THIS COVENANT made this .7 "'day of fN6 2002 by HARRY
SARGEANT, III and DEBORAH SARGEANT (collectively the "SARGEANTS") in favor of
the TOWN OF GULF STEAM, a political subdivision of the State of Florida (the "TOWN").
Preliminary Statements
A. The SARGEANTS are the owners in fee simple of those certain parcels of real
property ("Property") described as:
Lots 11, 11A, 12 and that part of Lot lA described as:
Begin at the Northwest comer of said Lot LA; thence Easterly, along the
North Line of said Lot LA, a distance of 83.0 feet to the Northeast corner of
said Lot 1A; thence Southwesterly, making an angle with the last described
course of 45° 00' 00" measured from West to Southwest, a distance of 9.90
feet to an intersection with a line being 7.00 feet South of, as measured at right
angles and parallel with the said North line of Lot IA; thence Westerly, along
said parallel line, a distance of 75.56 feet to an intersection with the West line
of said Lot 1A; thence Northerly, along the said West line of Lot IA, a
distance of 7.01 feet to the said Northwest comer of Lot 1A and the Point of
Beginning;
of McLOUTH SUBDIVISION according to the Plat thereof as
recorded in Plat Book 25, Page 67 of the Public Records of Palm
Beach County, Florida.
B. The SARGEANTS are presently having a two-story Anglo Caribbean design
single family dwelling and a guest house (collectively the "Houses") constructed on the
Property pursuant to permits for same issued by the TOWN.
C. It is a condition precedent to the issuance by the TOWN of a Certificate of
Occupancy for the Houses that the SARGEANTS shall have signed and delivered this Covenant
to the TOWN.
IN CONSIDERATION OF the benefits which will accrue to the SARGEANTS from the
construction and occupancy of the Houses, the SARGEANTS do hereby covenant and agree
with the TOWN as follows:
1. All of the Preliminary Statements are true and correct and, by this reference,
republished and confirmed.
2. In connection with the construction of the Houses having a street address of 1420
North Ocean Boulevard, Gulf Stream, Florida 33483, the SARGEANTS covenant with the
TOWN that so long as light moss green flat roof tiles exist on the Houses, the color of the
Houses shall be limited to a light creamy yellow with pure white trim. In the event the
SARGEANTS desire to utilize any other color or colors, then they agree that their selection of
such other color or colors must first be submitted to and approved by the Architectural Review /
Planning Board of the TOWN.
3. This Covenant shall constitute a covenant running with the Property, shall be
recorded in the Public Records of Palm Beach County, Florida and shall remain in full force and
effect and be binding on the SARGEANTS, their heirs, personal representatives, successors and
assigns unless and until such time as this Covenant shall be released in writing by the TOWN.
IN WITNESS WHEREOF, the SARGEANTS have set their hands as of the day, month
and year first above written.
