BOARD OF HEALTH MEETING
WEDNESDAY JANUARY 2 , 2019 AT 7: OOPM FEB 7 l ; 4 -ill
TOWN HALL, ROOM A
Board members present: Carmen Scherzo, DVM , Chairman; Annette Graczewski , MT (ASCP), Vice Chairman; Joe Ford;
Penny Hausser Holeman, MPH, MA, MS and Nancy Leach, PharmD
Others present: Nancy Ellis Ice , CHO , RS , MPH , Health Director and Tammi Mason , Senior Department Assistant
1 . Chairman 's Announcements :
Happy New Year.
Dr. Scherzo spoke again about the Board going through the Chair when speaking at the Board meetings . .
Town Council appeared before the Planning Board and provided guidance after special town meeting to go over what the
Repercussions of the newly voted in ban on recreational marijuana . The new bylaw won 't become effective until after the
attorney general approves it. New applications can still be submitted because there is a current zoning bylaw which has to
be followed . A town bylaw doesn 't supersede a zoning bylaw.
2 . Ryder & Wilcox - Local and Title 5 variance requests for 450 Lower Road
Stephanie Sequin presented this to the Board . This is a 16 , 000sf lot with a 3 bedroom house on it. There is a bordering
vegetated wetland ( BVW) on one side of property and a drainage easement on the other side . The system is from 1994
and is a mounded system .
The system started to fail last august and now needs to be replaced ( leaching ) . The whole property is within 100 foot of
the BVW. The new SAS will go back into the existing spot where the current one is . No perc was performed . They did
take a sample and sent to a lab but were not able to get a sieve analysis from that sample . Have sent in a new one and
are waiting on results .
The following variances are requested :
1 . To allow the SAS to be 11 ' from the foundation
2 . To allow the SAS to be 4 ' above observed groundwater
3 . To allow the SAS to be 66 ' from a wetland
4 . To allow no adjustment to observed groundwater elevation
The Conservation Commission meeting was in December. They were ok with proposal but didn ' t issue anything yet in
case the Board of Health wanted any changes .
Mrs . Graczewski asked about the perc test from 1994 . Mrs . Sequin stated that on the plan it says perc on installation . She
stated that she wasn 't sure if it was done or not. Mrs . Graczewski asked if anyone was living there . Mrs . Sequin stated
that there was currently one person living there .
Mrs . Graczewski stated that she feels uncomfortable because no perc was done and asked when the sieve analysis
would be available .
Dr. Scherzo asked if the bad sand was coming out and title 5 sand was being brought in . Mrs . Sequin stated that some
soil will be brought in .

Mrs . Graczewski thinks it would be better to continue this until the sieve analysis comes back.
Motion : Continue this until the February meeting so consideration of all information can be done .

3 . Winston Steadman II - Noncompliance: 160 Old Red Top Road
Mr. Steadman was not present.
The Board asked Mrs . Ice to check with county to see if it's been updated .
Motion : Encourage Mr. Steadman to get the testing done and submitted to the County and get results to the Board
of Health before the February meeting . Let the homeowner know also .
Motion : Joe Ford Second : Annette Graczewski Vote: 5- 0-0 Action : Motion carried
4 . Overview of Changes to 105 CMR 590 . 000 re: Sous Vide
Mrs . Ice went over the changes . The State sanitary code also includes the 2013 federal food code . There is a section on
Sous Vide changes . No variance is required now, but written documentation is still required .
Mr. Ford stated that this type of cooking is getting more and more popular.
5 . Discussion - interstate gas pipelines
In 2017 the Board voted not to participate . There are 3 towns on cape that have signed on to the letter to Governor Baker.
Mrs . Ice stated that she did included the email (in the Board 's packet) she received from T. Stephen Jones but she has not
had any response from him to her request. At the time the Board last discussed this , there were a lot of issues , weak
Infrastructure and not enough gas for residents .
Ms . Leach and Mr. Ford are not in favor of sending a letter to Governor Baker.
Dr. Scherzo stated that fracking and replacing the gas line are 2 different things . There are lots of health hazards with this .
Mr. Ford asked if there are there any sites in MA that are fracking and if there were any plans on doing this in Mass .
Motion : Do not send a letter to Governor Baker

6 . Discussion : Cape Cod Grow Lab Supplemental Documents
Dr. Scherzo spoke about the questions he had that Mrs . , Ice had forwarded to the Board .
His first concern was the tight tank . Mrs . Ice stated that she wasn 't sure if this was a title 5 issue . If it is for floor drains , it
falls under the plumbing code .
Dr. Scherzo thinks that the testing results should also come to the BOH , more monitoring wells should be required and

Mrs . Graczewski spoke about the monitoring wells that already exist and stated that they are testing for contamination
from the previous business that was on the property .

Mr. Ford thinks that it would make the board look unprofessional if they were to ask them to monitor for for marijuana in
the groundwater.
Mrs . Graczewski stated that this is a grow lab only .
Motion : Recommend that they put an I/A system in to reduce the nitrogen load to Pleasant Bay in conjunction with the 3
other towns .

7 . Discussion : Planning Board application for 2624 Main Street
Mrs . Ice stated that the septic system would need to be inspected .
8 . Discussion : Planning Board application for 150 Gulls Way
Mrs . Graczewski stated that if this property is subdivided , there doesn 't appear that there is anywhere on the lot for a new
septic to be 300 feet from the pond .

9 . Topics the Chairman did not anticipate
Mrs . Graczewski asked if there could be a cut-off date for materials to be submitted so that she is not looking at new items
on the day of the meeting .
Mrs . Graczewski told the Board that she attended a NEHA seminar
