CALL TO ORDER

The Council "Brown Bag" Work Session of August 29, 2003, was convened at 12:10 P.M.
by Mayor John Landwehr.
ATTENDANCE
The following Council Members were present:
Present: Berry, Ferguson, Gordon, Groner, Olsen, Viessman, Vogel
Absent: *Angle, Klindt, Weber
A quorum was present.
DISCUSSION OF AGENDA ITEMS
Mayor John Landwehr asked if the Council would agree to move up the USS Jefferson City
Submarine crew presentation so those people could leave to meet other commitments. The
Council agreed that would be a good idea.
*Councilman Clyde Angle arrived at this point in the meeting (12:11 PM).
CONSENT AGENDA
Councilman Richard Groner asked why permissive use items are placed on "consent
agenda" category. Councilman Clyde Angle stated he thought it would be more appropriate
if they were considered in a more formal manner. Councilman Michael Berry suggested that
someone explain in the Council Meeting that these items have previously been through the
Public Works and Planning Committee for consideration before they are brought to the
Council Meeting. Councilman Clyde Angle stated that would be acceptable as a minimum.
BILLS INTRODUCED
2003 -82: Councilman Richard Groner had questions about specific items related to the
work being done. Community Development Director Pat Sullivan stated he will find out
about the rigging and the power wash in answer Councilman Groner's questions.
2003 -97: Councilman Richard Groner asked about things that he thought should be
included in the packets. City Counselor Nathan Nickolaus explained that the parties have

not finalized the agreement yet and if it cannot be finalized, staff will ask that the bill (and
associated Bill 2003 -98) be withdrawn.
PENDING BILLS
2003 -70: Councilman Clyde Angle asked if staff had looked at the documents he requested.
In response to Council's questions, City Counselor Nathan Nickolaus stated that he has
determined that Evers and Company did not do anything actionable. Mr. Nickolaus stated
he has drafted a legal opinion on this matter, and it is considered "Attorney- Client
Privilege." He stated if the Council wanted to waive the Attorney - Client privilege, he could
hand it out. When asked why they would have to waive that privilege, he replied that
anything handed out in a public meeting becomes a public record. The Council agreed to
wait until this meeting adjourns and retrieve the opinion from Mr. Nickolaus at that time.
Councilman Richard Groner stated he did not need the opinion as he has already decided
to vote "no" on the bill.
NEW BUSINESS
Mayor John Landwehr asked Councilman Clyde Angle to report on the status of the budget.
Mayor John Landwehr asked the Council to let staff know between now and Monday night
if there will be any questions raised so staff can be prepared to answer them.
No official actions were taken since this was a work session only.
