Taylor County Administrator Robert Weisman July 1, 2011 TO: ALL LMS Members RE: UPDATING LMS PRIORITIZED PROJECT LIST (PPL) LMS Representative: The Palm Beach County Unified Local Mitigation Strategy (LMS) Steering Committee has approved an update to the submission and scoring process for its Project Prioritization List (PPL). The PPL contains a variety of proposed and planned projects that address identified local hazards, vulnerabilities, and mitigation strategies. The PPL is ever changing as projects are completed through self funding, with grant assistance, are not implemented, or new projects are added. The current PPL will remain in effect until September 21. As we transition to this new scoring and submission process we request that you update projects currently on the PPL by September 1 a. For convenience the 2009 PPL has been attached. Please identify if your jurisdiction's projects have been completed through self -funding or are no longer necessary. Updates may be emailed to jspearo®pbcgov.org. Those that remain will be consolidated into a revised PPL. In addition to updating projects we are also requesting that new projects be submitted for consideration. These projects should address a comprehensive range of mitigation actions in order to reduce the effects of hazards. The new Project & Initiative Submission Form has a number of categories for projects including; Shuttering and Wind Prqofing, Flood Control, Public Education, Homeland Security Initiatives, and Maintenance and Improvement. Other mitigation projects such as Beach' and Dune Restoration, Tree Trimming, Prescribed Burns, and Land Acquisition are also encouraged. These projects fall under the category of "Other". The new electronic Project & Initiative Submission Form can be found at pbcdem.org. This streamlined submission and scoring process will help to improve Palin Beach County's ability to apply for and secure funding for mitigation initiatives For all its members. All projects must be submitted electronically. No faxes or regular mail will be accepted. A fillable form can be found on Palm Beach County's Division of Emergency Management (DEM) Website; www.pbcdem.org, requested from the municipal LMS Representative, or from the DEM LMS Coordinator at (561) 712-6481. Only submit your project through this new Tillable format. 2. Put the Date of submission, Name of your municipality, department or organization, Primary Contact for the project along with their Phone Number and Email Address, Title of the Project, and the Estimated Cost. 3. Please use 11 -point Times New Roman font. Do not use bold, underline, or italics as emphasis. Please do not use headers or footers in your document or any other means of changing the form. Do not list multiple projects on a submission forth, only one (1) project per form. Note: We encourage jurisdictions to submit a variety of projects to be ranked. 4. Several smaller projects may be better than one large one. For example, if you want to shutter several buildings on your property, try to make each building a separate project rather than make them all one. However, there may be exceptions to this. 5. Check the box that your project corresponds with. In other words if you wish to submit a project that involves dredging a canal in order to improve floodwater flow in the community then check - Flood Control/Reduction and Waterway Management. Or if you want to conduct a controlled/prescribed burn to mitigate the impact of wildfires, then check- Other. Once again, any questions please consult your community's LMS Representative or Palm Beach County Emergency Management's LMS Coordinator. 6. Submit a short narrative paragraph that identifies what the project is that you want to have completed and how it benefits the community. We ask that you also submit an approximate project cost such as: Estimated cost $100,000. A detailed write-up and budget for the actual application will be required once a funding source has been identified and becomes available for application. 7. Please keep your narratives concise. It is not necessary to include anything other than information about the project and its benefit to the community. Please omit your municipality/agency characteristics, size, need, etc. from the narrative. 8. Lastly, answer the 12 questions as directly as possible and PROVIDE APPROPRIATE DOCUMENTATION. New projects can be submitted continually throughout the year. The Evaluation Panel will, at a minimum, rank and update the PPL twice a year (January & July). The list of projects is ever changing as projects completed through self - funding or with grant assistance are dropped and new proposed and planned projects are added. Jurisdictions and other potential project sponsors, particularly those not having projects on the current list, are encouraged to submit projects. The expectation is that all potential applicants be represented on the PPL with projects that address identified local hazards, vulnerabilities, and mitigation strategies. As municipalities complete projects they will be encouraged to submit new ones. At any given time a few communities will not have listed projects. The appendix satisfies, in