AN ORDINANCE OF THE CITY OF JEFFERSON,MISSOURI,AMENDING CHAPTER 35,ZONING
CODE TEXT; SPECIFICALLY EXHIBIT 35.28, LAND USE MATRIX, SECTION 1.A.8,
AUTHORIZING THE RESIDENTIAL USE IN A NON-RESIDENTIAL BUILDING ON THE SECOND
FLOOR OR ABOVE IN THE C-2 GENERAL COMMERCIAL DISTRICT
WHEREAS it appears that the procedures set forth in the zoning code relating to zoning have

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON,
MISSOURI, AS FOLLOWS:
Section 1. Article II, Exhibit 35-28.(Land Use Matrix) Specific Use Category/Type 1.A.8
Household Living, Residential Use in Non-Residential Building- Second Floor or Above is hereby
amended to permit residential use in a non-residential building on the second floor or above in the
C-2 zoning district:

Section 2, Amend Article II, Section 35.26. C (1) General Standards Applicable to All
Zoning Districts, Site Design and Improvement Standards, is hereby amended as follows with the
addition of the following "Note:"
Note: The C-2 General Commercial district is primarily intended to be a commercial
and retail zoning district Due to the nature of these uses and the attendant traffic and
noise,persons Inhabiting residential uses In non-residential buildings,as defined in
Article IX,should not expect to find the quiet and low level of ambient noise normally
found In residential districts.

Text Amendment to Chapter 35,Zoning Code
The City Council of the City of Jefferson, Missouri, will hold a public hearing on Monday,
May 16, 2005 at 6:00 p.m. in the Council Chamber of the John G. Christy Municipal
Building, 320 East McCarty Street, to consider the following amendments to the text of
Chapter 35 of the Code (Zoning):
1. Article II, District Regulations, Exhibit 35.28 Land Use Matrix: Use Category and
Specific Use Section 1.A.B:Add "Residential Use in an Non-Residential Building -
Second Floor or Above" as a "P" Permitted Use in the C-2 General Commercial
Zoning District.
2. Article_II, District Regulations, Section 35-23.C.1. General Standards applicable
to all zoning districts: Add the following note to Paragraph 1. Purpose: "Note: The
C-2 General Commercial district is primarily Intended to be a commercial and retail
zoning district. Due to the nature of these uses and the attendant traffic and noise,
persons inhabiting residential uses in non-residential buildings,as defined in Article
IX, should not expect to find the quiet and low level of ambient noise normally found
In residential districts."
This amendment was heard by the Planning and Zoning Commission as Case No.
