Chairman 's announcements Dog Park Development Committee is seeking the public' s input about designs for the dog park at their next meeting on October 18, 2018 at 6PM at the Town Hall . Entomologist Larry Dapsis is starring in a 10 part digital series available on U -Tube . You can go to : http ://bit. ly/tickoloay to view it. Cape Cod Healthcare in conjunction with the VNA and the Brewster Board of Health will hold a flu clinic on November 8th from 10AM - 12PM at the Brewster Baptist Church . You must register online after October 26tH Voting polls will be open 7 : OOAM - 8 :OOPM on November 6th for the State Election . Early voting and absentee voting are available at the Town Hall from 10/22 — 11 /2 . Brewster Community Network will hold a public forum at 6 : 30PM at Brewster Ladies Library to give the candidates running for office a chance to speak. Mary Chaffee and Madhavi Venkatesan will be present. They are both running for the Assembly of Delegates and Leo Cakounes and Ronald Bergstrom will also be present, both are running for County Commissioner, 2 . Horsley Witten Group (Joe Henderson) 6 month update on the Wastewater Treatment Plan at Kings Landing Joe Henderson presented this to the Board . He stated that he is still seeing the same issues as before . There is a problem with Quaternary Ammonia . They are working with Winston Steadman, the operator and the company to try and solve the problems . They did install an aeration system but it is not working at the moment. Mrs . Grazcewski stated that all 3 parimeters are outside the upper limits . Mr. Henderson agreed that the parimeters were outside the upper limits . He stated that it has been hard to trouble shoot and believes the issue is coming from the cleaning products residents are using . Dr. Scherzo asked what the notice of non - compliance from DEP meant to him . Mr. Henderson stated " nothing " and said the owner needs to do something with regards to the reports . WWW.BREWSTER-MA . GOV BOH 10/ 17/2018 Minutes Page 2 Mrs . Graczewski stated that the system hasn 't worked well since it started and asked if they had a time frame for remediating the problems? Mr. Henderson stated that it could be 6 months to a year. He would have to discuss this with the owners and come up with a time frame. Winston Steadman stated that he does have a few ideas, but ultimately the owners have to come up with funding for the work to be done . Mrs . Ice asked if the owner prepared an educational brochure for the residents . Mr. Henderson stated that he does not think so . Motion : Submit a plan within 30 days for review, return in February for the annual review. Order owners to provide tenants with educational materials . Motion : Annette Graczewski Second : Joe Ford Vote: 4- 0-0 Action : Motion carried 3 . J . M . O' Reilly — local variance request for 113 Surrey Lane John O' Reilly presented this to the Board . The owners were present also . A septic inspection was done and passed with the exception of the SAS being 227 ' from the pond . The system is 52 feet above pond level and is designed for 8 bedrooms . The owners are looking to finish garage for a separate living quarters . Motion : Finding that new construction will only make it a 6 bedroom home and it is an 8 bedroom system . Grant the variance . Penny Holeman seconded for discussion . Mrs . Grazewski asked when the original system put in . Mr. O' Reilly stated that it was installed in 1987 but retrofitted in 1997 for the 8 bedrooms . Mrs . Grazewski stated that there is room to move the SAS . Mr. O' Reilly stated yes, but because it is a small amount of flow they felt a waiver was ok . Motion : Joe Ford Second : Penny Holeman Vote: 4 -0 -0 Action : Motion carried 4. J . M . O' Reilly — Title S variance request for 2129 Main Street John O' Reilly presented this to Board . Alex Carlson was also present. He is back with the same request as a few weeks ago, which is to put a full basement foundation within 1 ' of the septic tank. He believes he has addressed the concerns of the board from last meeting . The septic tank is lower than the foundation . Both Mr. O' Reilly and the excavator have no concerns that the tank will be damaged . They will be putting a membrane around it so there will be no chance of leaks . It is only the corner of the tank that is the closest to the foundation, which is the strongest part of the tank that is too close to the foundation . Mrs. Grazewski stated that she is still concerned with the tank being compromised . She believe that it can be moved . Mr. Carlson stated that he is going above and beyond with the barriers. The concrete pad isn't really an issue. Impermeable barrier is water proof and septic waste proof. Mr. O' Reilly stated that the septic tank is back vented through house. If there is a leak, that would be the release for it, as for the gas when excavation takes place, he doesn't see an issue because it is a vented system . BOH 10/ 17/2018 Minutes Page 3 Mr. Ford thinks there is a lot of area