Present Chairman: Charles Bechtold;Vice-Chairman: Andrea Reed; Clerk: Thomas Johnson. Regular Member: Steve Bomemeier. Associates: William Mone and Richard Hartmann. Planning Department Staff: George Meservey; and Secretary: Karen Sharpless. Also Present: Board of Selectmen Liaison: Jon Fuller(Board of Selectmen). Absent: Regular Member: Chet Crabtree Chairman Bechtold asked Richard Hartmann to vote in the absence of Chet Crabtree. 7:00 P.M.-PUBLIC HEARING-ELIZABETH ARGO.7 ARENA DRIVE The public hearing was opened by Chairman Bechtold and the Clerk read the legal ad into the record. Elizabeth Argo described past conditions she requested be put on the property at 7 Arena Drive which prohibit further subdivision in 1995,and stated that now she is requesting that the conditions be lifted from the property. Meservey described the complex background of this subdivision and Planning Board members reviewed the conditions placed on the Definitive Subdivision in 1995. Planning Board members discussed steep shared access to 7 Arena Drive using an easement over the driveway to the Academy of Performing Arts building. PUBLIC COMMENTS: Greg DeLory(for the Academy of Performing Arts)stated there are concerns with expensive road maintenance,and would like an agreement to help maintain the road year round. MOTION TO APPROVE: MOTION: On a motion by Steve Bornemeier,seconded by Richard Hartmann,the Board voted to approve the Modification to the approval conditions of a Definitive Subdivision Plan,prepared for Elizabeth B.Argo,revised August 28, 1995,by deleting condition#1.(b),which"prohibits further residential development of the property,"the Covenant dated September 15, 1995 and recorded at the Barnstable County Registry of Deeds,Book 9859,Page 146,be released. MOTION TO CLOSE PUBLIC NEARING MOTION: On a motion by Andrea Reed,seconded by Steve Bornemeier,the Board voted to close the public hearing for Elizabeth Argo for property located at 7 Arena Drive. VOTE: 5-0-0 The motion passed unanimously. PUBLIC HEARING-AMEND ZONING BYLAW TO ADD CHAPTER 16436.1, MOBILE FOOD ESTABLISHMENTS Planning Board members discussed a proposal to add Chapter 164-36.1,Mobile Food Establishments to the Orleans Zoning Bylaws dependent on a vote at the October 2017 Special Town Meeting. Concerns were expressed that the proposed chapter might conflict with an existing bylaw regarding trailers. Meservey agreed to forward the proposed bylaw to Town Counsel for review before forwarding it to the Board of Selectmen with a recommendation to include it on the Special Town Meeting warrant. MOTION TO CALL THE QUESTION: MOTION: A motion was made by Steve Bornemeier,seconded by Richard Hartmann,to call the question. VOTE: 5-0-0 The motion passed unanimously. MOTION TO FORWARD BYLAW: MOTION: On a motion by Andrea Reed,seconded by Steve Bornemeier,the Board voted to forward the zoning amendment to the Board of Selectmen for inclusion on the warrant for the Special Town Meeting on October 16,2017,pending review by Town Counsel regarding a possible conflict with the definition of trailers. VOTE: 5-0-0 The motion passed unanimously. MOTION TO CLOSE PUBLIC HEARING MOTION: On a motion by Andrea Reed,seconded by Thomas Johnson,the Board voted to close the public hearing to amend the Zoning Bylaws to add Chapter 164-36.1,Mobile Food Establishments. VOTE: 5-0-0 The motion passed unanimously. ARCHITECTURAL REVIEW COMMITTEE Planning Board members discussed with members of the Architectural Review Committee existing and future bylaws that would be helpful to them as they review upcoming applications. Joy Cuming stated they learned a lot going through the recent process with CVS and felt the bylaws supported their decisions. Cuming noted that education for new committee members is essential to the committee's success. Cuming reiterated concerns regarding conflicts with the Site Plan Review Committee guidelines and suggested that Planning Board Minutes-August 22,2017 Page 2 of 6 All information discussed at Planning Hoard meetings is kept on file in the Planning Department. • the committees should coordinate their responses to avoid confusion. Cuming agreed that there may be a need for future bylaws to help them be able to guide projects in a manner