"SPUD" WOODWARD DIRECTOR RE: Shore Protection Act Permit #401, 4 Volleyball Courts on the Dry Sand Beach Between 16th and 18th Streets, Tybee Island, Chatham County, Georgia Dear Mr. Lynn: The Shore Protection Committee considered and approved permit #401 referenced above on August 27, 2010 under the Shore Protection Act O.C.G.A. §12 -5 -230 et. seq. The permit placards and permit conditions are attached to this letter. All decision documents, as well as all other plans, documents and materials submitted during the application process become terms of this permit and are now enforceable conditions. The project consists of maintenance of four (4) existing volleyball courts on the dry sand beach between 16th and 18th Streets. The courts are approximately 26' x 52' and cover an approximate 8,112 square feet area. Wooden piles are buried to a depth of approximately 4'. Tape is on the sand to mark court boundaries. Standard and special conditions apply to this permit. Enclosed is the permit placard to be posted at the work site (within 24 hours) for the duration of the construction activity. Please note that you will also need to notify the Department when you are within 10 -30 days of beginning your project to obtain separate construction placards. DNR staff will arrange a site visit to confirm the project footprints before construction begins and to initial the construction placards at the identified intervals during the project. This placard will also need to be posted on the site during construction. Also enclosed is a Certification of Compliance that must be submitted to us within 30 days following completion of the permitted activity. Please include this compliance form with the post- construction survey, as required under the special conditions. This letter and attachments are to be held by you for your files and for inspection by any authorized persons. The expiration date for the permits is five (5) years from the date of issuance (i.e. August 27, 2015). However, no construction may commence within the area of jurisdiction of the Act until the expiration of thirty (30) days following the date of issuance, provided there is no legal appeal of this permit. Standard and special conditions apply to this permit. SHORE PROTECTION ACT O.C.G.A. § 12 -5 -230 STANDARD PERMIT CONDITIONS 1. The project must comply, as applicable, for areas permitted herein, with all other Federal, State, and local statutes, ordinances, and regulations, and the applicant must obtain all licenses and permits prior to commencement of construction. 2. This permit does not resolve actual or potential disputes regarding ownership of or rights in or over the property upon which the subject project is proposed, and shall not be construed as recognizing or denying any such rights or interests. 3. All plans, documents, and materials contained in this permit application, required by the Shore Protection Act O.C.G.A. 12 -5 -230 et. seq. are a part of this permit and conformance to such plans, documents, and materials are a condition of this permit. No change or deviation from these plans, documents, and materials shall be permitted without prior notification and approval by the Department or Committee. 4. No further encroachment or construction shall take place within State jurisdiction, except as permitted by the Shore Protection Committee. Any modification of the plans or structure in the jurisdictional area must be reviewed and approved by the Department prior to construction. 5. A construction placard will be required to be obtained from the Department up to 30 days prior to the start of project construction and must be posted at the site. This placard will include certain steps in the construction of the permitted project that must be approved by the Department prior to construction. 6. The exact location and configuration of this project must be reviewed onsite and approved by Department staff immediately prior to beginning construction. Minor changes to the location may be allowed or required in areas that have eroded or accreted subsequent to the original jurisdictional determination. No construction materials may be disposed of in the jurisdictional area of the Shore Protection Act. 8. Any incidental impacts associated with the construction of this project must be rectified by restoring areas to their pre - construction topographic and vegetative states. 9. The public shall maintain rights of ingress and egress on the foreshore beach area seaward of the ordinary high water mark. 10. If the permitted improvements are damaged, fall into disrepair, become dilapidated, are not meeting their expected usefulness, or are not maintained at a serviceable level, then it is the responsibility of the owner to remove the improvements. A new permit will be required to retain and repair the structure, improvement or asset if it loses its structural integrity and is no longer serviceable. 11. The Shore Protection Committee is not bound in the future to protect any asset or improvements authorized by the permit. 12. The permit must be posted onsite within twenty -four (24) hours of beginning construction. 