The roll of the Bal Harbour Village Council was 16, 1991, in the Council Chamber at Bal meeting was called to order at 4:05 p.m. was called and those present were: Mayor Estelle Stern Assistant Mayor Andrew R. Hirschl Councilman Matthew B. Blank Councilman James E. Boggess Also present: Carole S. Morris, Village Manager Jeanette Horton, Village Clerk Stephen J. Helfman, Deputy Village Attorney Absent: Councilman Sol Taplin As a quorum was determined to be present, the meeting commenced. 2. Approval of Minutes: A motion was offered by Councilman Blank and seconded by Assistant Mayor Hirschl to approve the minutes of the July 16, 1991 Regular Meeting. There being no changes or additions thereto, the motion carried unanimously (4-0), with Councilman Taplin absent. A motion was offered by Assistant Mayor Hirschl and seconded by Councilman Blank to approve the minutes of the July 24, 1991 Special Meeting. There being no changes or additions thereto, the motion carried unanimously (4-0), with Councilman Taplin absent. A motion was offered by Councilman Blank and seconded by Councilman Boggess to approve the minutes of the August 21, 1991 Budget Workshop Meeting. There being no changes or additions thereto, the motion carried unanimously (4-0), with Councilman Taplin absent. A motion was offered by Councilman Boggess and seconded by Assistant Mayor Hirschl to approve the minutes of the August 26, 1991 Budget Workshop Meeting. There being no changes or additions thereto, the motion carried unanimously (4-0), with Councilman Taplin absent. 3. Presentations: Mr. Charles Nicholas, on behalf of Metro - Dade County Commissioner Mary Collins, presented Bal Harbour Council Mtg. - 9/16/91 1 Village with a poster commemorative of Flag Day and the Salute to the Troops Parade and expressed appreciation for our support of and participation in this event. In the absence of Chief Treppeda, Mrs. Morris read from his memo the accomplishments of Officer of the Month for August, 1991, Pam Robinson. Officer Robinson was presented a plaque and a check in the amount of $100. The Mayor and Council then joined in thanking her for her outstanding efforts. 4. Public Hearings: Mayor Stern opened a Public Hearing to hear complaints and consider adjustment of the Security Assessment Roll 91-1. Mrs. Morris advised Council that the Assessment Roll had been appropriately advertised and that the assessment amount for each owner remains the same as during the current year. There being no further discussion, Mayor Stern closed the Public Hearing. Mayor Stern then opened a Public Hearing to discuss a proposed increase in water rates from $13.50 per month or $1.35 per 1,000 gallons to $15.00 per month or $1.50 per 1,000 gallons. There being no discussion, Mayor Stern closed the Public Hearing. 5. Ordinances - Second Reading/Public Hearing: None. 6. Ordinances - First Reading: An Ordinance was read by title by the Village Clerk amending Chapter 6, Section 6-35, 6-36, 6-37, 6-38, 6-39 and 6-40 providing for amended building permit fees, etc. Mrs. Morris noted that this is the first increase since 1986 and is in line with neighboring communities. She advised Council that the plumbing, mechanical and electrical inspectors are paid 75% of the fee charged and the fees must be at a level to induce top-quality inspectors to continue performing these services. Councilman Boggess and Mayor Stern c-xpressed concern that these fees might be out of line and requested the Village Manager to research the South Florida Building Code for possible adjustment and requested this matter be deferred until such research is complete. An Ordinance was then read by title by the Village Clerk amending Section 6-27 of Chapter 6 which would provide for increased fees for licensed contractors working without a permit. Inasmuch as this proposed Ordinance is in conjunction with the previous Ordinance, this matter was deferred as well. The Village Clerk read by title an Ordinance which would prohibit the feeding of stray or ownerless