part, the following FEMA requirements: Requirement: §201.6(c)(3)(fii): [The mitigation strategy section shall include] an action plan describing how the actions identified in section (c)(3)(ii) will be prioritized, implemented, and administered by the local jurisdiction. Prioritization shall include a special emphasis on the extent to which benefits are maximized according to a cost benefit review of the proposed projects and their associated costs. Requirement §201.6(c)(3)(iv): For multi -jurisdictional plans, there must be identifiable action items specific to the jurisdiction requesting FEMA approval or credit of the plan. Requirement §201.6(c)(3)(ii): [The mitigation strategy shall include a] section that identifies and analyzes a comprehensive range of specific mitigation actions and projects being considered to reduce the effects of each hazard, with particular emphasis on new and existing buildings and infrastructure. Requirement: §201.6(c)(3)(ii): [The mitigation strategy] must also address the jurisdiction's participation in the National Flood Insurance Program (NFIP), and continued compliance with NFIP requirements, as appropriate. Other sections and appendices addressing these requirements include appendices F, G, and J and Section 3 and Section 5. About the Prioritized Project List (PPL Normally the PPL is updated twice a year... in the Spring and in the Fall. Projects are added, deleted, modified, scored, and ranked in accordance with the procedures described in Section 5. During the period 2004 to 2009, however, Palm Beach County experienced a number of weather events that resulted in four federal declarations and several SBA declarations. These events included three hurricanes, two tropical storms (one declared), and an extended drought. Logically, the mitigation project focus over this period was almost exclusively on developing and submitting HMGP-specific drainage improvement and wind retrofit projects. A total of 64 projects, valued at $37,532,416 were developed and coordinated through the LMS. Several dozen other projects were developed, but were withdrawn when they were deemed ineligible under HMGP guidelines. E-1 The process and criteria used to rank projects are described in detail in Section 5. The current criteria emphasize: "community benefit" (Does the project promise tangible benefits to the community?); "project benefit" (Does the project address critical elements of the community infrastructure?); "community exposure" (Does the project mitigate an identified hazard to which the community is particularly vulnerable?); "cost effectiveness" (Does the project meet or exceed the thresholds of benefit to cost ratios using accepted methodologies?); "community commitment" (Is the project consistent with or incorporated in other plans, including COMP plans, CEMPs?); "public support" (Is there demonstrated public support for the project?); and "project implementation considerations" (What further is required to accomplish implementation? The feasibility and benefits of ranking "like" projects rather than forcing a single list of highly dissimilar projects has been discussed by the LMS Evaluation Panel and will continue to be explored. In 2004 the PPL format and content were expanded and modified to include the following information: • Rank position number • Project control number • Project applicant/sponsor • Final score • Project description • Estimated project cost • Potential funding source(s) • Potential time frame for funding • Benefit -cost, technical feasibility, environmental status (as available) • Key referencing separate expanded narrative analyzing how the project will reduce the effects of future hazard events on new/existing buildings The above format will be reevaluated when plan enhancements are considered. Recognizing that many worthy projects that have benefits that are difficult to quantify are disadvantaged by the current FEMA benefit -cost methodologies, the LMS Steering Committee is also considering the feasibility of maintaining two prioritized project lists ... one for projects earmarked for assistance funding under the Pre Disaster Mitigation, Hazard Mitigation Grant Program, and Flood Mitigation Assistance programs, and one for projects that might qualify for funding assistance under alternative non- federal grant programs. Regardless of funding intentions, all project applicants are encouraged to calculate benefit -costs whether or not they meet FEMA's threshold for submission. The current procedure for prioritizing projects will be retained until any enhancements are fully developed, deemed acceptable under the rules of LMS by FEMA and the Florida Department of Community Affairs, and adopted by the LMS Steering Committee. Hazard Mitigation Grant Program Prioritization The reader will note that there are multiple prioritized project lists contained in this section. A lesson learned from recent hurricane events was that the overall Prioritized Project List contains many projects that could never be funded under the guidelines of E-2 federal mitigation assistance programs. In 2004 Palm Beach County received sizeable allocations of HMGP funds in response to losses suffered from