HomeMy Public PortalAbout2014-031 Resolution Granting Final Plat Approval for Hamel HavenMember Pederson introduced the following resolution and moved its adoption: • CITY OF MEDINA RESOLUTION 2014-31 RESOLUTION GRANTING FINAL PLAT APPROVAL FOR HAMEL HAVEN WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, JJC Hamel LLC (the "Applicant"), is the fee owner of land within the City at 805 Hamel Road (the "Property") which is legally described as: That part of the East 200 feet of the East half of the Southeast Quarter of Section 11, Township 118, Range 23, lying Southerly of the Rockford Road and Northerly of a line drawn parallel to and distant 183 feet Southerly of and measured at right angles from the center line of the Rockford Road. WHEREAS, on January 27, 2012 the City granted preliminary plat approval to the Applicant to allow the future platting of property into two parcels; and WHEREAS, the Applicant has now requested final approval of the Hamel Haven plat; and WHEREAS, the City Council reviewed the final plat at the May 6, 2014 meeting; and WHEREAS, the City Council has found that, subject to the terms and conditions contained herein, the plat is substantially consistent with the approved preliminary plat and the requirements of the City's subdivision regulations. NOW, THEREFORE BE IT RESOLVED, by the City Council of Medina, Minnesota that final approval is hereby granted for the plat of Hamel Haven, subject to the following terms and conditions: 1. The Applicant shall enter into a development agreement as drafted by the City which shall include the requirements described below as well as other relevant requirements of City ordinance or policy. 2. The Applicant shall provide the City a letter of credit as required by City ordinances to ensure completion of the required subdivision improvements. 3. The Applicant shall install the improvements and landscaping within and adjacent to the Property as shown on the plans received by the City on March 31, 2014. The design, specifications, and construction shall meet the requirements of the City Engineer. Resolution No. 2014-31 May 6, 2014 4. The Applicant shall provide a tree preservation plan. If the Applicant updates the grading plan and tree preservation plans to verify that the 28" oak can be preserved, such plan shall accommodate 29 inches of replacement trees. If this cannot be verified, the Applicant present a tree replacement plan for 57 inches of replacement trees. 5. The Applicant shall pay a park dedication fee of $4,160 in -lieu of parkland dedication. 6. All comments by the City Attorney related to title issues and recording procedures shall be followed. 7. The Applicant shall obtain necessary approvals and permits from the Elm Creek Watershed, Hennepin County, and other relevant agencies. 8. This final plat shall be recorded within 120 days of the date of this resolution or this approval shall be considered void, unless a written request for a time extension is submitted by the Applicant within said 120 days and approved by the City Council for good cause. 9. All fees incurred by the City regarding the processing and review of this application shall be paid by the Applicant, including the drafting and review of relevant agreements documents, and plans.
