The project must comply, as applicable, for areas permitted herein, with all other Federal, State, and local statutes, ordinances, and regulations, and the applicant must obtain all licenses and permits prior to commencement of construction. 2. This permit does not resolve actual or potential disputes regarding ownership of or rights in or over the property upon which the subject project is proposed, and shall not be construed as recognizing or denying any such rights or interests. 3. All plans, documents, and materials contained in this permit application, required by the Shore Protection Act O.C.G.A. 12 -5 -230 et. seq. are a part of this permit and conformance to such plans, documents, and materials are a condition of this permit. No change or deviation from these plans, documents, and materials shall be permitted without prior notification and approval by the Department or Committee. 4. No further encroachment or construction shall take place within State jurisdiction, except as permitted by the Shore Protection Committee. Any modification of the plans or structure in the jurisdictional area must be reviewed and approved by the Department prior to construction. 5. A construction placard will be required to be obtained from the Department up to 30 days prior to the start of project construction and must be posted at the site. The exact location and configuration of this project must be reviewed onsite and approved by Department staff immediately prior to beginning construction. Minor changes to the location may be allowed or required in areas that have eroded or accreted subsequent to the original jurisdictional determination. 7. No construction materials may be disposed of in the jurisdictional area of the Shore Protection Act. 8. Any incidental impacts associated with the construction of this project must be rectified by restoring areas to their pre - construction topographic and vegetative states. 9. The public shall maintain rights of ingress and egress on the foreshore beach area seaward of the ordinary high water mark. 10. If the permitted improvements are damaged, fall into disrepair, become dilapidated, are not meeting their expected usefulness, or are not maintained at a serviceable level, then it is the responsibility of the owner to remove the improvements. A new permit will be required to retain and repair the structure, improvement or asset if it loses its structural integrity and is no longer serviceable. 11. The Shore Protection Committee is not bound in the future to protect any asset or improvements authorized by the permit. 12. The permit must be posted onsite within twenty -four (24) hours of beginning construction. 13. A copy of the above conditions must be supplied to the person in charge of construction. SPECIAL CONDITIONS 1. Access to the beach will be via an existing dune. No new beach access is permitted. 2. No construction or landscaping is permitted in the dune area. Should the dunes shift landwards, which is considered a natural function of the sand sharing system, every effort must be made to protect the dynamic area. 3. To protect marine turtle hatchlings, placement and use of exterior lighting must be consistent with the Department of Natural Resources' Wildlife Resources Divisions sea turtle nesting guidelines as well as the lighting ordinance of the City of Tybee. 4. Permittee must provide a post - construction survey of subject parcel depicting all structures. Landscaped trees must be designated as such on the survey. "SPUD" WOODWARD DIRECTOR Public Notice June 29, 2010 Mary Ellen Bowers Addition of Deck Seascape Condominium Tybee Island, Atlantic Ocean, Chatham County, Georgia 2Razirovial JUL 0 12w si BY:....... _ ..° This serves as notification from the Shore Protection Committee and the Georgia Department of Natural Resources of a request from Mary Ellen Bowers for a Shore Protection Act Permit under O.C.G.A. 12 -5 -230 et, seq. to add a deck to 28 Taylor Street Unit 4, Lot 1, Block 33, and a Portion of Beechwood Drive, Fort Ward, Tybee Island, Chatham County, Georgia. Shore Protection Committee Permit #116 issued July 10, 1984 authorized the construction and maintenance of Seascape Townhomes Condominium. The existing 3 -story condominium includes 6 individual units. Originally, decks were proposed to extend seaward from each unit. Currently, 5 of the 6 units have an open deck on the seaward side. The applicant's unit (Unit 4) does not have an open deck. Permit #116 has expired. The condominium parcel is approximately 26,434 square feet, of which approximately 12,010 square feet are located within the jurisdictional area. Impacts within jurisdiction include a portion of the cooled and heated space of the existing condominium building and the existing decks associated with 5 of the 6 units. Current impacts within jurisdiction total approximately 3600 square feet (30 %). The applicant proposes to construct and maintain a 7' x 19' (133 square feet) open deck attached to the Unit 4. The deck will be accessed from the existing sunroom located in the unit. No outside access is proposed. The deck will extend entirely over community property, which is currently maintained as mowed lawn. The proposed deck will be located approximately 78' from the landward toe of the most landward dune and approximately 276' landward of the ordinary high water mark. No heavy equipment or stock piling of materials is proposed in the dunes. The condominium Association currently uses a 3' wide dune path to access the beach, no crosswalk is proposed. The total jurisdictional area impacted by the existing and proposed structures would be approximately 3,733 square feet (31%). Approximately 8,277 square feet or 69% of the states jurisdictional area would remain undisturbed in its natural, vegetated and topographic state. It is the responsibility of the applicant to demonstrate that the project is not contrary to the public interest and that no feasible alternative sites exist. In passing upon the application for permit, the permit issuing authority shall consider the public interest which for purposes of this part shall be deemed to be the following considerations: (1) Whether or not unreasonably harmful, increased alteration of the dynamic dune field or submerged lands, or function of the sand - sharing system will be created; (2) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with the conservation of marine life, wildlife, or other resources; and (3) Whether or not the granting of a permit and the completion of the applicant's proposal will unreasonably interfere with reasonable access by and recreational use and enjoyment of public properties impacted by the project.
