NATAPUW anis KATHLEEN M. NATAPOW, his wife ca:led "NATAPOWS") are the owners of that certain property legally described as follows: o w Lot 1, H.V. POPE SUBDIVISION, according to the z Plat thereof on file in the Office of the Clerk = of the Circuit Court in and for Palm Beach 0 County, Florida, as recorded in Plat Book 31, Page 53; (hereinafter called the "Property"); WHEREAS, the TOWN OF GULF STREAM has agreed, pursuant to the approval of building plans for construction of the residence by NATAPOWS upon the Property, to provide for a uniform scheme of maintenance of a portion of Wrightway; WHEREAS, NATAPOWS and the TOWN OF GULF STREAM wish to provide for the maintenance of the following portion of Wrightway (called "Maintenance Area"), to wit: that portion of Wrightway (a/k/a Pope Drive as shown on the Plat of H.V. POPE SUBDIVISION) located north of the easterly extension of the southern boundary of the Property. NOW THEREFORE, in consideration of the sum of Ten Dollars ($10.00) paid in hand by the parties to each other, and the mutual covenants and conditions contained herein, it is hereby agreed as follows: 1. NATAPOWS, including any future owners of the Property (called "Owner of the Property") shall install and maintain the pavement of the Maintenance Area. 2. Such maintenance shall include keeping the pavement in good condition to no less than the same standard as the rest of Wrightway except t.a" Cwner --f the y whall have the right to use ._ Property _ another pavement materials and surfaces or other ornamental treatment. 3. All such maintenance by Owner of the Property to the Maintenance Area shall be at the cost and expense of the Owner of the Property. 4. The obligation of maintenance set forth herein shall be binding upon the heirs, successors and assigns of NATAPOWS and shall be binding upon future Owners of the Property as a covenant running with the land. 5. This Agreement may be amended only upon the unanimous agreement of the current Owner of the Property and the TOWN OF GULF STREAM. 6. The Owner of the Property shall save, defend and hold the TOWN OF GULF STREAM harmless from any and all claims which may arise as a result of the Owner of the Property's construction and maintenance of this portion of Wrightway. 7. The NATAPOWS, their heirs, successors and assigns, hereby agree that their c..,,isLructi��-.: and maintenance of the Maintenance Area shall be done in a manner so as not to preclude the use by the travelling public of this portion of Wrightway, and access to same shall remain open to the public. 8. The Maintenance Area maintained by the Owner of the Property shall be maintained neatly and in a safe manner so as to avoid deterioration and/or hazard to others. 9. The TOWN OF GULF STREAM shall have final approval over the plans for the improvement and maintenance of the Maintenance Area and shall have the authority from time to time to compel the Owner -1- DEC 2 2 1987 W ORB 5526 Pg 101 C-4 of the Property to maintain wrightway in a condition reasonably z:`�2satisfactnry to the TOWN OF GULF STREAM In the event the Owner of ai the Prop.-ity fails to comply with the written requests of the TOWN ;REX"OF G '.r STREAM in this regard, the TOWN OF GULF STREAM shall have - �oc..i the authority to improve the Property in a manner satisfactory to w 03 3the TOWN OF GULF STREAM and charge the cost of said improvements to Ci Ca =w::- the Owner of the Property, and in the event the cost of the improve - cc ments are not paid by the Owner of the Property within ninety (90) z days of said improvement, to lien the Property. Provided, however, that TOWN OF GULF STREAM shall not assume such full control without first giving the Owner of the Property thirty (30) days prior written notice and the right to cure the deficiency of performance. 11. "NATAPOW" and the term "Owner of the Property" shall mean the Owner(s) of the Property from time to time. DATED this 3&b day of %flu , 1987.
