BUDGET HEARING - SEPTEMBER 16, 1991
A Budget Hearing of the Bal Harbour Village Council was held
on Monday, September 16, 1991 in the Council Chamber at Bal Harbour
Village Hall. The meeting was called to order by Mayor Stern at
5:15 p.m. The roll was called and those present were:
Mayor Estelle Stern
Assistant Mayor Andrew R. Hirschl
Councilman Matthew B. Blank
Councilman James E. Boggess
Also present: Carole S. Morris, Village Manager
Jeanette Horton, Village Clerk
Stephen J. Helfman, Deputy Village Attorney
Absent: Councilman Sol Taplin
As a quorum was determined to be present, the meeting
commenced.
2. Discussion of Millage Rate - No increase over Rolled Back
Rate: Mayor Stern announced that the millage rate proposed is 0%
over the rolled -back millage rate. She then opened a Public
Hearing for discussion. Mrs. Morris advised that this is the third
consecutive year of no increase over the rolled -back millage rate.
There being no further discussion, Mayor Stern closed the Public
Hearing.
3. Discussion of Proposed Millage Rate: Mayor Stern
announced that the proposed millage rate for the coming fiscal year
is 3.369% and opened a Public Hearing for comments. There being
none, the Public Hearing was closed. A motion to adopt the millage
rate as proposed was offered by Councilman Boggess and seconded by
Councilman Blank. The motion carried unanimously (4-0), with
Councilman Taplin absent.
4. Discussion of Proposed Budgets: None.
5. Resolution - Adoption of Millage Rate: A Resolution
adopting the final millage rate was read, in full, by the Village
Clerk. A motion to adopt this Resolution was offered by Councilman
Blank and seconded by Councilman Boggess. The motion carried

unanimously (4-0), with Councilman Taplin absent, thus becoming

RESOLUTION OF BAL HARBOUR VILLAGE ADOPTING A
FINAL MILLAGE FATE FOR FISCAL YEAR 1991/92;
PROVIDING FOR AN EFFECTIVE DATE.
6. Ordinances/Public Hearings - Adoption of Proposed
Budgets:
A. General Fund: An Ordinance adopting the General Fund
Budget for F/Y 1991-92 was read, by title, by the Village Clerk.
Mayor Stern then opened a Public Hearing for discussion. There
being no discussion, Mayor Stern closed the Public Hearing. A
motion to enact this Ordinance was offered by Councilman Boggess
and seconded by Councilman Blank. The motion carried unanimously
(4-0), with Councilman Taplin absent, thus becoming

BUDGET FOR THE PERIOD OF OCTOBER 1, 1991 TO
SEPTEMBER 30, 1992 IN THE AMOUNT OF
$3,812,077, AUTHORIZING EXPENDITURES;
ESTABLISHING AN EFFECTIVE DATE.
B. Water Department: An Ordinance adopting the Water
Department Budget for F/Y 1991/92 was read, by title, by the
Village Clerk. Mayor Stern opened a Public Hearing for comments
and there being none, closed the Public Hearing. A motion to enact
this Ordinance was offered by Councilman Boggess and seconded by
Assistant Mayor Hirschl. The motion carried unanimously (4-0),
with Councilman Taplin absent, thus becoming

BUDGET FOR THE WATER DEPARTMENT FOR THE PERIOD
OF OCTOBER 1, 1991 TO SEPTEMBER 30, 1992 IN
THE AMOUNT OF $795,730; AUTHORIZING
EXPENDITURES; ESTABLISHING AN EFFECTIVE DATE.
C. Sanitary Sewer Department: An Ordinance adopting a
Budget for the Sanitary Sewer Department for F/Y 1991-92 was read,
by title, by the Village Clerk. Mayor Stern opened a Public
Hearing for comments and there being none, closed the Public
Hearing. A motion to enact this Ordinance was offered by
Councilman Boggess and seconded by Councilman Blank. The motion
carried unanimously (4-0), with Councilman Taplin absent, thus
becoming

This form is for use by any person serving at the county, city, or other local level of government on an appointed or elected board,
council, commission, authority, or committee. It applies equally Co members of advisory and non -advisory bodies who are presented
with a voting conflict of interest under Section 112.3143, Florida Statutes. The requirements of this law are mandatory; although
the use of this particular form is not required by law, you are encouraged to use it in making the disclosure required by law.
Your responsibilities under the law when faced with a measure in which you have a conflict of interest will vary greatly depending
on whether you hold an elective or appointive position. For this reason, please pay close attention to the instructions on this form
before completing the reverse side and filing the form.
INSTRUCTIONS FOR COMPLIANCE WITH SECTION 112.3143, FLORIDA STATUTES
ELECTED OFFICERS:
A person holding elective county, municipal, or other local public office MUST ABSTAIN from voting on a measure which inures
to his special private gain. Each local officer also is prohibited from knowingly voting on a measure which inures to the special
gain of a principal (other than a government agency) by whom he is retained.
In either case, you should disclose the conflict:
PRIOR TO THE VOTE BEING TAKEN by publicly stating to the assembly the nature of your interest in the measure on
which you are abstaining from voting; and
WITHIN 15 DAYS AFTER THE VOTE OCCURS by completing and filing this form with the person responsible for recording
the minutes of the meeting, who should incorporate the form in the minutes.
APPOINTED OFFICERS:
A person holding appointive county, municipal, or other local public office MUST ABSTAIN from voting on a measure which
inures to his special private gain. Each local officer also is prohibited from knowingly voting on a measure which inures to the
special gain of a principal (other than a government agency) by whom he is retained.
A person holding an appointive local office otherwise may participate in a matter in which he has a conflict of interest, but must
disclose the nature of the conflict before making any attempt to influence the decision by oral or written communication, whether
made by the officer or at his direction.

by Councilman Blank. The motion carried unanimously (4-0), with
Councilman Taplin absent, thus becoming
ORDINANCE NO. 368
ORDINANCE OF BAL HARBOUR VILLAGE ADOPTING A
BUDGET FOR THE DEPARTMENT OF TOURISM FOR THE
PERIOD OF OCTOBER 1, 1991 TO SEPTEMBER 30,
1992 IN THE AMOUNT OF $1,387,414; AUTHORIZING
EXPENDITURES; ESTABLISHING AN EFFECTIVE DATE.
7. Other Business: None.
8. Adiourn: A motion to adjourn was offered by Assistant
Mayor Hirschl and seconded by Councilman Blank. The motion carried
unanimously (4-0), with Councilman Taplin absent, and the meeting
adjourned at 5:25 p.m.
