serious complaint. Mrs. Morris replied how she would evaluate, and if she felt it necessary, would revoke the work order and refer the matter to Council. The consensus of the Council was that effective immediately, the permitted working hours for the Sheraton Bal Harbour would be: Exterior Work - including, but not limited to, loading/unloading, deliveries, disposal of debris: 8:30 a.m. - 8:30 p.m. daylight savings time; when daylight saving time expires, hours will become 8:30 a.m. to 7:30 p.m.- Monday through Saturday. No exterior work on Sunday and Holidays as defined in the Village Code. Interior Work - work shall not be limited except when noise is audible from the exterior of the building. 3. Other Business: No other business was presented. 4. Adi ourn : There being no further business to come before the Council, a motion was offered by Councilman Boggess and seconded by Councilman Blank to adjourn.
