AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A
CERTAIN EASEMENT FOR SANITARY SEWER PURPOSES ON LOT 54 OF DEER
PARK SUBDIVISION.
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS
FOLLOWS:
WHEREAS, by an easement recorded In Book 387, Page 227, and as corrected in Plat
Book 12, Page 273, of the Records of the Cole County, Missouri, a sewer easement was
granted to the City of Jefferson, a Municipal Corporation, to excavate within, install,
construct, maintain and repair structures for the routing and conveyance of sewer in, under
and through the lots, tracts or parcels of land described in Section 1;
Section 1. The Council finds that the following described easement is surplus
property of the City and is no longer needed for any public purpose:
• Part of the SANITARY SEWER EASEMENT as recorded in Book 387, Page
227, Cole County Recorder's Office, being across a part of Lot 54 of DEER
PARK SUBDIVISION, SECTION THREE, per plat of record in Plat Book 12,
page 265 and as corrected in Plat Book 12, page 273, Cole County
Recorder's Office, all being part of the Southwest Quarter of Section 31,
Township 45 North, Range 12 West,Cole County, Missouri, more particularly
described as follows:
From the northeasterly corner of said LOT 54; thence S83 047'42"W, along
the northerly line of said LOT 54, 24.43 feet; thence S1 2052'58"E, 86.21 feet
to the northwesterly line of said SANITARY SEWER EASEMENT as
recorded in Book 387, page 227 and the POINT OF BEGINNING for this
description;thence continuing S1 2052'58"E,2.74 feet;thence S77 006'41"W,
7.79 feet to the northwesterly line of said SANITARY SEWER EASEMENT;
thence N57 042'32"E,along the northwesterly line of said SANITARY SEWER
EASEMENT, 7.20 feet to the point of beginning.
Containing 10.69 Sq. Ft.
Section 2. The easement described In Section 1 is hereby relinquished, and the
City does hereby release and abandon whatever Interest it has in the easement.
Section 3. The Mayor and City Clerk are hereby authorized to execute any
• necessary legal document relinquishing all of the City's interest in the tract of ground
described in Section 1.
• Section 4. This Ordinance shall be in full force and effect from and after the date
of its passage and approval.
