FeesMember Pederson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2014-47 RESOLUTION REVOKING APPROVAL OF THE WAIVER OF CERTAIN DEVELOPMENT FEES; REVOKING RESOLUTION 2013-49 WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, on June 4, 2013, the City Council adopted resolution 2013-49, approving the waiver of certain development fees for the construction of approximately 32 affordable rental housing units by Dominium at Outlot D, Medina Clydesdale Marketplace (the "Property"); and WHEREAS, the Property is located in Tax Increment Financing District No. 1-9 (the "TIF District"); and WHEREAS, the City Council had discussed reimbursing such fees using tax increment generated by the TIF District; and WHEREAS, funds from the TIF district were only permitted to be expended until July 9, 2014; and WHEREAS, the Dominium project did not proceed as originally proposed nor proceed within the timeframe in which the City could expend funds generated from the TIF District. NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota does hereby revoke Resolution 2013-49 and the approval of any fee waivers contained therein. Dated: August 6, 2014.