cats and providing penalty therefore. Mayor Stern opened a Public Hearing to receive comments and discussion. There being none, the Public Hearing was closed by Mayor Stern. A motion to enact this Ordinance was offered by Councilman Boggess and seconded by Councilman Blank. The motion carried unanimously (4-0), with Councilman Taplin absent, thus becoming Council Mtg. - 9/16/91 2 AN ORDINANCE OF BAL HARBOUR VILLAGE CREATING SECTION 5-7; PROHIBITING THE FEEDING OF STRAY OR OWNERLESS CATS; PROVIDING PENALTIES; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND EFFECTIVE DATE. 7. Resolutions: The Village Clerk read by title a Resolution establishing water rates, as previously approved. Mayor Stern opened a Public Hearing and receiving no comments or discussion, closed the Public Hearing. A motion to adopt this Resolution was offered by Councilman Boggess and seconded by Councilman Blank. The motion carried unanimously (4-0) with Councilman Taplin absent, thus becoming RESOLUTION NO. 443 RESOLUTION OF BAL HARBOUR VILLAGE, FLORIDA ESTABLISHING WATER RATES; PROVIDING FOR AN EFFECTIVE DATE. A Resolution was then read by title, by the Village Clerk, adopting the Security District Assessment Roll for F/Y 91-92. Mayor Stern opened the Public hearing for comments, and there being none, closed the Public Hearing. A motion to adopt this Resolution was offered by Assistant Mayor Hirschl and seconded by Councilman Boggess. The motion carried unanimously (4-0), with Councilman Taplin absent, thus becoming RESOLUTION NO. 444 RESOLUTION OF BAL HARBOUR VILLAGE ADOPTING AN ASSESSMENT ROLL FOR THE SECURITY DISTRICT; PROVIDING FOR AN EFFECTIVE DATE. A Resolution was then read, by title by the Village Clerk, notifying Dade County of Bal Harbour's intention to exempt itself from the County's stormwater utility. Mayor Stern opened a Public Hearing to receive comments. After a brief discussion, Mayor Stern closed the Public Hearing. A motion to adopt this Resolution was offered by Councilman Boggess and seconded by Assistant Mayor Hirschl. The motion carried unanimously (4-0), with Councilman Taplin absent, thus becoming RESOLUTION NO. 445 A RESOLUTION OF THE VILLAGE OF BAL HARBOUR NOTIFYING THE BOARD OF COUNTY COMMISSIONERS OF METROPOLITAN DADE COUNTY AND THE DIRECTOR OF THE METROPOLITAN DADE COUNTY DEPARTMENT OF ENVIRONMENTAL RESOURCES MANAGEMENT THAT IT WISHES TO EXERCISE ITS OPTION TO EXEMPT BAL HARBOUR VILLAGE FROM THE PROVISIONS OF ORDINANCE 91-66; PROVIDING FOR TRANSMISSION AND EFFECTIVE DATE. Council Mtg. - 9/16/91 3 2f The Village Clerk read by title a Resolution recognizing City Government Week, October 7-11, 1991. Mayor Stern opened a Public Hearing to receive comments. She then advised Council that this celebration is sponsored by the Florida League and local involvement is encouraged. A Proclamation will be signed by Mayor Stern and placed in the lobby. There being no further discussion, Mayor Stern then closed the Public Hearing. A motion to adopt this Resolution was offered by Councilman Blank and seconded by Councilman Boggess. The motion carried unanimously (4-0), with Councilman Taplin absent, thus becoming RESOLUTION NO. 446 A RESOLUTION OF BAL HARBOUR VILLAGE RECOGNIZING CITY GOVERNMENT WEEK, OCTOBER 7- 11, 1991 AND ENCOURAGING ALL CITIZENS TO SUPPORT THE CELEBRATION AND CORRESPONDING ACTIVITIES. A Resolution was then read by title, by the Village Clerk, relative to amendment of the election laws to require all voter I.D. cards to carry photographs and signatures. Mayor Stern opened a Public Hearing and advised Council that it has come to the attention of the Dade League of Cities that many people are registering to vote who aren't citizens of the U.S. and this action would be part of the process to prevent same from occurring. There being no further discussion, Mayor Stern closed the Public Hearing. A motion was offered by Councilman Boggess and seconded by Councilman Blank to adopt this Resolution. The motion carried unanimously (4-0), with Councilman Taplin