WEDNESDAY NOVEMBER 7 , 2018 AT TOOPM
TOWN HALL , ROOM B
Board members present: Carmen Scherzo , DVM , Chairman , Annette Graczewski , MT (ASCP) , Vice Chairman ; Joe Ford ;
Penny Hausser Holeman , MPH , MA, MS and Nancy Leach , PharmD
Others present: Nancy Ellis Ice , MPH , CHO , RS , Health Director and Tammi Mason , Senior Department Assistant
1 . Chairman 's announcements :
Dog Park Development Committee is moving forward with design work and they are seeking public input. The next
meeting is on November 15th at the Town Hall . The focus is on park design concept and design location .
Cape Cod Healthcare in conjunction with the VNA and the Brewster Board of Health will hold a flu clinic on November 81h
from 1 0- 1 2 at the Brewster Baptist Church .
Senior Environmental Corp will do radon testing for anyone on Cape Cod . The cost is $ 30 . Homeowners can register by
calling 3944630 X524
George Huefelder has received the 319 grant for 2018 . This will help reduce phosphorus to the ponds from the septic
systems . More information to follow.
2 . Alex Carlson - variance request for 2129 Main Street
Mr. Carlson asked to withdraw this from the agenda .
3 . J . C . Ellis Design Co . , Inc. - Title 5 variance for 40 Red Wing Cartway
Jason Ellis presented to the Board . This is a 3 bedroom house with an old title 5 . They will be upgrading to a new system
due to the SAS failing . The SAS will be in the driveway . The water lines will be reconfigured . Mr. Ellis is requesting a 5-
foot variance from the lot line . This does push the system away from the water. He is also asking for no reserve area .
Mrs . Ice asked if this had gone before Conservation Commission yet. Mr. Ellis stated that he had filed an Administrative
Review and was told by the Conservation Agent to submit a letter stating that no machinery would be used within the work
limit.
Dr. Scherzo stated that since there was no increase in flow there was no need to ask for the no reserve area variance .
Mrs . Graczewski asked how the system was determined to be in failure . Mr. Ellis stated that he went to do a Title 5
inspection and realized immediately that it was in failure so moved on to upgrading the system .
Motion : Finding that this is an upgrade and will provide better treatment and is further away from the Coastal Bank,
approve the 5 ' variance request. Pending Conservation Commission approval .
Motion : Annette Graczewski Second : Joe Ford Vote: 5-0-0 Action : Motion carried
4 . Bass River Engineering - Title 5 and local variance requests for 59 Spring Lane
The engineer requested that this be continued until he could get Conservation Commission approval .

5 . Ryder & Wilcox - Local variance requests for 80 Mill Pond Road (previously granted in 2016 and extended to
2017)
Stephanie Sequin presented this to the Board . Mike Smith , owner, was also present. They are requesting variances that
had previously been granted in 2016 . They are as follows :
1 . Allow the proposed SAS to be 215' from Lower Mill Pond
2 . Allow the proposed reserve area to be 210' from Lower Mill Pond
3 . Allow the proposed SAS and reserve area to be within the well protection zone of the proposed
locus well
4 . If necessary : to allow the SAS to be within twenty feet of the foundation
The lot consists of 40 , 000 sf of property . The entire property is within 300 feet to pond , There is no town water. The
previous owners were trying to sell it and had to get an extension for the variances . Those expired in February of 2018 .
The current owner brought pictures of the room above the garage . This room will be a craft room . There is heat
and is separate from main house . There is no door at the bottom or the top of the stairs .
Mrs . Graczewski feels that the craft room could be a potential 4th bedroom .
Mrs . Sequin stated that in the building code (for a room attached to a garage) you have to have 2 doors to call it a
bedroom .
Motion : -extend the variances for another year with an unfinished room . NL seconded .

Motion : Approve the variances with the condition that the system be upgraded to a 4 bedroom .

Mrs . Graczewski withdrew the motion .
Mrs . Sequin asked if she and the owners could have a few minutes to discuss things before the Board voted .
Mrs . Grazcewski withdrew her motion .
Mrs . Sequin and the owners were back in the meeting at 8 : 20PM .
Mrs . Sequin went back and looked at adding the extra septic capacity for a 4th bedroom , They would need a variance from
the foundation to the SAS . It would be about 18' instead of the 20 ' that is currently requested .
Motion : Approve the 4 bedroom system with the 85 ' variance for the SAS to the pond , the 90' variance from the reserve
area to the pond , the reserve are to be within the well protection zone and a 2 ' variance for the SAS to the foundation ( if
necessary)
Motion : Joe Ford Second : Penny Holeman Vote: 5 -0-0 Action : Motion carried
6 . Lucretia Hickok - Local variance request for 21 Fisher Point Road
Owner was not present.
Mrs . Graczewski stated that she did a site visit and the lot is heavily vegetated and there is a high drop to the pond .
Dr. Scherzo asked about the depth to groundwater. He is concerned with the fact that it is a leach pit.

Motion : Continue this so that the owner could have some representation to answer questions .

7 . Mark Nelson - Discussion on Brochure and Guidance Documents with regards to Septic Systems and Ponds and
Pleasant Bay Watershed Permit
Mark Nelson and Chris Miller were present. Mr. Nelson gave an update of the results of the charrette . He spoke about the
memo he submitted regarding the Draft Variance Guidance , and stated that they board could vote to adopt this and it
wouldn 't change the current regulation at all .
Dr. Scherzo believes this should go on the town website and not the Horsley Witten website . He had a few other
comments and stated that he thought improving the vegetated buffer should go through a town meeting and not the BOH .
Ms . Leach asked about what kind of money this regulation would be asking people to spend .
There was back and forth discussion on issues .
Mr. Ford stated that he would like to see the board adopt this guidance .
Mr. Nelson will add tonight' s comments and come back if the board wants .
Mr. Nelson went on to talk about the Pleasant Bay part of this .
8 . Discuss Dr. Scherzo's request to send Town Counsel questions regarding the proposed Marijuana Regulation
This was brought back to the Board because they never actually voted on allowing Dr. Scherzo to send his questions to
Town Counsel .
Mr. Ford thought that adding to the letter that the Board had voted to postpone this indefinitely would be appropriate .
Motion : Allow Dr. Scherzo to submit his letter to Town Counsel
Motion : Penny Holeman Second : Nancy Leach Vote: 5- 0-0 Action : Motion carried
9 . Discuss Planning Board application for 1399 Freeman's Way
Mrs . Graczewski asked about nitrogen calculations . It was noted that this is not required by the BOH . The Water Quality
Review Committee will be looking at it .
Dr. Scherzo stated that the groundwater flow is to the east and monitoring wells are up-gradient and wondered if they
should be downgradient. He is concerned about the bottom of the leaching fields and wondered if an I/A system should be
required .
Motion : Note that the monitoring wells should be downgradient of the building and all industrial wastewater should be
treated offsite . This would be a new nitrogen source so it would be recommended that they put in a nitrogen
limiting technology on the site .

10 . Discuss letter from POCCA
Mrs . Ice stated that Brewster does not use herbicides . (Golf or Water Dept. ) . The Town has a policy to not use them .
The Board asked that Mrs . Ice send a letter thanking Laura Kelley and let her know that the town has a policy to not use
Pesticides .
11 . Topics the Chairman did not anticipate

Mrs . Graczewski stated that Doug Wilcox (Chairman of the WQRC) wrote a letter to the Planning board about accessory
dwellings that they include nitrogen sensitive systems in those specific areas .
Informational items were noted .