for malfunction with the excavation so close to foundation and tank. Dr. Scherzo asked Ms . Ice if the Board had ever granted this type of variance in the past. Mrs . Ice stated " not that she is aware of' . Dr. Scherzo stated that he is concerned with the tank being soclose . Motion : Deny the request for the 9 ' variance based on the board ' s concern about the closeness of the tank to the foundation and the chance of damage to the tank being done. Motion : Annette Graczewski Second : Joe Ford Vote: 3 - 0- 1 Action : Motion carried Mr. Carlson stated that he had addressed all the concerns from last time and doesn't think " personal " feelings should come into play. 5 . Meredith Baler — discussion re: 2671 Main Street Meredith Baler present. Steve Enos was present on behalf of Mason Pryme, Ms . Baier read the letter that she had submitted to the Board in regards to the trash receptacle being a problem . Mr. Ford asked how long Ms . Baler had owned the property. Ms. Baier stated for about 20 years . Mrs . Grazewski asked about the inspection that was done when the complaint was made . Mrs . Ice stated that there was no problem when she went out there . Ms . Baler stated that she did approach Mr. Pryme and spoke to him about the dumpster. She said that the assistant chef said he knew it was a problem . He stated that he did not want to pay for an extra pick up . That' s when she submitted the letter of complaint to the BOH . Mr. Enos was told by Mr. Pyrme that he did call the dumpster company and they did agree to come on that Tuesday. Not once has the pick- up been late. Dr. Scherzo asked if he was willing to do a twice a week pick up next summer? Mrs . Ice stated that Mr. Pyrme did say he would do that next summer. Mrs. Graczewsi stated that she did ask the building commissioner about the dumpster placement and he said that there was not a concern because this had been a restaurant for many years . Mr. Ford thinks that to meet in the middle, a twice a week pick up is warranted and stated that Memorial day through Labor day is the normal " summer" time frame. Motion : Order them to do a twice a week pick up . AG seconded . Motion : Joe Ford Second : Annette Graczewski (for discussion ) Mrs. Graczewski stated that she would like to leave it like it is for now and hope that the neighbors can work it out, Mr. Ford retracted motion . 6. Jenkins Well Drilling — discuss failure to submit required paperwork BOH 10/ 17/2018 Minutes Page 4 Mrs . Ice stated that she did attempt to contact them . She would like to try and talk to them before any action is taken . This will be continued to the next meeting . 7 . Discuss letter from Cathy Chamberlain re: Pets banned on beaches regulation Cathy Chamberlain, Brewster resident has a problem with the dog regulations . She stated that they are not the same as other cape towns . She thinks banning the dogs until October 111 is way too long and would like to see dog hours either in morning or night. She also stated that it is not fair that private beaches can bring their dogs to the beach but other residents of the Town can't. Mr. Ford state that he did agree that Brewster' s regulation are stricter than other Towns . Motion : Extend the regulations from Memorial Day to Labor Day. Motion : Joe Ford There was no second . Mrs . Graczewski stated that she had checked around to different towns and Brewster is in line with a few of them . Chris Miller- Natural Resource Director stated that the DCR regulations are responsible for a large section of beach and they don't allow dogs at all . _ I _ - - I - _I : r A . Dr. Scherzo stated that it probably wouldn 't be until 2020 . Motion : Leave regulations as they are . Motion : Annette Graczewski Second : Penny Holeman Ann Ellis, Brewster resident, feels the time frame is prohibitive . Beaches are not used much after Labor Day. Dr. Scherzo stated that he was struggling with the October 11t deadline . Mr. Miller talked about the air temp and the ability of bacteria to bloom . Rob Garside, Brewster resident, spoke about bacteria issue with seals and stated that he thinks the bacteria from the dogs would be minimal . Vote: 2 -2 -0. Discuss Smoking regulations Continue for 30 days until the next work meeting . 9 . Discuss the State and Local Well Regulation changes Tom and Sally Desmond (owners of Desmond Well Drilling) were present. They would like to see the abutter notification taken out of the regulation . They believe it serves no purpose . Model regulations are just suggestions, they are not requirements . The Board will continue this until the next work meeting . 10. Discuss the Selectmen' s " Public Engagement Policy" Dr. Scherzo stated that many Brewster residents don 't follow Brewster politics and said that if practical abutters should be notified about projects happening near them . Discuss the Regulation for Modification of Compliance Order Based on Financial Hardship Nancy has gotten some information to give to the Board . Continue this until a future date. 12 .
