GOV BOARD OF HEALTH MEETING BRE111IcTER TOU11 CLERK WEDNESDAY DECEMBER 5 , 2018 AT 7 : OOPM ' i FFA , : elM TOWN HALL, ROOM A Board members present: Carmen Scherzo, DVM, Chairman; Joe Ford; Penny Hausser Holeman, MPH, MA, MS and Nancy Leach, Pharml) Board members absent: Annette Graczewski, MT (ASCP) Others present: Nancy Ellis Ice, CHO, RS, MPH , Health Director and Tammi Mason, Senior Department Assistant 1 . Chairman 's announcements Dr. Scherzo spoke about the Board going through the Chair when speaking at the Board meetings . The Brewster Fire Department and the Massachusetts Department of Fire Safety have produced handouts on holiday Safety tips and safety when heating your home. They are available on the Town website. 2 . J . M . O' Reilly & Associates, Inc . — Local variance request for 394 Run Hill Road John O' Reilly presented this to the Board . The septic system was installed in 2001 . It is a 2 bedroom cottage with an expansion into a 5 bedroom . It is 550 gallons per day. The SAS is 200 feet away from pond . Setback to groundwater is exact and the system is in good working condition . Dr. Scherzo stated that it looked like there was room to move the system but asked about the power line. Mr. O' Reilly stated that when the system was installed there was a well Dr. Scherzo stated that it looks like it would be another 20 years until it gets to the pond . Mr. Ford asked if groundwater was flowing towards pond . Mr. O ' Reilly stated that it was . Motion : Approve the variance for the SAS to remain 200' from the pond . Motion : Penny Holeman Second : Joe Ford Vote: 4 -0 -0 Action : Motion carried 3 . J . M . O ' Reilly & Associates, Inc . — Title 5 and Local variance requests for 115 The Tides Court John O' Reilly presented this to the Board . He stated that they did receive Conservation approval to reconstruct the dwelling . There is an older system on the property right now. There is a coastal dune and a coastal bank. They are going to pull the structure back from those resources and move it away from the coastal dune . Mitigation and restoration of the dune will have to be done . A new title 5 system is proposed . They have sandwiched the leaching and tank as close as they can . Variances requested are : WWW.BREWSTER-MA . GOV BOH 12/5/2018 Minutes Page 2 1 . To allow the SAS to be 6. 5 ' to property line (really 6) 2 . To allow the SAS to be 5 . 8' to the cellar wall 3 . To allow the tank to be 6 . 8' to a property line 4 . To allow the tank to be 7 .4' to the cellar wall 5 . To allow the SAS to be 25 ' to the dune Peres were done . Water was 5 . 5 ' down . The system will be 9 ' about the adjusted groundwater. They will be providing a poly liner around foundation and retaining wall . This is not considered new construction . It will remain a 4 bedroom home (rebuilt) Dr. Scherzo asked if any of the loam will be retained . Mr. O' Reilly said no and that the loamy sand will be removed . Dr. Scherzo asked if the liner extended to the NE corner of the house . Mr. O' Reilly stated that it would not and that he is comfortable with the liner as it is proposed . Motion : Finding that this is an improvement, approve the variances as requested . Motion : Joe Ford Second : Penny Holeman Vote: 4 -0 -0 Action : Motion carried 4. Down Cape Engineering Inc. — Title 5 variance request for 143 Ellis Landing Road Dan Ojala presented this to the Board . This is a compact lot with 4 bedrooms . Mr. Ojala is asking for a variance to allow the SAS to be 1 .4' from the property line. Motion : Finding that this system is an improvement, there is not a lot of room on the lot and there are no abutter issues, grant the variance as requested . Motion : Joe Ford Second : Penny Holeman Vote: 4- 0- 0 Action : Motion carried 5 . Down Cape Engineering Inc. — Approval of a Nitrogen Aggregation plan — Windrift Acres Dan Ojala presented this to the Board . The Planning Board has given approval . It is a compact development. Houses are clustered and there is open space. It is in zone 2 . They would like them to be 4 bedroom homes . It will be 2 . 8 parts per million nitrogen levels The property is 23 . 9 acres . There are no wetlands . They are looking for a total of 36 bedrooms . Using standard DEP nitrogen loading numbers . There will be deed riders for each lot limiting them to 4 bedrooms . Open space will show no bedrooms on a deed rider. Motion : Approve the Nitrogen Aggregation Plan for Windrift Acres Motion : Joe Ford Second : Penny Holeman Vote: 4- 0- 0 Action : Motion carried 6. Lucretia Hickok — 21 Fisher Point Road — variance request from Leaching Facility Setback Regulation (continued from November 7, 2018) Deirdre Conway (owner' s realtor) was present. It was noted that the Leach pit is only 225 feet from pond . Dr. Scherzo stated that he would like to see a different kind of system installed there . BOH 12/5/2018 Minutes Page 3 Mr. Ford asked if the home was for sale. Ms . Conway stated that it is for sale . Motion : Deny the variance request seeing as the system is very old , Motion : Joe Ford Second : Penny Holeman Vote: 4 -O -O Action : Motion carried 7. Mark O ' Brien — Captains Golf Course use of pesticides Mark O' Brien was present. Dr. Scherzo spoke about the Selectmen' s policy about not spraying Glyphosate . Mr. O' Brien Stated that the golf course uses less than 20 oz. a year. It has never been purchased, it has been in inventory for many years , He stated that he was not aware of the Selectmen 's policy. Motion : Make a formal request to the golf course that they stop using the pesticide and not purchase it in the future . Ms , Leach asked if there was any substitute for it. Mr. O' Brien stated that there are other products that could be used . Motion : Joe Ford Second : Penny Holeman Vote: 4-O - O Action : Motion carried 8. Winston Steadman — failure to submit I/A sample/inspection reports to the County The Board asked that Mrs . Ice send a letter requesting him to attend the next meeting , 9. Kings Landing updated report on the treatment plant Mrs . Ice stated that she had been informed that things are getting better and a repair is being done. Residents were given a letter recommending that they don ' t use certain things , 10. Discuss email regarding letters to Governor Baker re: Natural gas pipelines Dr. Scherzo spoke about a 2017 BOH meeting at which the Board voted not to send a letter to the Governor. This will be continued until there is a full board present. 11 . Topics the Chairman did not anticipate The Board agreed to not meet on December 19, 2018 and hold their next meeting on January 2, 2019 . Informational items were noted . Meeting adjourned at 8:OOPM