Hurricanes Frances and Jeanne. Given HMGP's narrow preference for wind retrofit and drainage improvement projects, a special request for eligible project applications was initiated. In consultation with the Evaluation Panel and the Administrative Committee the decision was made to submit all submitted hardening and wind retrofit projects for State and FEMA consideration. A set of special criteria were developed and administered by the LMS Flood Mitigation Technical Advisory Committee for the prioritization of drainage improvement projects for submission to the State and FEMA. These included: LMS rank (if on the current list), cost -benefit ratios, risk to lives, size of population impacted, geographic area benefited, loss of function considerations, duration of impacts, frequency of flooding, cost of losses, relationship to other flood mitigation projects, technical feasibility, readiness to implement, cost as a percentage of the HMGP allocation. The intent was to get the optimum community benefit for the dollar. A similar process was followed in 2005 when the county was allocated HMGP funds in response to losses suffered from Hurricane Wilma. In late 2008 Palm Beach County received an HMGP allocation for losses from Tropical Storm Fay. The Steering Committee opted to follow the standard scoring and ranking procedure for the later wave of applications. The LMS, comprised of county, municipal and community partners, prepares and promotes local strategies and projects to reduce long-term risks to life and property from natural and manmade disasters. Resulting pre- and post -disaster mitigation strategies and projects are supported by a variety of state and federal programs and funding sources in accordance with the Disaster Mitigation Act of 2000. PURPOSE To develop a strategywhich will systematically guide the priorities of rebuilding after a disaster including a method for conflict resolution between participants, a list of pre- identified and prioritized mitigation programs, projects and initiatives, and a methodology to revise the prioritized list of mitigation programs, projects and initiatives. SECTION 2. GENERAL TERMS AND CONDITIONS A. Both the COUNTY and the CITY agree to be governed by this Agreement, as well as applicable State and Federal laws, rules and regulations. B. Modification of this Agreement may be requested by either party. Changes which are mutually agreed upon shall be valid only when reduced to writing, duly signed by each party and attached to the original Agreement. C. There is hereby created a committee to be known as the "Local Mitigation Strategy Evaluation Panel" responsible for developing the draft list of prioritized Local Mitigation Strategy projects. The Local Mitigation Strategy Evaluation Panel shall be governed by the Palm Beach County Local Mitigation Strategy as approved by the 2 Steering Committee on September 30, 1999, attached hereto as Exhibit A and incorporated herein by reference. WITNESSETH: WHEREAS: Section 163.01 of the Florida Statutes, known as the "Florida Interlocal Cooperation Act of 1969," authorizes local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner an pursuant to forms of governmental organization that will accord best with geographic, economic, population and other factors influencing the needs and development of local communities; and WHEREAS: Part I of Chapter 163 of the Florida Statutes permits public agencies as defined therein to enter into interlocal agreements with each other to exercise jointly any power, privilege, or authority which such agencies share in common and which each might exercise separately; and WHEREAS: the State of Florida Department of Community Affairs (the "Department') has entered into an agreement with Palm Beach County to develop a single, unified local mitigation strategy to pre -identify and prioritize hazard mitigation projects to become part of a Statewide Hazard Mitigation Strategy; and WHEREAS: the development of a single, unified local mitigation strategy requires the participation of local municipal governments within Palm Beach County; and WHEREAS: the TOWN and COUNTY agree that the COUNTY should assume full responsibility for the development of a single, unified local mitigation strategy, including those portions applicable to the TOWN. NOW, THEREFORE, in consideration of the mutual covenants, promises and representations herein, the parties hereto agree as follows: Page 1 of 6 SECTION I. PURPOSE A. The purpose of this Agreement is to develop a single, unified county -wide Local Mitigation Strategy (LMS) in partnership between the COUNTY, TOWNS, and the State of Florida, Department of Community Affairs. Participation of the TOWN is voluntary, and the TOWN has agreed to participate, but desires the COUNTY to conduct the efforts applicable to the TOWN which are required to develop a unified mitigation strategy. B. The COUNTY and TOWN agree to act in a spirit of mutual cooperation and good faith in the implementation of the Agreement and its Purpose. SECTION 2. GENERAL TERMS AND CONDITIONS A. This Agreement shall begin upon execution by both parties and shall end August 31, 1999, unless terminated earlier in accordance