13. A copy of the above conditions must be supplied to the person in charge of construction. SPECIAL CONDITIONS 1. The volleyball courts must be located seaward of the dunes and landward of the high water mark. Should the dry sand beach become narrowed as the high water mark moves landward and the dunes move seaward, or if the courts become an obstruction to pedestrian and/or emergency access along the waters edge, the courts shall be removed. To protect the sand sharing system and public and/or emergency access, monitoring is required. Monitoring must include the following: a. The distance from the ordinary high water mark to the most seaward edge of the courts; A 10' wide path must be available at the edge of the high water mark to allow for pedestrian access and emergency vehicle access along the beach. If the courts are within 10' of the high water mark or dunes the courts must be removed with the departments approval. b. The distance of the seaward toe of the dune to the volleyball courts; Should the dunes shift seaward, which is considered a natural function of the sand sharing system, every effort must be made to protect the dynamic area. Due to the active nature of volleyball and frequent "out of bounds" play, a 10' protective buffer area must exist between the seaward toe of the most seaward dune and the edge of the volleyball courts to protect the dynamic area. c. Vegetation growth at the site must be monitored. Any growth of pioneer dune vegetation must be noted and protected. The courts must be removed to allow for uninhibited growth of dune vegetation. 2. If the island comes under a hurricane warning the courts must be temporarily removed by the permittee until the storm threat has passed. 3. Public access must be maintained through the public crossovers in the area and along the high water mark. 4. No vegetation is to be disturbed beyond the limits of the project during construction. Any incidental impacts to the dunes or vegetation must be restored to pre - project vegetated and topographic conditions, any backfilling must be beach quality and obtained from an upland source and not from the beach. All construction must use hand tools only. No heavy equipment or vehicles are allowed on the beach in connection with this project. All construction must comply with Department of Natural Resources Sea Turtle Guidelines and the Tybee Island Beach Management Plan. Since maintenance and activities associated with the courts will occur during the period of May 1 to October 31, the area must be surveyed by a person in possession of a DNR Sea Turtle Cooperators Permit prior to commencement of any activities. If a turtle nest is found near the volleyball area DNR/WRD must be contacted and the courts are to be posted as unusable until a decision is made, on a case by case basis, as to whether the courts should be removed or the nest be moved. 6. "SI UD" WCIO( � ti`A Public Notice July 15, 2010 City of Tybee Island Volleyball Courts Tybee Island, Atlantic Ocean, Chatham County, Georgia This serves as notification from the Shore Protection Committee and the Georgia Department of Natural Resources of a request from the City of Tybee Island for a Shore Protection Act Permit under O.C.G.A. 12 -5 -230 et, seq. to place four Volleyball Courts on the Beach, Between 16th and 18th Streets, Tybee Island, Chatham County, Georgia. On June 18, 2010 the Department issued a Letter of Permission (LOP) to allow the temporary (30 days) placement of four volleyball courts on the beach south of the Tybee Pier between 16th and 18th Streets on Tybee Island. Since the LOP was for temporary placement, the City is requesting permanent placement of the volleyball courts on the beach. The four existing courts are located seaward of the dunes and landward of the ordinary high water mark on the dry sand beach. The existing courts are approximately 26' x 52' and cover an approximately 8,112 square feet area. Wooden piles are in place and buried to a depth of approximately 4'. Tape is on the sand to mark court boundaries. The proposal includes the City's Department of Public Works maintaining the structures using hand tools only and accessing the beach by crossovers. In coordination with Tybee Ocean Rescue and the Tybee Police Department, an 8- 10' wide path is to be maintained along the high water mark for emergency vehicle access along the beach. Public access is also to be maintained through the existing public crossovers in the area and along the high water mark. No vegetation currently exists in the area. Since the sea turtles are nesting during the period of May 1 to October 31, the volleyball court area is surveyed by a person in possession of a DNR Sea Turtle Cooperators Permit prior to commencement of any activities. All sea turtle nest will be relocated to a suitable site outside the proposed volleyball area. It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. In passing upon the application for permit, the permit issuing authority shall consider the public interest which for purposes of this part shall be deemed to be the following considerations: (1) Whether or not unreasonably harmful, increased alteration of the dynamic dune field or submerged lands, or function of the sand - sharing system will be created; (2) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with the conservation of marine life, wildlife, or other resources; and (3) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with reasonable access by and recreational use and enjoyment of public properties impacted by the project.
