HomeMy Public PortalAbout2014-025 Resolution Granting Approval of a Lot Combination to Frederick HartrayMember Pederson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION NO.2014-25 RESOLUTION GRANTING APPROVAL OF A LOT COMBINATION TO FREDERICK C. HARTRAY FOR PROPERTY AT 4035 APACHE DRIVE WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Frederick C. Hartray (the "Applicant') is the owner of certain property located at and adjacent to 4035 Apache Drive, which is legally described in Exhibit A, attached hereto (the "Properties"); and WHEREAS, the Applicant has requested approval from the City to combine the Properties into a single lot, which is proposed to be legally described as in Exhibit B, attached hereto; and WHEREAS, on April 15, 2014, the city council reviewed the proposed lot combination for conformance with City ordinances and heard comments from interested parties. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA, that approval be granted to the Applicant for the proposed lot combination to be legally described as in Exhibit B, attached hereto, subject to the following terms and conditions: (1) The Applicant shall grant to the City right-of-way over the eastern 33-feet of the Properties for Apache Drive and shall also grant to the City 33-feet of right-of-way each side of the centerline of Pioneer Trail. (3) The Applicant shall meet the requirements of the City Attorney with regards to title documentation and procedures for recording documents with Hennepin County; (4) The Applicant shall record necessary documents with Hennepin County in order to effectuate the lot combination within 180 days or this approval shall be considered void, unless a written request for time extension is submitted by the Applicant and approved by the City Council; and (5) The Applicant shall pay to the City a fee in an amount sufficient to reimburse the City for the cost of reviewing the lot combination and reviewing and preparing related documents.