with Section 6 of this Agreement. B. The TOWN shall assist the COUNTY to perform its obligations by providing information and support in accordance with the Scope of Work, Attachment A of this Agreement, to the satisfaction of the COUNTY. C. Both the COUNTY and the TOWN agree to be governed by the contractual services agreement between the COUNTY and the State of Florida, Department of Community Affairs, copies of which are in possession of each party. In addition, the COUNTY and the TOWN agree to be governed by applicable State and Federal laws, rules and regulations. D. Modification of this Agreement may be requested by either party. Changes which are mutually agreed upon shall be valid only when reduced to writing, duly signed by each party and attached to the original Agreement. E. The COUNTY and the TOWN agree to resolve any conflicts that may arise from the development of the Local Mitigation Strategy by using the process included in the Intergovernmental Coordination Element of the respective Comprehensive Growth Management Plan, or other alternative as approved by the Local Mitigation Strategy Working Group. SECTION 3. RECORD KEEPING A. All records required of the TOWN and COUNTY shall be sufficient and complete to verify compliance with the requirements of this Agreement and the COUNTY'S agreement with the Department. B. The TOWN shall allow access to its records during normal business hours and upon reasonable advanced request of the COUNTY, its employees and agents. Page 2 of 6 SECTION 4. REPORTS A. The COUNTY will develop the reports required by its agreement with the Department and will include those portions applicable to the TOWN. B. The TOWN will provide information, review, and coordination as identified in Attachment A, Scope of Work. SECTION 5. DEFAULT, REMEDIES, TERMINATION A. If the State of Florida, Department of Community Affairs determines that funds are not available to continue to fund the Agreement between the COUNTY and the Department of Community Affairs, all obligations on the part of the COUNTY and TOWN shall terminate. B. This Agreement may be terminated with or without cause by either the TOWN or the COUNTY with thirty (30) days notice to other party. SECTION 6. NOTICE AND CONTACT A. All notices provided under or pursuant to the Agreement shall be in writing, delivered either by hand or by first class, certified mail, return receipt requested, to the representatives identified below at the address set forth below. FUNDING/CONSIDERATION As consideration for the COUNTY performing work on behalf of the TOWN, the TOWN waives its right to receive payment from the Department and hereby assigns its portion of the grant to the COUNTY, which is $7,500. The COUNTY agrees to allocate residual grant funds, if any, of the TOWN'S portion of the Department's grant after costs to the COUNTY'S consultant have been deducted back to the TOWN. ENTIRETY OF AGREEMENT The parties agree that this Agreement set forth the entire agreement between the parties, and there are no promises or understandings other than those stated herein. SECTION 9. INVALIDITY OF CLAUSES The validity of any portion, article, section, paragraph, provision, clause, or any portion thereof of the Agreement shall have no effect upon the validity of any other part or portion hereof. SECTION 10. VENUE To the extent allowed by law, the venue for any action arising from this Agreement shall be in Palm Beach County, Florida. SECTION 11. ATTORNEY'S FEES Any costs or expenses (including reasonable attorney's fees) associated with the enforcement of the terms and/or conditions of this Agreement shall be borne by the respective parties, however, this clause pertains only to the parties to this Agreement. Municipalities choosing to have the County assume full responsibility to conduct the "local mitigation strategy" program shall perform the following: 1. Designate the County as its representative to the "Local Mitigation Strategy" Working Group or designate a Municipal representative to the Working Group. The municipality may designate other representatives to participate in technical committees or task forces. 2. Cooperate with the County by allowing the County's representative access to, and replication of, all information required as identified below: A. Listing of municipal agencies and the mitigation function each provides; including a narrative of how the agencies help reduce losses from hazards. B. Listing of existing municipal policies, ordinances, and programs that affect mitigation. C. Listing of municipal facilities, public buildings, and hazardous material sites. D. Repetitive loss data for all structures within the Municipality. E. Historical flood data within the municipality. F. Listing of potential program, project, and policy initiatives within the municipality that have the potential to reduce losses of life and property from natural disaster events. 3. Assist the County's representative by: A. Reviewing for accuracy and completeness, all lists, reports, and recommendations regarding the Municipality. B. Prioritizing and ranking of all mitigation initiatives identified by the County's representative for the Municipality. C.