absent, thus becoming RESOLUTION NO. 447 A RESOLUTION OF THE MAYOR AND COUNCIL OF BAL HARBOUR VILLAGE REQUESTING THE STATE LEGISLATURE TO AMEND THE ELECTION LAWS TO REQUIRE THAT ALL VOTER IDENTIFICATION CARDS CARRY THE PHOTOGRAPH AND SIGNATURE OF THE VOTER. Another Resolution was read by title by the Village Clerk requesting amendment of the election laws to require proof of residency and citizenship when registering to vote. Mayor Stern opened a Public Hearing and hearing no comments, closed the Public Hearing. A motion to adopt this Resolution was offered by Councilman Blank and seconded by Councilman Boggess. The motion carried unanimously (4-0), with Councilman Taplin absent, thus becoming RESOLUTION NO. 448 A RESOLUTION OF THE MAYOR AND COUNCIL OF BAL HARBOUR VILLAGE REQUESTING THE STATE LEGISLATURE TO AMEND THE ELECTION LAWS TO REQUIRE PROOF OF RESIDENCY AND CITIZENSHIP WHEN REGISTERING TO VOTE. Council Mtg. - 9/16/91 4 8. Reports and Recommendations: A. Mayor and Council: Councilman Boggess, concerned about the process each year of adopting the Budget document, suggested quarterly financial workshops to familiarize Council with the Budget, thus reducing the burden of understanding and passage of this document each year. Council agreed therewith. Assistant Mayor Hirschl questioned Mrs. Morris as to the time schedule of the Appearance Code Ordinance. Mrs. Morris explained that after initial meetings with Village Counsel and the Building Officials, Mr. Weiss was asked to make revisions to this document and as yet, same has not been completed. She will notify Mr. Weiss of Council's concern that this been completed timely. Assistant Mayor Hirschl also advised Council of the recommendation of the Resort Tax Committee that the masterplan for landscaping of Collins Avenue be retained and performed in many phases. Mr. Stanley Whitman expressed his strong agreement therewith. Assistant Mayor Hirschl further requested the Village Manager to instruct Village Counsel to research increasing the Resort Tax and means by which same is amended. B. Village Attorney: none C. Village Manager: 1. Renewal of Advertising Services Agreemui.t: Mrs. Morris explained that it was the recommendation of the Resort Tax Committee that we enter into a one-year agreement for advertising/public relations services with the firm of Garber & Goodman Advertising, Inc. A motion was offered by Assistant Mayor Hirschl and seconded by Councilman Boggess that this agreement be approved and the Village Manager execute same. The motion carried. (3-0), with Councilman Blank abstaining' and Councilman Taplin absent. 2. Emergency Budget Transfer Ordinance: The Village Manager explained that the purpose of this Ordinance is to provide for transfer of funds between accounts in the General Fund to balance the budget. A motion was offered by Assistant Mayor Hirschl and seconded by Councilman Blank to enact this Ordinance. The motion carried (4-0), with Councilman Taplin absent, thus becoming 'Form 4 Memorandum of Voting Conflict attached hereto. Council Mtg. - 9/16/91 5 ORDINANCE NO. 364 AN EMERGENCY ORDINANCE OF BAL HARBOUR VILLAGE, FLORIDA TRANSFERRING FUNDS WITHIN THE GENERAL FUND BUDGET FOR FISCAL YEAR 1990-91. 3. Collins Avenue/96th Street Landscaping: Discussed under Mayor and Council's report. 9. Other Business: Stanley Whitman addressed Council relative to the median landscaping and requested Council proceed with the first phase of the masterplan. A motion was offered by Assistant Mayor Hirschl and seconded by Councilman Boggess to authorize the Village Manager to pursue this matter, meet with Architect William O'Leary and proceed appropriately with the bid process for the first phase of this project, not to exceed $750,000. 10. Adiourn: A motion to adjourn was offered by Councilman Boggess and seconded by Councilman Blank. There being no further business to come before the meeting, the motion carried unanimously (4-0), with Councilman Taplin absent, and the meeting adjourned at 5:12 p.m. (ram e '-y..