that works best for the town. PLANNING BOARD REORGANIZATION Planning Board Chairman NOMINATION: Andrea Reed nominated Charles Bechtold for Planning Board Chairman for FY`18. There were no other nominations. VOTE: 5-0-0 The motion passed unanimously. MOTION TO CLOSE NOMINATIONS MOTION: On a motion by Steve Bornemeier,seconded by Thomas Johnson,the Board voted to close nominations for Planning Board Chairman. VOTE: 5-0-0 The motion passed unanimously. Planning Board Vice Chairman MOTION: On a motion by Charles Bechtold,seconded by Thomas Johnson,Planning Board member Andrea Reed was nominated for Planning Board Vice Chairman for FY `18. There were no other nominations. VOTE: 5-0-0 The motion passed unanimously. MOTION TO CLOSE NOMINATIONS MOTION: On a motion by Charles Bechtold, seconded by Thomas Johnson,the Board voted to close nominations for Planning Board Vice Chairman. VOTE: 5-0-0 The motion passed unanimously. Planning Board Clerk MOTION: On a motion by Andrea Reed,seconded by Charles Bechtold,Planning Board member Thomas Johnson was nominated for Planning Board Clerk for FY `18. There were no other nominations. VOTE: 4-0-1 The motion passed unanimously. COMMITTEE APPOINTMENTS Planning Board Representatives to Zoning Bylaw Task Force MOTION: On a motion by Thomas Johnson,seconded by Steve Bornemeier,Planning Board members Charles Bechtold and Andrea Reed were nominated as the Planning Board representatives to the Zoning Bylaw Task Force for FY `18. There were no other nominations. VOTE: 5-0-0 The motion passed unanimously. MOTION TO CLOSE NOMINATIONS MOTION: On a motion by Richard Hartmann, seconded by Thomas Johnson,the Board voted to close nominations for Planning Board representatives to the Zoning Bylaw Task Force. VOTE: 5-0-0 The motion passed unanimously. Planning Board Representative to Community Preservation Committee MOTION: On a motion by Richard Hartmann,seconded by Thomas Johnson,Planning Board member William Mone was nominated as the Planning Board representative to the CPC for FY `18. There were no other nominations. VOTE: 5-0-0 The motion passed unanimously. MOTION TO CLOSE NOMINATIONS MOTION: On a motion by Richard Hartmann,seconded by Thomas Johnson,the Board voted to close nominations for Planning Board Representative to the Community Preservation Committee. VOTE: 5-0-0 The motion passed unanimously. SIGNATURE AUTHORIZATION Meservey reminded Planning Board members that after their annual reorganization, letters must be sent to the Boston Land Court and Barnstable County Registry of Deeds authorizing the Planning Board Chairman to sign Approval Not Required Plans,Definitive Plans,Application Approval Forms,all forms related to Surety,and all Full and Partial Releases of Covenants on behalf of the Planning Board. BOSTON LAND COURT MOTION: On a motion by Andrea Reed, seconded by Thomas Johnson,the Board voted to send a letter to the Boston Land Court authorizing the Planning Board Chairman to sign Approval Not Required Plans,Definitive Plans,Application Approval Forms,all forms related to Surety,and all Full and Partial Releases of Covenants on behalf of the Planning Board. VOTE: 5-0-0 The motion passed unanimously. COMMITTEE REPORTS Community Preservation Committee(William Mone) Mone reported that a special meeting of the Community Preservation Committee was held at the request of the Historical Society regarding proposed projects. P3 Wastewater Working Group(Richard Hartmann) Hartmann reported that a meeting was held on April 4,2017,but there seemed to be a lack of business community interest. CORRESPONDENCE • Zoning Board of Appeals Public Hearing Notices: September 6, 2017 PLANNER UPDATE Meservey updated Planning Board members on the following items: • A Main Street redesign meeting—may be possible to apply for a Massworks grant from the State. • The Site Plan Review Committee reviewed applications for a relocation of Liams at Nauset Beach and a rebuilding of the administration/restroom building at Skaket Beach. • The Housing Needs Study will shortly be available for review by the Planning Board. o On a related note,Thomas Johnson invited Planning Board members to attend workshops to be held by the Cape Housing Institute this fall for town officials to attend.
