HomeMy Public PortalAbout2014-074 Resolution Approving Mixed Use Stage 1 Plan for Dominium IncMember Anderson introduced the following resolution and moved its adoption: CITY OF MEDINA RESOLUTION 2014-74 RESOLUTION APPROVING A MIXED USE STAGE I PLAN FOR DOMINIUM, INC. AT 510 CLYDESDALE TRAIL WHEREAS, the city of Medina (the "City") is a municipal corporation, organized and existing under the laws of Minnesota; and WHEREAS, Medina Recreations, Inc. (the "Owner") owns approximately 4 acres of property within the City located at 510 Clydesdale Trail and legally described as: Outlot D, Clydesdale Marketplace, Hennepin County, Minnesota (the "Property"); and WHEREAS, Dominium, Inc. (the "Applicant") intends to purchase the Property has made an application for a Mixed Use Stage I Plan for the Property; and WHEREAS, pursuant to City regulations, the Stage I Plan is intended to establish the project boundaries, general layout, land uses, and densities in order to ensure overall compliance with the Comprehensive Plan upon development of the Property; and WHEREAS, the Applicant is proposing a mixed use development that consists of two and four unit townhouse buildings; and WHEREAS, the Planning Commission held a duly noticed public hearing on September 9, 2014 and heard comments from city staff and considered oral and written comments from all interested parties, and recommended approval to the City Council, subject to certain terms and conditions; and WHEREAS, the City Council reviewed the proposed Mixed Use Stage I Plan at the October 7, 2014 meeting, reviewed the recommendation of the Planning Commission and the staff report and attached material, and considered oral and written comments from all interested parties; and WHEREAS, the City Council makes the following findings of fact for the Mixed Use Stage I Plan: 1. The proposed uses and residential density meet the standards of the Comprehensive Plan and the Mixed Use District. 2. The proposed Stage I Plan provides appropriate transitions, adequate buffers, provides open space for recreational purposes, is designed consistent with design standards of the Mixed Use District, provides pedestrian connections and complements existing residential neighborhoods. Resolution No. 2014-74 October 21, 2014 3. The proposed development is consistent with the goals and policies of the Comprehensive Plan. 4. The proposed plan provides appropriate public utilities, streets, trails, and other infrastructure improvements. NOW, THEREFORE BE IT RESOLVED, that the City Council of Medina, Minnesota hereby approves the proposed Mixed Use Stage I Plan with the following conditions: 1. This Stage I Plan approval does not confer any development rights. Development shall be subject to Stage II Plan approval. Such development shall also be subject to all relevant ordinance requirements in place at the time of this subsequent approval. 2. The Owner and Applicant shall enter into an agreement to be recorded against the Property, in a form and of substance acceptable to the City Attorney, which describes the general layout, land uses, and densities required by the future development of the Property in order to ensure compliance with the Comprehensive Plan and other relevant regulations. 3. Any future development shall obtain Stage II and Stage III approval prior to any construction and these plans shall be consistent with the general layout, land uses, and densities depicted on the approved Stage I plan, except as modified herein Subject to density bonuses described in the Mixed Use zoning district, the maximum number of units shall permitted as stated within the MU District. 4.
