MUNICIPAL SOLID WASTE TO A DESIGNATED FACILITY
THIS AGREEMENT, made and entered into this&3 clay of 44,ki- �aL by
and between the SOLID WASTE AUTHORITY OF PALM BEACH COUNTY, a
dependent special district created pursuant to Chapter 75-473, Laws of Florida, as
amended, hereinafter called "Authority", and the TOWN OF GULF STREAM, a
municipal corporation, chartered and organized in accordance with the laws of the State
of Florida, hereinafter called "Town", to establish a designated solid waste disposal
facility for the disposal of all municipal solid waste collected by or on behalf of the Town.
WITNESSETH:
WHEREAS, the Town provides for the collection of solid waste from the residents and
businesses within its boundaries; and
WHEREAS, the Town recognizes the need for safe and sanitary processing and
disposal of solid waste; and
WHEREAS, the Town wishes to participate in a coordinated County -wide program for
the management of hazardous waste and control of solid waste processing and
disposal in cooperation with federal, state, and local agencies responsible for the
prevention, control, or abatement of air, water, and land pollution; and
WHEREAS, the Town together with Palm Beach County recognizes the need to plan
and develop an adequate solid waste system for the benefit of all the residents of Palm
Beach County; and
WHEREAS, the Town recognizes the importance of the availability of environmentally
responsible solid waste disposal facilities; and
WHEREAS, the Town recognizes that the Authority's disposal system and
infrastructure was established, and said infrastructure is available, for the use and
betterment of all municipalities within Palm Beach County and the County, and;
WHEREAS, the Town recognizes the cost of existing disposal infrastructure has been
paid for with revenue bonds, and residents and businesses are presently paying tipping
fees and assessments to retire these bonds.
NOW, THEREFORE, in consideration of the mutual covenants and promises
hereinafter contained to be kept and performed by the parties hereto, and for the
mutual benefit of the Town, its constituents and the Authority, it is agreed as follows:

1. The Town agrees that all solid waste collected by or on behalf of the Town shall
be disposed at an Authority operated facility or Authority permitted facility, in
accordance with this Agreement.
2. Town agrees to cooperate with the Authority to provide all necessary and
required information to the Authority so that the Town and the Authority can
determine if the Town's solid waste is being delivered to the designated facility,
when such information is available.
3. The Authority agrees to maintain its disposal facility to ensure adequate capacity
for the Town's waste and to operate within all applicable local, state and federal
environmental guidelines.
. 4. The Authority agrees to defend any legal challenge to this interlocal agreement.
5. Compliance with Zoning Ordinances
Any transfer and/or disposal of solid waste shall be undertaken in a location
suitable and adequate for such activity and shall comply with all local zoning
ordinances and any other applicable local and state statutes, ordinances and
regulations.
6. Waste Disposal Requirements
All solid waste collected by or on behalf of the Town shall be disposed of at an
Authority operated or permitted facility in accordance with the criteria established
for acceptance of loads deemed suitable for processing at the designated
facilities, as set forth in Attachment A.
7. Term
This Agreement shall begin the date herein above and continue through
September 30, 2010. Notwithstanding termination, any rights or duties imposed
by law shall remain in effect.
8. This Agreement may be modified or terminated only by the mutual written
consent of both parties.
9. In the event any change in law abrogates or modifies any provisions or
applications of this Agreement, the parties hereto agree to enter into good faith
negotiations and use their best efforts to reach a mutually acceptable
modification of this Agreement.

10. All formal notices affecting the provisions of this Agreement shall be delivered in
person or be sent by registered or certified mail to the individual designated
below, until such time as either party furnishes the other party written instructions
to contact another individual.

11. If any clause, section, or provision of this Agreement shall be declared to be
unconstitutional, invalid or unenforceable for any cause or reason, or is
abrogated or negated by a change in law, the same shall be eliminated from this
Agreement, and the remaining portion of this Agreement shall be in full force and
effect and be valid as if such invalid portions thereof had not been incorporated
herein.

North County Regional Resource RecoLery Facility (NCRRRF)
• Otherwise known as the Waste to Energy Plant, this is where all garbage is taken.
• Staff remove tires, appliances, yard trash, scrap metals, propane tanks, auto batteries and other items
that would be harmful to burn.
• Ferrous (tin) is removed from other garbage and taken to the Ferrous Processing Facility
(located near the MRF) where it is prepared for shipment to recycling companies.
• The rest is shredded by a series of machines and burned under a controlled process.
• The heat is used to boil water which makes steam.
• The steam is used to make electricity.
• The electricity is used to power all of SWA's North Jog Road facilities. The rest is sold to
FPL. It is enough to power approximately 30,000 homes each year (327,000,000 kwh in 1993).
• Ash is left after the process. This ash is used as daily,cover on the landfill.
• For every 100 pounds of garbage. that is burned, only 10-20 pounds of ash results.
This saves landfill space.
• There are pollution control devices on the plant. The emissions are monitored constantly and are well
below Environmental Protection Agency standards.
• The plant is owned by SWA and operated by Babcock & Wilcox under a 20 year contract.
• The Office of Engineering is the SWA department responsible for the Waste to Energy Plant.
• There are two SWA staff at the plant (see below).
The rest of the employees work for Babcock & Wilcox.

Landfills

• The Class I is the garbage landfill.'
• Items that are disposed of in this landfill include: household garbage (items that rot), ash from the
Waste to Energy Plant, items'that would be harmful to burn at the Waste to Energy Plant,
dead animals and de -watered sludge.
• Approximately 40 acres are being used as of 4/93.
• SWA began using the landfill in 1989.
• It is expected to be filled by 2010.
• It is double -lined with thick plastic liners, sand and dirt.
• Ground water is tested on a regular basis to make sure debris is not getting into the water supply.
Class III
- The Class III is the trash landfill.
- Items that are disposed of in this landfill include construction and'demolition debris,
wood/lumber appliances, tires and furniture.
- SWA has used it since 1989.
• It is expected to be filled by 2002.
It is lined with thick plastic..
• Ground. water is tested on a regular basis to make sure debris is not getting into the water supply.
A waste reduction system is used to recycle tin, aluminum, plastic,. construction and demolition debris
and wood into small pieces. The pieces are then recycled, composted or sent to the
Waste to Energy Plant..
SWA has set a goal to recycle/reduce 30% of all trash that comes to the Class III Landfill.

center. Glass, plastics with a 1 or 2, newspaper/inserts, brown paper grocery bags, office paper and
corrugated cardboard are accepted. There is no charge for this drop-off service.
